class="identifier">135P</xhtml:span><xhtml:span class="headnote">ADVERSE HEALTH CARE INCIDENTS <xhtml:span class="em-dash"/> COMMUNICATIONS <xhtml:span class="em-dash"/> CONFIDENTIALITY</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec135P.1"><xhtml:div class="heading"><xhtml:span class="identifier">135P.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Adverse health care incident”</xhtml:span> means an objective and definable outcome arising from or related to patient care that results in the death or physical injury of a patient.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Health care provider”</xhtml:span> means a physician or osteopathic physician licensed under <xhtml:span class="iowaCodeRef">chapter 148</xhtml:span>, a physician assistant licensed under <xhtml:span class="iowaCodeRef">chapter 148C</xhtml:span>, a podiatrist licensed under <xhtml:span class="iowaCodeRef">chapter 149</xhtml:span>, a chiropractor licensed under <xhtml:span class="iowaCodeRef">chapter 151</xhtml:span>, a licensed practical nurse, a registered nurse, or an advanced registered nurse practitioner licensed under <xhtml:span class="iowaCodeRef">chapter 152</xhtml:span> or <xhtml:span class="iowaCodeRef">152E</xhtml:span>, a dentist licensed under <xhtml:span class="iowaCodeRef">chapter 153</xhtml:span>, an optometrist licensed under <xhtml:span class="iowaCodeRef">chapter 154</xhtml:span>, a pharmacist licensed under <xhtml:span class="iowaCodeRef">chapter 155A</xhtml:span>, or any other person who is licensed, certified, or otherwise authorized or permitted by the law of this state to administer health care in the ordinary course of business or in the practice of a profession.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Health facility”</xhtml:span> means an institutional health facility as defined in <xhtml:span class="iowaCodeRef">section 135.61</xhtml:span>, a birth center as defined in <xhtml:span class="iowaCodeRef">section 135.131</xhtml:span>, a hospice licensed under <xhtml:span class="iowaCodeRef">chapter 135J</xhtml:span>, a home health agency as defined in <xhtml:span class="iowaCodeRef">section 144D.1</xhtml:span>, an assisted living program certified under <xhtml:span class="iowaCodeRef">chapter 231C</xhtml:span>, a clinic, a community health center, or the university of Iowa hospitals and clinics, and includes any corporation, professional corporation, partnership, limited liability company, limited liability partnership, or other entity comprised of such health facilities.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Open discussion”</xhtml:span> means all communications that are made under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>, and includes all memoranda, work products, documents, and other materials that are prepared for or submitted in the course of or in connection with communications under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Patient”</xhtml:span> means a person who receives medical care from a health care provider, or if the person is a minor, deceased, or incapacitated, the person’s legal representative.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2015 class="identifier">135P.2</xhtml:span><xhtml:span class="headnote">Confidentiality of open discussions.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Open discussion communications and offers of compensation made under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Do not constitute an admission of liability.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Are privileged, confidential, and shall not be disclosed.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Are not admissible as evidence in any subsequent judicial, administrative, or arbitration proceeding and are not subject to discovery, subpoena, or other means of legal compulsion for release and shall not be disclosed by any party in any subsequent judicial, administrative, or arbitration proceeding.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Communications, memoranda, work products, documents, and other materials, otherwise subject to discovery, that were not prepared specifically for use in a discussion under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>, are not confidential.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The limitation on disclosure imposed by <xhtml:span class="iowaCodeRef">this section</xhtml:span> includes disclosure during any discovery conducted as part of a subsequent adjudicatory proceeding, and a court or other adjudicatory body shall not compel any person who engages in an open discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> to disclose confidential communications or agreements made under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> does not affect any other law, regulation, or requirement with respect to confidentiality.</xhtml:p></xhtml:div><xhtml:div id="sec135P.3"><xhtml:div class="heading"><xhtml:span class="identifier">135P.3</xhtml:span><xhtml:span class="headnote">Engaging in an open discussion.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">If an adverse health care incident occurs in a health facility, the health care provider, the health facility, or the health care provider jointly with the health facility, may provide the patient with written notice of the desire of the health care provider, the health facility, or of the health care provider jointly with the health facility, to enter into an open discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. A health facility may designate a person or class of persons who have authority to provide such notice on behalf of the facility. If the health care provider or health facility provides such notice, such notice must be sent within one year after the date on which the health care provider knew, or through the use of diligence should have known, of the adverse health care incident. The notice must include all of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Notice of the desire of the health care provider, or of the health care provider jointly with the health facility, to proceed with an open discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Notice of the patient’s right to receive a copy of the medical records related to the adverse health care incident and of the patient’s right to authorize the release of the patient’s medical records related to the adverse health care incident to any third party.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Notice of the patient’s right to seek legal counsel.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">A copy of <xhtml:span class="iowaCodeRef">section 614.1, subsection 9</xhtml:span>, and notice that the time for a patient to bring a lawsuit is limited under <xhtml:span class="iowaCodeRef">section 614.1, subsection 9</xhtml:span>, and will not be extended by engaging in an open discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> unless all parties agree to an extension in writing.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Notice that if the patient chooses to engage in an open discussion with the health care provider or health facility, that all communications made in the course of such a discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, including communications regarding the initiation of an open discussion, are privileged and confidential, are not subject to discovery, subpoena, or other means of legal compulsion for release, and are not admissible in evidence in a judicial, administrative, or arbitration proceeding.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">If the patient agrees in writing to engage in an open discussion, the patient, health care provider, or health facility engaged in an open discussion under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> may include other persons in the open discussion. All additional parties shall also be advised in writing prior to the discussion that discussions are privileged and confidential, are not subject to discovery, subpoena, or other means of legal compulsion for release, and are not admissible in evidence in a judicial, administrative, or arbitration proceeding. The advice in writing must indicate that communications, memoranda, work products, documents, and other materials, otherwise subject to discovery, that were not prepared specifically for use in a discussion under <xhtml:span class="iowaCodeRef">this section</xhtml:span>, are not confidential.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The health care provider or health facility that agrees to engage in an open discussion may do all of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Investigate how the adverse health care incident occurred and gather information regarding the medical care or treatment provided.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Disclose the results of the investigation to the patient.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Openly communicate to the patient the steps the health care provider or health facility will take to prevent future occurrences of the adverse health care incident.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Determine either of the following:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">That no offer of compensation for the adverse health care incident is warranted and orally communicate that determination to the patient.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">That an offer of compensation for the adverse health care incident is warranted and extend such an offer in writing to the patient.</xhtml:p></xhtml:div></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">If a health care provider or health facility makes an offer of compensation under <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span> and the patient is not represented by legal counsel, the health care provider or health facility shall advise the patient of the patient’s right to seek legal counsel regarding the offer of compensation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Except for offers of compensation under <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span>, discussions between the health care provider or health facility and the patient about the compensation offered under <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span> shall remain oral.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2015 Acts, ch 33, §3</xhtml:span>; <xhtml:span class="iowaActsRef">2020 Acts, ch 1045, §8</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 80, §70</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec135P.4"><xhtml:div class="heading"><xhtml:span class="identifier">135P.4</xhtml:span><xhtml:span class="headnote">Payment and resolution.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A payment made to a patient pursuant to <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span> is not a payment resulting from any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A written claim or demand for payment.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A claim for purposes of <xhtml:span class="iowaCodeRef">section 272C.9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A claim for purposes of <xhtml:span class="iowaCodeRef">section 505.27</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A health care provider or health facility may require the patient, as a condition of an offer of compensation under <xhtml:span class="iowaCodeRef">section 135P.3</xhtml:span>, to execute all documents and obtain any necessary court approval to resolve an adverse health care incident.
