<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp154E" name="154E"><slim:About class="header"><slim:Property type="string" name="taskInfo">25:70A94FC2-07EB-468D-AAAF-1E5CD26BDAC4</slim:Property><slim:Property type="string" name="version">17</slim:Property></slim:About><slim:TOC><slim:Item idref="sec154E.1" title="154E.1   Definitions."/><slim:Item idref="sec154E.2" title="154E.2   Duties of the board."/><slim:Item idref="sec154E.3" title="154E.3   Requirements for licensure."/><slim:Item idref="sec154E.3A" title="154E.3A   Temporary license."/><slim:Item idref="sec154E.3B" title="154E.3B   Licensure of employers."/><slim:Item idref="sec154E.4" title="154E.4   Exceptions."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp154E"><slim:Heading class="heading"><xhtml:span class="identifier">154E</xhtml:span><xhtml:span class="headnote">INTERPRETERS AND TRANSLITERATORS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec154E.1"><xhtml:div class="heading"><xhtml:span class="identifier">154E.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Board”</xhtml:span> means the board of sign language interpreters and transliterators established in <xhtml:span class="iowaCodeRef">chapter 147</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Consumer”</xhtml:span> means an individual utilizing interpreting services who uses spoken English, American sign language, or a manual form of English.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the department of inspections, appeals, and licensing.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Interpreter training program”</xhtml:span> means a postsecondary education program training individuals to interpret or transliterate.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Interpreting”</xhtml:span> means facilitating communication between individuals who communicate via American sign language and individuals who communicate via spoken English.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Licensee”</xhtml:span> means any person licensed to practice interpreting or transliterating for deaf, hard-of-hearing, and hearing individuals in the state of Iowa.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Transliterating”</xhtml:span> means facilitating communication between individuals who communicate via a manual form of English and individuals who communicate via spoken English.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2004 Acts, ch 1175, §426, 433</xhtml:span>; <xhtml:span class="iowaActsRef">2007 Acts, ch 10, §150</xhtml:span>; <xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1630</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec154E.2"><xhtml:div class="heading"><xhtml:span class="identifier">154E.2</xhtml:span><xhtml:span class="headnote">Duties of the board.</xhtml:span></xhtml:div><xhtml:p class="para">The board shall administer <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. The board’s duties shall include, but are not limited to, the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Adopt rules consistent with <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> and with <xhtml:span class="iowaCodeRef">chapter 147</xhtml:span> which are necessary for the performance of its duties.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Act on matters concerning licensure and the process of applying for, granting, suspending, imposing supervisory or probationary conditions upon, reinstating, and revoking a license.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Administer the provisions of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> regarding documentation required to demonstrate competence as an interpreter, and the processing of applications for licenses and license renewals.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Establish and maintain as a matter of public record a registry of interpreters licensed pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Develop continuing education requirements as a condition of license renewal.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">Evaluate requirements for licensure in other states to determine if reciprocity may be granted.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2004 Acts, ch 1175, §427, 433</xhtml:span>; <xhtml:span class="iowaActsRef">2006 Acts, ch 1155, §12, 15</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec154E.3"><xhtml:div class="heading"><xhtml:span class="identifier">154E.3</xhtml:span><xhtml:span class="headnote">Requirements for licensure.</xhtml:span></xhtml:div><xhtml:p class="para">Every person providing interpreting or transliterating services in this state shall be licensed pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. The board shall adopt rules pursuant to <xhtml:span class="iowaCodeRef">chapters 17A</xhtml:span>, <xhtml:span class="iowaCodeRef">147</xhtml:span>, and <xhtml:span class="iowaCodeRef">272C</xhtml:span> establishing procedures for the licensing of new and existing interpreters. Prior to obtaining licensure, an applicant shall successfully pass an examination prescribed and approved by the board, demonstrating the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span><xhtml:span class="headnote">Voice-to-sign interpretation.</xhtml:span></xhtml:div><xhtml:p class="para">An applicant shall demonstrate proficiency at:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Message equivalence:<xhtml:span class="em-space"/>producing a true and accurate signed form of the spoken message, maintaining the integrity of content and meaning, and exhibiting few omissions, substitutions, or other errors.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Affect:<xhtml:span class="em-space"/>producing nonmanual grammar consistent with the intent and emotion of the speaker, and exhibiting no distracting mannerisms.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Vocabulary choice:<xhtml:span class="em-space"/>making correct sign choices appropriate to the setting and consumers, applying facial grammar consistent with sign choice, selecting signs that remain true to speaker’s intent, and demonstrating lexical variety.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Fluency:<xhtml:span class="em-space"/>displaying confidence in production, exhibiting a strong command of American sign language or manual codes for English, applying nonmanual behaviors consistent with the speaker’s intent, and demonstrating understanding of and sensitivity to cultural differences.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span><xhtml:span class="headnote">Sign-to-voice interpretation.</xhtml:span></xhtml:div><xhtml:p class="para">An applicant shall demonstrate proficiency at:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Message equivalence:<xhtml:span class="em-space"/>producing a true and accurate spoken form of the signed message, maintaining the integrity of content and meaning, and exhibiting few omissions, substitutions, or other errors.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Affect:<xhtml:span class="em-space"/>producing inflection consistent with the intent and emotion of the speaker, and exhibiting no distracting mannerisms.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Vocabulary choice:<xhtml:span class="em-space"/>making correct word choices appropriate to the setting and consumers, using vocal inflection consistent with word choice, selecting words that remain true to the speaker’s intent, and demonstrating lexical variety.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Fluency:<xhtml:span class="em-space"/>displaying confidence in production, exhibiting a strong command of English in both spoken and written forms, applying vocal inflections consistent with the speaker’s intent, and demonstrating understanding of and sensitivity to cultural differences.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span><xhtml:span class="headnote">Professional conduct.</xhtml:span></xhtml:div><xhtml:p class="para">An applicant shall demonstrate:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Proficiency in functioning as a communicator of messages between the sender and receiver and educating consumers of services about the functions and logistics of the interpreting process.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An impartial demeanor, refraining from interjecting opinions or advice and from aligning with one party over another. An applicant shall treat all people fairly and respectfully regardless of their relationship to the interpreting assignment, and present a professional appearance that is not visually distracting and is appropriate to the setting. An applicant shall exhibit knowledge and application of federal and state laws pertaining to the interpreting profession.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Integrity, and shall be proficient in understanding and applying ethical behavior appropriate for a licensee. An applicant shall demonstrate discretion in accepting and meeting interpreter services requests, and shall engage actively in lifelong learning.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2004 Acts, ch 1175, §428, 433</xhtml:span>; <xhtml:span class="iowaActsRef">2025 Acts, ch 30, §29</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Unnumbered paragraph 1 amended</xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec154E.3A"><xhtml:div class="heading"><xhtml:span class="identifier">154E.3A</xhtml:span><xhtml:span class="headnote">Temporary license.</xhtml:span></xhtml:div><xhtml:p class="para">An individual who does not meet the requirements for licensure by examination pursuant to <xhtml:span class="iowaCodeRef">section 154E.3</xhtml:span> may apply for or renew a temporary license. The temporary license shall authorize the licensee to practice as a sign language interpreter or transliterator under the direct supervision of a sign language interpreter or transliterator licensed pursuant to <xhtml:span class="iowaCodeRef">section 154E.3</xhtml:span>. The temporary license shall be valid for two years and may only be renewed one time in accordance with standards established by rule. An individual shall not practice for more than a total of four years under a temporary license. The board may revoke a temporary license if it determines that the temporary licensee has violated standards established by rule. The board may adopt requirements for temporary licensure to implement <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2006 Acts, ch 1184, §98</xhtml:span>; <xhtml:span class="iowaActsRef">2025 Acts, ch 30, §30</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Section amended</xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec154E.3B"><xhtml:div class="heading"><xhtml:span class="identifier">154E.3B</xhtml:span><xhtml:span class="headnote">Licensure of employers.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An employer that employs a person to provide interpreting or transliterating services to the employer’s employees may be licensed pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding <xhtml:span class="iowaCodeRef">section 154E.3</xhtml:span>, a person employed by an employer licensed pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> to provide interpreting or transliterating services to the employer’s employees is not required to be licensed pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, but shall meet the requirements for licensure under <xhtml:span class="iowaCodeRef">section 154E.3</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The board shall adopt rules pursuant to <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span> for the process of applying for, granting, suspending, reinstating, renewing, and revoking a license issued pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2024 Acts, ch 1064, §1</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec154E.4"><xhtml:div class="heading"><xhtml:span class="identifier">154E.4</xhtml:span><xhtml:span class="headnote">Exceptions.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not practice interpreting or transliterating, or represent that the person is an interpreter, unless the person is licensed under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This chapter</xhtml:span> does not prohibit any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Any person residing outside of the state of Iowa holding a current license from another state that meets the state of Iowa’s requirements from providing interpreting or transliterating services in this state for up to fourteen days per calendar year without a license issued pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Any person from interpreting or transliterating solely in a religious setting with the exception of those working in schools that receive government funding.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Volunteers working without compensation, including emergency situations, until a licensed interpreter is obtained.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Any person working as a substitute for a licensed interpreter in an early childhood, elementary, or secondary education setting for no more than thirty school days in a calendar year.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Students enrolled in a school of interpreting from interpreting only under the direct supervision of a permanently licensed interpreter as part of the student’s course of study.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2004 Acts, ch 1175, §429, 433</xhtml:span>;
