House File 2254 S-5141 Amend House File 2254, as passed by the House, as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < Section 1. Section 262.9, Code 2026, is amended by adding 4 the following new subsection: 5 NEW SUBSECTION . 43. a. Develop a policy that prohibits 6 the university of Iowa hospitals and clinics from including a 7 noncompete clause in an employment contract with an advanced 8 registered nurse practitioner, a licensed practical nurse, a 9 pharmacist, a physician, a physician assistant, or a registered 10 nurse. 11 b. This subsection applies to all employment contracts 12 between an advanced registered nurse practitioner, a licensed 13 practical nurse, a pharmacist, a physician, a physician 14 assistant, or a registered nurse and the university of Iowa 15 hospitals and clinics entered into, extended, or renewed on or 16 after the effective date of this Act. 17 c. For purposes of this subsection: 18 (1) “Advanced registered nurse practitioner” means the same 19 as defined in section 152.1. 20 (2) “Licensed practical nurse” means an individual licensed 21 under chapter 152. 22 (3) “Noncompete clause” means any restriction on the right 23 of an advanced registered nurse practitioner, a licensed 24 practical nurse, a pharmacist, a physician, a physician 25 assistant, or a registered nurse to practice in any geographic 26 area or for a defined period of time upon the termination of 27 an employment contract between the advanced registered nurse 28 practitioner, licensed practical nurse, pharmacist, physician, 29 physician assistant, or registered nurse and the university of 30 Iowa hospitals and clinics. 31 (4) “Pharmacist” means the same as defined in section 32 155A.3. 33 (5) “Physician” means an individual licensed under chapter 34 148. 35 -1- HF 2254.3281 (2) 91 ak/ko 1/ 2 #1.
