The hospital shall be especially designed, kept, and administered for the care, observation, and treatment of those persons who are afflicted with abnormal mental conditions.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Administrative services organization”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 225A.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the department of health and human services.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Respondent”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 229.1</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C24, 27, 31, 35, §3954; However, the charge for such care, nursing, observation, treatment, medicine, and maintenance shall not exceed the cost of the same to the state. If, upon examination, the physician or physician assistant who meets the qualifications set forth in the definition of a mental health professional in <xhtml:span class="iowaCodeRef">section 228.1</xhtml:span> decides that the respondent should be admitted to the hospital, the respondent shall be provided a proper bed in the hospital. The physician or physician assistant who meets the qualifications set forth in the definition of a mental health professional in <xhtml:span class="iowaCodeRef">section 228.1</xhtml:span> who has charge of the respondent shall proceed with observation, medical treatment, and hospital care as in the physician’s or physician assistant’s judgment are proper and necessary, in compliance with <xhtml:span class="iowaCodeRef">sections 229.13</xhtml:span>, <xhtml:span class="iowaCodeRef">229.14</xhtml:span>, <xhtml:span class="iowaCodeRef">this section</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 229.16</xhtml:span>. A judge may request that a physician or mental health professional who examines a respondent as required by <xhtml:span class="iowaCodeRef">section 229.10</xhtml:span> complete such blanks in duplicate in the course of the examination. A physician who proposes to file information under <xhtml:span class="iowaCodeRef">section 225.10</xhtml:span>* shall obtain and complete such blanks in duplicate and file them with the information. The blanks shall be printed by the state and a supply of the blanks shall be made available to counties.
