<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp260J" name="260J"><slim:About class="header"><slim:Property type="string" name="taskInfo">1035:AC9B8E1A-AD78-49F0-9770-551300DE5FC2</slim:Property><slim:Property type="string" name="checkinTime">08/28/2023 14:56</slim:Property><slim:Property type="string" name="version">3</slim:Property></slim:About><slim:TOC><slim:Item idref="sec260J.1" title="260J.1   Supplemental new jobs credit from withholding."/><slim:Item idref="sec260J.2" title="260J.2   Loans payable from new jobs credit from withholding."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp260J"><slim:Heading class="heading"><xhtml:span class="identifier">260J</xhtml:span><xhtml:span class="headnote">NEW JOBS TRAINING PROJECT FUNDING <xhtml:span class="em-dash"/> CREDITS AND LOANS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec260J.1"><xhtml:div class="heading"><xhtml:span class="identifier">260J.1</xhtml:span><xhtml:span class="headnote">Supplemental new jobs credit from withholding.</xhtml:span></xhtml:div><xhtml:p class="para">In order to promote the creation of additional high-quality new jobs within the state, an agreement under <xhtml:span class="iowaCodeRef">section 260E.3</xhtml:span> may include a provision for a supplemental new jobs credit from withholding from jobs created under the agreement. A provision in an agreement for which a supplemental credit from withholding is included shall provide for the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">That the project shall be administered in the same manner as a project under <xhtml:span class="iowaCodeRef">chapter 260E</xhtml:span> and that a supplemental new jobs credit from withholding in an amount equal to one and one-half percent of the gross wages paid by the employer pursuant to <xhtml:span class="iowaCodeRef">section 422.16</xhtml:span> is authorized to fund the program services for the additional project.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">That the supplemental new jobs credit from withholding shall be collected, accounted for, and may be pledged by the community college in the same manner as described in <xhtml:span class="iowaCodeRef">section 260E.5</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">That the employer shall agree to pay wages for the jobs for which the credit is taken of at least the laborshed wage. For purposes of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, <xhtml:span class="term">“laborshed wage”</xhtml:span> means the wage level represented by those wages within two standard deviations from the mean wage within the laborshed area in which the eligible business is located, as calculated by the department of workforce development by rule, using the most current covered wage and employment data available to the department for the laborshed area. Eligibility for the supplemental credit shall be based on a one-time determination of starting wages by the community college.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">To provide funds for the payment of the costs of the additional project, a community college may borrow money, issue and sell certificates, and secure the payment of the certificates in the same manner as described in <xhtml:span class="iowaCodeRef">section 260E.6</xhtml:span>, including, but not limited to, providing the assessment of an annual levy as described in <xhtml:span class="iowaCodeRef">section 260E.6, subsection 4</xhtml:span>.
