<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp261K" name="261K"><slim:About class="header"><slim:Property type="string" name="taskInfo">1035:F0572C3C-2A87-4A04-8187-56BD4EBA9CEC</slim:Property><slim:Property type="string" name="checkinTime">07/21/2025 13:53</slim:Property><slim:Property type="string" name="version">4</slim:Property></slim:About><slim:TOC><slim:Item idref="sec261K.1" title="261K.1   Definitions."/><slim:Item idref="sec261K.2" title="261K.2   Accrediting agencies  adverse action against institutions for compliance with state law prohibited."/><slim:Item idref="sec261K.3" title="261K.3   Civil action."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp261K"><slim:Heading class="heading"><xhtml:span class="identifier">261K</xhtml:span><xhtml:span class="headnote">ACCREDITATION OF PUBLIC INSTITUTIONS OF HIGHER EDUCATION</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec261K.1"><xhtml:div class="heading"><xhtml:span class="identifier">261K.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Accrediting agency”</xhtml:span> means an entity that provides accreditation of public institutions of higher education and that is not a government agency.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Public institution of higher education”</xhtml:span> means an institution of higher learning governed by the state board of regents or a community college.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2025 Acts, ch 62, §6, 9</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">NEW section</xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec261K.2"><xhtml:div class="heading"><xhtml:span class="identifier">261K.2</xhtml:span><xhtml:span class="headnote">Accrediting agencies <xhtml:span class="em-dash"/> adverse action against institutions for compliance with state law prohibited.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An accrediting agency shall not take any adverse action against a public institution of higher education for complying with a state law or refusing to violate a state law.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Any adverse action taken by an accrediting agency against a public institution of higher education based, in whole or in part, on the institution’s compliance with a state law or refusal to violate a state law constitutes a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> that is subject to <xhtml:span class="iowaCodeRef">section 261K.3</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2025 Acts, ch 62, §7, 9</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">NEW section</xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec261K.3"><xhtml:div class="heading"><xhtml:span class="identifier">261K.3</xhtml:span><xhtml:span class="headnote">Civil action.</xhtml:span></xhtml:div><xhtml:p class="para">A public institution of higher education that is negatively affected by adverse action taken against the institution by an accrediting agency in violation of <xhtml:span class="iowaCodeRef">section 261K.2</xhtml:span> may bring a civil action against the accrediting agency in this state if authorized by the attorney general. The attorney general may bring the action on behalf of the institution.
