1012:79915610-F246-4004-83AB-AF12F60A131610/20/2023 15:0918267LIVESTOCK HEALTH ADVISORY COUNCIL267.1Definitions.As used in this chapter, unless the context otherwise requires:1“College of veterinary medicine” means the Iowa state university of science and technology college of veterinary medicine.2“Council” means the livestock health advisory council created pursuant to section 267.2.3“Fund” means the livestock disease research fund created in section 267.8.4“Livestock” means the same as defined in section 717.1.5“Member organization” means an organization appointing one or more members to the council pursuant to sections 267.2 and 267.3.6“Producer” means a person engaged in the business of producing livestock for profit.[C79, 81, §267.1]95 Acts, ch 43, §102023 Acts, ch 27, §1267.2Livestock health advisory council creation and membership.1A livestock health advisory council is created to support research of livestock diseases conducted by the college of veterinary medicine.2The council shall consist of all of the following:aThree cattle producers appointed by the Iowa cattlemen’s association, one of whom shall serve an initial term of one year, and one of whom shall serve an initial term of two years.bThree swine producers appointed by the Iowa pork producers association, one of whom shall serve an initial term of one year.cOne sheep producer appointed by the Iowa sheep producers association who shall serve an initial term of one year.dOne poultry producer appointed by the north central poultry association who shall serve an initial term of two years.eOne turkey producer appointed by the Iowa turkey federation who shall serve an initial term of three years.fOne milk producer appointed by the Iowa state dairy association who shall serve an initial term of two years.gOne practicing veterinarian appointed by the Iowa veterinary medical association.[C79, 81, §267.2]2023 Acts, ch 27, §2267.3Terms and vacancies expenses and compensation prohibited.1Except as provided in section 267.2, each member of the council shall be appointed by a member organization for a three-year term beginning on July 1 of the year of appointment. A member shall not serve more than two terms, including any portion of a term served pursuant to the filling of a vacancy. A vacancy shall be filled by the appropriate member organization in the same manner as appointing a full-term member.2A member of the council is not entitled to receive expenses incurred in the discharge of the member’s duties on the council. A member is also not entitled to receive compensation as otherwise provided in section 7E.6.[C79, 81, §267.3]2023 Acts, ch 27, §3267.4Supplies and services.Repealed by 2023 Acts, ch 27, §7.267.5Duties and objectives of council.The livestock health advisory council shall do all of the following:1Elect a chairperson and such other officers as it deems advisable. Officers of the council shall serve for terms of one year. A member shall not serve in any one office for more than two terms.2Meet as necessary at Iowa state university of science and technology. The council shall meet with the faculty of the college of veterinary medicine. The council may hold other such meetings as the council may determine necessary, or as required by section 267.6. An action taken by the council shall not be valid unless agreed to by a majority of the council members.3aBy the beginning of each fiscal year, make recommendations to the college of veterinary medicine concerning the expenditure of moneys in the fund.bThe college of veterinary medicine shall not obligate moneys in the fund for a fiscal year until the council makes timely recommendations for the expenditure of those moneys for that fiscal year as required in paragraph “a”.4File an annual report with the secretary of agriculture.[C79, 81, §267.5]92 Acts, ch 1246, §402023 Acts, ch 27, §4; 2024 Acts, ch 1170, §108267.6Iowa administrative procedure Act.The provisions of chapter 17A shall not apply to the council or any actions taken by it, except that any recommendations adopted by the council pursuant to section 267.5, subsection 3, and any rules adopted by the council shall be adopted, amended, or repealed only after compliance with the provisions of sections 17A.4 and 17A.5, and the publication requirements in section 2B.5A.[C79, 81, §267.6]2010 Acts, ch 1031, §57267.7Other moneys.In addition to moneys in the fund, the college of veterinary medicine may accept grants, gifts, matching moneys, or any other moneys for research into the diseases affecting livestock. The moneys may be from any source, public or private.[C77, §266.20; C79, 81, §267.7]2023 Acts, ch 27, §5267.8Livestock disease research fund — appropriation.There is created in the office of the treasurer of state a fund to be known as the livestock disease research fund. Moneys in the fund are appropriated for use by the college of veterinary medicine to conduct research of diseases affecting livestock.
