DEPARTMENT OF HEALTH AND HUMAN SERVICES AND AREA 10 AGENCIES ON AGING —— REDESIGNATION OF PLANNING AND SERVICE 11 AREAS —— REVIEW AND REPORT. 12 1. For purposes of this section, unless the context 13 otherwise requires: 14 a. “Area agency on aging” means the same as defined in 42 15 U.S.C. §3002. 16 b. “Department” means the department of health and human 17 services. 18 c. “Health and human services district” means the same as 19 defined in section 217.1, as amended in division I of this Act. 20 d. “Planning and service area” means the same as defined in 21 42 U.S.C. §3002. 22 e. “Redesignation” means the process described in 45 C.F.R. 23 §1321.13(e) to change the designation of a planning and service 24 area. 25 2. The department shall not submit an application for 26 redesignation for federal approval prior to January 1, 2027. 27 3. a. The department and each area agency on aging shall 28 collaborate in good faith to do all of the following: 29 (1) Determine the full fiscal impact of a proposed 30 redesignation including but not limited to the costs related 31 to all of the following: 32 (a) Transition. 33 (b) Administration. 34 (c) Information technology. 35 -1- SF 2338.3698 (2) 91 dg/ko 1/ 3 #1. #2.
(d) Property. 1 (e) Contract modifications. 2 (f) Personnel. 3 (g) The long-term finances of the state and each affected 4 area agency on aging. 5 (2) Determine the effects of a proposed redesignation on all 6 of the following: 7 (a) Service continuity. 8 (b) Client access. 9 (c) Provider networks. 10 (d) Rural service delivery. 11 (e) Wait lists. 12 (f) Consumer choice. 13 (g) Outcomes for older Iowans. 14 (3) Identify and recommend reasonable alternatives to 15 redesignation and reasonable means to align aging services 16 coordination with the geographic boundaries of health and 17 human services districts in a manner that adequately achieves 18 the state’s policy objectives for the delivery of aging and 19 disability services. 20 (4) Recommend the date by which a proposed planning 21 and service area will be implemented as the result of a 22 redesignation. 23 b. In completing the requirements under paragraph “a”, the 24 department and each area agency on aging shall do all of the 25 following as applicable: 26 (1) Provide information and data to the department as 27 determined necessary by the department. 28 (2) Engage with and receive input from relevant 29 stakeholders including but not limited to service providers, 30 consumer representatives, advocates for older Iowans, and 31 representatives of rural and underserved communities. 32 c. No later than December 15, 2026, the department shall 33 submit a report to the general assembly that details the 34 results of the collaboration between the department and the 35 -2- SF 2338.3698 (2) 91 dg/ko 2/ 3
area agencies on aging under paragraph “a”. Stakeholders shall 1 be provided a meaningful opportunity to review and provide 2 comments on the report prior to the department submitting the 3 report. A summary of the input from the stakeholder review and 4 stakeholder comments shall be included in the report. > 5 3.
