<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp308A" name="308A"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec308A.1" title="308A.1   Department of natural resources and transportation commissions to cooperate."/><slim:Item idref="sec308A.2" title="308A.2   Funds."/><slim:Item idref="sec308A.3" title="308A.3   Certain elevated structures prohibited  exception."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp308A"><slim:Heading class="heading"><xhtml:span class="identifier">308A</xhtml:span><xhtml:span class="headnote">RECREATIONAL BIKEWAYS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec308A.1"><xhtml:div class="heading"><xhtml:span class="identifier">308A.1</xhtml:span><xhtml:span class="headnote">Department of natural resources and transportation commissions to cooperate.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The department of natural resources, in consultation with the state transportation commission, is hereby authorized to establish recreational bikeways within this state for the use, enjoyment, and participation of the public in bicycling, not including the use of motorized bicycles as defined in <xhtml:span class="iowaCodeRef">section 321.1</xhtml:span>. The routes established for such bikeways shall be designed to maximize the safety of cyclists and motorists and may utilize secondary roads when the normal flow of motor vehicle traffic will not be hindered, as well as other infrequently traveled roads, streets, parkways, and appropriate thoroughfares. Such bikeways shall be routed, wherever possible, to allow the enjoyment of scenic views and points of historical interest, and may connect state parks and other recreational areas throughout the state.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Bikeway routes shall be clearly marked with appropriate signs to guide cyclists and to alert motorists. Such signs shall be placed at intervals and designed in such form as prescribed by the department of natural resources in consultation with the state transportation commission.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The department of natural resources is hereby authorized to cooperate with county conservation boards, boards of supervisors, city councils, or any private organizations interested in the establishment of bikeways, and may consult with such groups in the planning of appropriate bikeway routes and related activities.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §308A.1</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2017 Acts, ch 54, §76</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 125, §1</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec308A.2"><xhtml:div class="heading"><xhtml:span class="identifier">308A.2</xhtml:span><xhtml:span class="headnote">Funds.</xhtml:span></xhtml:div><xhtml:p class="para">The department of natural resources may accept in the name of the state funds contributed by the groups specified in <xhtml:span class="iowaCodeRef">section 308A.1</xhtml:span> and the funds shall be used exclusively in the establishment of bikeways as provided in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. Additional funds as may be necessary in purchasing signs and otherwise carrying out the provisions of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> may be expended by the department of natural resources if authorized by the general assembly pursuant to appropriations for such purposes.
