Page 3, by striking lines 21 through 33 and inserting: 3 < 1. The business court shall consist of two judges. 4 2. a. On the effective date of this Act, the supreme 5 court shall determine from among the judges then serving in 6 the existing business specialty court two judges to serve 7 exclusively as full-time judges of the business court. 8 b. If fewer than two judges from the existing business 9 specialty court seek appointment to serve as full-time judges 10 of the business court, the remaining vacancy or vacancies shall 11 be nominated and appointed as provided in chapter 46. 12 3. After the initial appointments under subsection 2, any 13 vacancy on the business court shall be nominated and appointed 14 as provided in chapter 46. 15 4. In addition to the judges appointed or designated under 16 this section, the supreme court may assign as visiting judges 17 of the business court district court judges and senior judges. > 18 3. A judge of the business court may be assigned to the 20 civil docket of a district court when the business court 21 caseload permits, as determined by the supreme court. > 22 4. On or before January 1, 2029, the 24 judicial branch shall submit a report to the general assembly 25 on the performance of the business court established under 26 section 602.6801, as enacted in this Act. The report must 27 include but is not limited to all of the following: 28 1. The average number of days from filing to final 29 disposition of business court cases. 30 2. A side-by-side comparison of the number of days from 31 filing to final disposition of business court cases with the 32 number of days from filing to final disposition of comparable 33 commercial civil litigation on the district court docket. 34 3. from, dismissed from, or retained on the business court docket 1 as provided in section 602.6804, as enacted in this Act. 2 4. An estimate of the cost savings, if any, of district 6 courts due to the operations of the business court. 7 6. The total amount of court fees collected for cases in the 8 business court. 9 7. The percentage of time, if any, that business court 10 judges spend on non-business-court civil litigation cases in 11 district court. 12 8. Anonymized survey data from legal counsel and other 13 litigants regarding the perceived expertise, fairness, 14 efficiency, and predictability of the business court. 15 9. The number and outcome of appeals of business court 16 decisions compared to the general reversal rate for civil 17 litigation case decisions. > 18 5.
