<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp172E" name="172E"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec172E.1" title="172E.1   Definitions."/><slim:Item idref="sec172E.2" title="172E.2   Marketing practices — dairy cattle sold for slaughter."/><slim:Item idref="sec172E.3" title="172E.3   Penalties."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp172E"><slim:Heading class="heading"><xhtml:span class="identifier">172E</xhtml:span><xhtml:span class="headnote">DAIRY CATTLE SOLD FOR SLAUGHTER</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec172E.1"><xhtml:div class="heading"><xhtml:span class="identifier">172E.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Dairy cattle”</xhtml:span> means cattle belonging to a breed that is used to produce milk for human consumption, including but not limited to Holstein and Jersey breeds.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Livestock”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 717.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Livestock market”</xhtml:span> means any place where livestock are assembled from two or more sources for public auction, private sale, or sale on a commission basis, which is under state or federal supervision, including a livestock auction market, if such livestock are kept in the place for ten days or less.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Packer”</xhtml:span> means a person who is engaged in the business of slaughtering livestock or receiving, purchasing, or soliciting livestock for slaughter. As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, <xhtml:span class="term">“packer”</xhtml:span> includes an agent of the packer engaged in buying or soliciting livestock for slaughter on behalf of a packer.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2001 Acts, ch 101, §6</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 176, §63</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec172E.2"><xhtml:div class="heading"><xhtml:span class="identifier">172E.2</xhtml:span><xhtml:span class="headnote">Marketing practices — dairy cattle sold for slaughter.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">If a livestock market accepts dairy cattle upon condition that the dairy cattle are to be moved directly to slaughter, the dairy cattle shall be segregated with other livestock to be moved directly to slaughter until sold to a packer. A person shall not knowingly sell the dairy cattle to a purchaser other than to a packer at the livestock market. A person other than a packer shall not knowingly purchase the dairy cattle at the livestock market.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> shall not supersede requirements relating to the movement or marketing of livestock infected with an infectious or contagious disease, including but not limited to those diseases enumerated in <xhtml:span class="iowaCodeRef">section 163.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2001 Acts, ch 101, §7</xhtml:span>; <xhtml:span class="iowaActsRef">2002 Acts, ch 1100, §1</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec172E.3"><xhtml:div class="heading"><xhtml:span class="identifier">172E.3</xhtml:span><xhtml:span class="headnote">Penalties.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The department, with assistance by the attorney general, shall have the same authority to enforce <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> as it does under <xhtml:span class="iowaCodeRef">chapter 165A</xhtml:span>. A person who violates <xhtml:span class="iowaCodeRef">section 172E.2</xhtml:span> is subject to the same penalties as provided in <xhtml:span class="iowaCodeRef">section 165A.5</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> does not prevent a person from commencing a civil cause of action based on any right that the person may assert under statute or common law.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2001 Acts, ch 101, §8</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
