Section 123.3, Code 2026, is amended by adding 3 the following new subsection: 4 NEW SUBSECTION . 5A. “Authorized noninstitutional investor” 5 means a person who has an ownership interest in a business that 6 manufactures, imports, bottles, sells at wholesale, or sells 7 at retail alcoholic beverages, if the person meets all of the 8 following criteria: 9 a. The ownership interest of the person does not exceed five 10 percent of the entire ownership interest of the business that 11 manufactures, imports, bottles, sells at wholesale, or sells 12 at retail alcoholic beverages. 13 b. The person is not engaged as a director, officer, 14 employee, broker, or agent of the business that manufactures, 15 imports, bottles, sells at wholesale, or sells at retail 16 alcoholic beverages. > 17 2. Notwithstanding any other provision of law to the 21 contrary, an authorized noninstitutional investor of a business 22 engaged in the manufacturing, importing, bottling, selling at 23 wholesale, or selling at retail of alcoholic beverages may 24 directly or indirectly have an ownership interest in another 25 licensee or permittee authorized under this chapter to sell 26 at retail alcoholic beverages, if the person remains only 27 an authorized noninstitutional investor of the licensee or 28 permittee authorized under this chapter to sell at retail 29 alcoholic beverages. 30 2. Any authorized noninstitutional investor of a business 31 engaged in the manufacturing, importing, bottling, or selling 32 at wholesale of alcoholic beverages that is also an authorized 33 noninstitutional investor of another business holding a retail 34 alcohol license issued under this chapter shall annually 35 -1- HF 2200.3755 (1) 91 jm/ns 1/ 2 #1. #2.
