id="sec196.1"><xhtml:div class="heading"><xhtml:span class="identifier">196.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">Unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Candling”</xhtml:span> means the careful examination of each shell egg and the elimination of those eggs determined unfit for human consumption.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Consumer”</xhtml:span> means a person who buys eggs for personal consumption.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the department of agriculture and land stewardship.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Egg handler”</xhtml:span> or <xhtml:span class="term">“handler”</xhtml:span> means a person who buys or sells eggs, or uses eggs in the preparation of human food. <xhtml:span class="i">“Egg handler”</xhtml:span> or <xhtml:span class="term">“handler”</xhtml:span> does not include a retailer, a consumer, an establishment, or a producer who sells eggs as provided in <xhtml:span class="iowaCodeRef">section 196.4</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Establishment”</xhtml:span> means any place in which eggs are offered or sold as human food for consumption by its employees, students, patrons, customers, residents, inmates or patients or as an ingredient in food offered or sold in a form ready for immediate consumption.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Grading”</xhtml:span> means classifying each shell egg by weight and grading in accordance with egg grading standards approved by the United States government as of July 1, 1985, pursuant to the Agricultural Marketing Act of 1946, 7 U.S.C. §1621 et seq.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Nest run eggs”</xhtml:span> means eggs which have not been denatured, candled, graded, processed or labeled.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Package”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 189.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Producer”</xhtml:span> means a person who owns layer type chickens.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">10</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Retailer”</xhtml:span> means a person who sells eggs directly to consumers except a producer who sells eggs under the provisions of <xhtml:span class="iowaCodeRef">section From the time of candling and grading until they reach the consumer, all eggs designated for human consumption shall be held at a temperature not to exceed 45 degrees Fahrenheit or 7 degrees Celsius ambient temperature. The 45 degrees Fahrenheit or 7 degrees Celsius ambient temperature requirement applies to any place or room in which eggs are stored, except inside a vehicle during transportation where the ambient temperature may exceed 45 degrees Fahrenheit or 7 degrees Celsius, provided the transport vehicle is equipped with refrigeration units capable of delivering air at a temperature not greater than 45 degrees Fahrenheit or 7 degrees Celsius and capable of cooling the vehicle to a temperature not greater than 45 degrees Fahrenheit or 7 degrees Celsius. All cases of loose packed eggs sold in this state shall identify the egg handler’s name or license number or United States department of agriculture plant number, and the grade of the eggs contained in the case. However, <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not apply to producers transporting their own eggs to a handler.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C58, 62, 66, 71, 73, 75, §196.20; C77, 79, <xhtml:span class="iowaCodeRef">81, §196.12</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec196.13"><xhtml:div class="heading"><xhtml:span class="identifier">196.13</xhtml:span><xhtml:span class="headnote">Records.</xhtml:span></xhtml:div><xhtml:p class="para">Handlers shall keep a record for three years of each of their purchases and sales of eggs, including the date of the transaction, the names of the parties, the grade, or nest run, and the quantity of eggs being purchased or sold.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C77, 79, <xhtml:span class="iowaCodeRef">81, §196.13</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec196.14"><xhtml:div class="heading"><xhtml:span class="identifier">196.14</xhtml:span><xhtml:span class="headnote">Penalty.</xhtml:span></xhtml:div><xhtml:p class="para">Any person who violates a provision of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> shall be guilty of a simple misdemeanor.
