"/><slim:Item idref="sec174.19" title="174.19   Report of county aid."/><slim:Item idref="sec174.20" title="174.20   Fraudulent entries of horses."/><slim:Item idref="sec174.21" title="174.21   Violations — penalty."/><slim:Item idref="sec174.22" title="174.22   Entry under changed name."/><slim:Item idref="sec174.23" title="174.23   Class determined."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp174"><slim:Heading class="heading"><xhtml:span class="identifier">174</xhtml:span><xhtml:span class="headnote">COUNTY AND DISTRICT FAIRS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec174.1"><xhtml:div class="heading"><xhtml:span class="identifier">174.1</xhtml:span><xhtml:span class="headnote">Terms defined.</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Association”</xhtml:span> means the association of Iowa fairs.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Fair”</xhtml:span> means an organization which is incorporated under the laws of this state, including as a county or district fair or as an agricultural society, for the purpose of conducting a fair event, if all of the following apply:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The organization owns or leases at least ten acres of fairgrounds. An organization may meet the requirement of owning or leasing land, buildings, and improvements through ownership by a joint entity under <xhtml:span class="iowaCodeRef">chapter 28E</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The organization owns buildings and other improvements situated on the fairgrounds which have been specially constructed for purposes of conducting a fair event.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The market value of the fairgrounds and buildings and other improvements located on the fairgrounds is at least twenty-five thousand dollars.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Fair event”</xhtml:span> means an annual gathering of the public on fairgrounds that incorporates agricultural exhibits, demonstrations, shows, or competitions that include programs or projects sponsored by 4-H clubs, future farmers of America, or the Iowa cooperative extension service in agriculture and home economics of Iowa state university.  Other activities may include any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Commercial exhibits sponsored by manufacturers or other businesses.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Educational programs or exhibits sponsored by governmental entities or nonprofit organizations.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Competition in culinary arts, fine arts, or home craft arts.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Fairgrounds”</xhtml:span> or <xhtml:span class="term">“grounds”</xhtml:span> means the real estate, including land, buildings, and improvements where a fair event is conducted.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Management”</xhtml:span> shall mean president, vice-president, secretary, or treasurer of a fair.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“State aid”</xhtml:span> means moneys appropriated by the treasurer of state to the association of Iowa fairs for payments to eligible fairs pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C24, 27, 31, 35, 39, §<xhtml:span class="b">2894;</xhtml:span> C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §174.1</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">97 Acts, ch 215, §32</xhtml:span>; <xhtml:span class="iowaActsRef">2004 Acts, ch 1019, §6 – 8</xhtml:span>; <xhtml:span class="iowaActsRef">2004 Acts, ch 1175, §366</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1193, §113, 114</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec174.2"><xhtml:div class="heading"><xhtml:span class="identifier">174.2</xhtml:span><xhtml:span class="headnote">Powers of a fair.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A fair may annually conduct a fair event to further interest in agriculture and to encourage the improvement of agricultural commodities and products, livestock, articles of domestic industry, implements, and other mechanical devices. It may offer and award such premiums as will induce general competition.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">In addition to the powers granted in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, a fair shall have the powers of a corporation not for pecuniary profit under the laws of this state and those powers enumerated in its articles of incorporation, such powers to be exercised before and after the holding of a fair event.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">No salary or compensation of any kind shall be paid to the president, vice president, treasurer, or to a director of the fair for such duties. However, the president, vice president, treasurer, or a director of the fair may be reimbursed for actual expenses incurred by carrying out duties under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or <xhtml:span class="iowaCodeRef">chapter 173</xhtml:span>, including but not limited to attending the convention provided under <xhtml:span class="iowaCodeRef">section 173.2</xhtml:span>. The moneys paid as state aid must be used exclusively for capital expenditures relating to the acquisition of land for fairgrounds and improvements on the fairgrounds such as the construction of new facilities and the renovation of existing facilities. In order to be eligible for state aid, a fair must file with the association of Iowa fairs on or before November 15 of each year, a statement which provides information as required by the association of Iowa fairs. The information shall at least include all of the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The amount that the fair paid in cash premiums at its fair for the current year. The association shall distribute the moneys to eligible fairs pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The association shall maintain a list of each fair in a county which is a member of the association and conducts a fair event in that county as provided in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. If a county has more than one fair event, the association shall list the name of each fair conducting a fair event in that county for three or more years. The association shall not make a payment to a fair under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> unless the fair complies with <xhtml:span class="iowaCodeRef">section 174.9</xhtml:span>, the name of the fair appears on the association’s list, and the fair is a member in good standing according to the bylaws of the association.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The association shall prepare a report at the end of each fiscal year concerning the state aid that it received, the manner in which such aid was allocated to eligible fairs, and the manner in which the aid was expended by the fairs. The association shall submit the report to the governor and the general assembly by February 1 of each year. The association must certify to the treasurer that the fair is eligible under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> to receive the amount to be paid to the fair by the association. The association shall pay the fair the remaining one thousand dollars, if all of the following apply:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The secretary of the state fair board certifies to the association that the fair had an accredited delegate in attendance at the annual convention for the election of members of the Iowa state fair board as provided in <xhtml:span class="iowaCodeRef">section 173.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A district director of the association representing the district in which the county is located, and the director of the Iowa state fair board representing the state fair board district in which the county is located, certify to the association that the fair had an accredited delegate in attendance at at least one of the district meetings and at the association’s annual meeting.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Any moneys appropriated in state aid remaining due to the failure of a fair to comply with <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be distributed equally among the eligible fairs which have qualified for state aid under <xhtml:span class="iowaCodeRef">this section</xhtml:span>. Title to new buildings or improvements shall be taken in the name of the county or a fair. The governing body of a fair shall comply with all of the following procedures in issuing such bonds:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A fair may institute proceedings for the issuance of bonds by causing a notice of the proposal to issue the bonds to be published at least once in a newspaper of general circulation within the county at least ten days prior to the meeting at which the fair proposes to take action for the issuance of the bonds. The notice shall include a statement of the amount and purpose of the bonds, the maximum rate of interest the bonds are to bear, and the right to petition for an election.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If at any time before the date fixed for taking action for the issuance of the bonds, a petition signed by three percent of the registered voters of the county is filed with the board of supervisors, asking that the question of issuing the bonds be submitted to the registered voters, the board of supervisors shall either by resolution declare the proposal to issue the bonds to have been abandoned or shall direct the county commissioner of elections to call a special election upon the question of issuing the bonds. The proposition of issuing bonds under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> is not approved unless the vote in favor of the proposition is equal to at least sixty percent of the vote cast. If a petition is not filed, or if a petition is filed and the proposition of issuing the bonds is approved at an election, the board of supervisors acting on behalf of the fair may proceed with the authorization and issuance of the bonds. Bonds may be issued for the purpose of refunding outstanding and previously issued bonds under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> without otherwise complying with the provisions of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">All bonds issued under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall be payable solely from and shall be secured by an irrevocable pledge of a sufficient portion of the net rents, profits, and income derived from the operation of the fair event and the use or rental of the real and personal property owned or leased by the fair. Bonds issued pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not constitute an indebtedness within the meaning of any constitutional or statutory debt limitation or restriction, and shall not be subject to the provisions of any other law or charter relating to the authorization, issuance, or sale of bonds. Bonds issued under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall not limit or restrict the authority of the fair as otherwise provided by law.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">To further secure the payment of the bonds, the board of supervisors may, by resolution, provide for the assessment of an annual levy of a standby tax upon all taxable property within the county. A copy of the resolution shall be sent to the county auditor. The revenues from the standby tax shall be deposited in a special fund and shall be expended only for the payment of principal of and interest on the bonds issued as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, when the receipt of revenues pursuant to <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> is insufficient to pay the principal and interest. If payments are necessary and made from the special fund, the amount of the payments shall be promptly repaid into the special fund from the first available revenues received which are not required for the payment of principal of or interest on bonds due. Reserves shall not be built up in the special fund in anticipation of a projected default.
