<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp27" name="27"><slim:About class="header"><slim:Property type="string" name="checkinTime">11/09/2017 11:10</slim:Property><slim:Property type="string" name="taskInfo">1035:2EA13426-7FFE-45FA-9A7D-FDB596DDF9B4</slim:Property><slim:Property type="string" name="version">13</slim:Property></slim:About><slim:TOC><slim:Item idref="sec27.1" title="27.1   Definitions."/><slim:Item idref="sec27.2" title="27.2   Monitoring devices prohibited."/><slim:Item idref="sec27.3" title="27.3   Removal of monitoring devices."/><slim:Item idref="sec27.4" title="27.4   Limitation on political subdivisions."/><slim:Item idref="sec27.5" title="27.5   Public hospital exception."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp27"><slim:Heading class="heading"><xhtml:span class="identifier">27</xhtml:span><xhtml:span class="headnote">MONITORING DEVICES IN PUBLIC LOCATIONS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec27.1"><xhtml:div class="heading"><xhtml:span class="identifier">27.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Monitoring device”</xhtml:span> means a digital video or audio streaming or recording device that is part of a system of monitoring activity in an area or building using a system in which signals are transmitted from a video camera or microphone to the receivers by cables or wirelessly, forming a closed circuit.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Public hospital”</xhtml:span> means a hospital licensed pursuant to <xhtml:span class="iowaCodeRef">chapter 135B</xhtml:span> and governed pursuant to <xhtml:span class="iowaCodeRef">chapter 145A</xhtml:span>, <xhtml:span class="iowaCodeRef">263</xhtml:span>, <xhtml:span class="iowaCodeRef">347</xhtml:span>, <xhtml:span class="iowaCodeRef">347A</xhtml:span>, or <xhtml:span class="iowaCodeRef">392</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Public library”</xhtml:span> means a library district as described in <xhtml:span class="iowaCodeRef">chapter 336</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Public school”</xhtml:span> means a school district as described in <xhtml:span class="iowaCodeRef">chapter 274</xhtml:span>. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Reasonable expectation of privacy”</xhtml:span> means a person’s reasonable belief, under the circumstances, that the person can disrobe or partially disrobe in privacy without being concerned that the person is being viewed, photographed, or filmed when doing so.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2017 Acts, ch 135, §1, 6</xhtml:span>; <xhtml:span class="iowaActsRef">2017 Acts, ch 170, §31</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec27.2"><xhtml:div class="heading"><xhtml:span class="identifier">27.2</xhtml:span><xhtml:span class="headnote">Monitoring devices prohibited.</xhtml:span></xhtml:div><xhtml:p class="para">The state or a political subdivision of the state, including but not limited to a public library, public school, or other government office open to the public, shall not use a monitoring device in a toilet, bath, or shower facility; locker room; common area within such a facility or room, including an area where a sink or changing table is located; or other space open to the public where a person has a reasonable expectation of privacy.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2017 Acts, ch 135, §2, 6</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec27.3"><xhtml:div class="heading"><xhtml:span class="identifier">27.3</xhtml:span><xhtml:span class="headnote">Removal of monitoring devices.</xhtml:span></xhtml:div><xhtml:p class="para">On or before July 1, 2017, the state or a political subdivision of the state, including but not limited to a public library, public school, or other government office open to the public, using a monitoring device in a toilet, bath, or shower facility; locker room; common area within such a facility or room, including an area where a sink or changing table is located; or other space open to the public where a person has a reasonable expectation of privacy shall cease use of and remove the monitoring device. </xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2017 Acts, ch 135, §3, 6</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec27.4"><xhtml:div class="heading"><xhtml:span class="identifier">27.4</xhtml:span><xhtml:span class="headnote">Limitation on political subdivisions.</xhtml:span></xhtml:div><xhtml:p class="para">On July 1, 2017, any ordinance, resolution, rule, or other measure adopted or enforced by a political subdivision of the state permitting the use of a monitoring device in a toilet, bath, or shower facility;
