NEW SECTION . 208.9A Subsidence. 4 The division shall adopt rules providing for the regulation 5 of land affected by a subsidence. The rules shall include but 6 are not limited to requirements related to the reporting of 7 the subsidence, the qualifications of a professional engineer 8 or other qualified person submitting a subsidence repair plan 9 to the division, and the timeliness of a subsidence’s planned 10 repair. 11 Sec. ___. EMERGENCY RULES. The division of soil 12 conservation and water quality created within the department 13 of agriculture and land stewardship shall adopt emergency 14 rules under section 17A.4, subsection 3, and section 17A.5, 15 subsection 2, paragraph “b”, to implement the provisions of 16 this Act within sixty business days of the effective date of 17 this Act and shall submit such rules to the administrative 18 rules coordinator and the administrative code editor pursuant 19 to section 17A.5, subsection 1, within the same period. The 20 rules shall be effective immediately upon filing unless a 21 later date is specified in the rules. Any rules adopted in 22 accordance with this section shall also be published as a 23 notice of intended action as provided in section 17A.4. 24 Sec. ___. EFFECTIVE DATE. This Act, being deemed of 25 immediate importance, takes effect upon enactment. > 26 2.
