Section 18B.1, Code 2026, is amended to read as 4 follows: 5 18B.1 Iowa smart planning principles. 6 State The general assembly finds that it has a duty to 7 maintain healthy oversight over planning, zoning, development, 8 and resource management decisions made by state agencies, 9 local governments, and other public entities to ensure 10 the protection of individual rights and proper stewardship 11 of taxpayer dollars. Therefore, state agencies, local 12 governments, and other public entities shall consider and 13 may apply the following principles during deliberation of 14 all appropriate planning, zoning, development, and resource 15 management decisions, except that nothing in this section shall 16 be construed to expand the eminent domain authority of a state 17 agency, local government, or other public entity beyond that 18 which is authorized under chapter 6A or 6B : 19 1. Collaboration Investment . Governmental, community, 20 private sector entity, and individual stakeholders, including 21 those outside the jurisdiction of the entity, are encouraged 22 to be involved in and provide comment during deliberation 23 of planning, zoning, development, and resource management 24 decisions and during implementation of such decisions. The 25 state agency, local government, or other public entity is 26 encouraged to develop and implement a strategy to facilitate 27 such participation increase nongovernmental investment and 28 development to provide residents with safe, cost-effective, and 29 high-quality housing, jobs, amenities, and communities . 30 2. Efficiency, transparency, and consistency cost savings, 31 and tax relief . Planning, zoning, development, and resource 32 management should be undertaken to provide efficient , 33 and transparent , and consistent outcomes. in the responsibility to promote the equitable distribution of 1 development benefits and costs governmental processes, reduce 2 government spending, and decrease taxpayer burdens for those 3 who live in, work in, and visit the community. Governmental 4 entities should consider consolidation to reduce duplicative 5 services and improve efficiency . 6 3. Clean, renewable, and efficient energy Energy 7 production . Planning, zoning, development, and resource 8 management should be undertaken to promote clean and renewable 9 energy use and increased energy efficiency production that 10 results in lower consumer costs . 11 4. Occupational diversity Business, employment, and 12 entrepreneurial growth . Planning, zoning, development, 13 and resource management should promote increased diversity 14 of employment and business opportunities, promote access 15 to education and training, and expand entrepreneurial 16 opportunities , and promote the establishment of businesses 17 in locations near existing housing, infrastructure, and 18 transportation . Governmental entities should eliminate land 19 development regulations that create barriers to starting or 20 operating a business and obtaining employment. 21 5. Revitalization Public safety . Planning, zoning, 22 development, and resource management should facilitate the 23 revitalization of established town centers and neighborhoods 24 by promoting development that conserves land, protects 25 historic resources, promotes pedestrian accessibility, and 26 integrates different uses of property. Remediation and reuse 27 of existing sites, structures, and infrastructure is preferred 28 over new construction in undeveloped areas promote quick 29 emergency response times, active local business districts, 30 and investments into commercial and residential property that 31 increase public safety. Governmental entities should adopt 32 other policies to increase public safety, including maintaining 33 residential areas and vital infrastructure, adequately funding 34 and supporting law enforcement and first responders, and 35 -2- HF 2618.3559 (3) 91 sc/ns 2/ 5
collaborating with state and federal law enforcement agencies . 1 6. Housing diversity supply and affordability . Planning, 2 zoning, development, and resource management should expand new 3 housing opportunities, encourage diversity in the types of 4 available housing, including but not limited to market rate 5 housing, workforce housing, starter homes, multifamily housing, 6 accessory dwelling units, manufactured housing, townhomes, and 7 apartments, and support the rehabilitation of existing housing , 8 and promote the location of housing near public transportation 9 and employment centers . Governmental entities should eliminate 10 regulatory barriers to housing expansion, promote policies that 11 decrease housing costs, and encourage creative, efficient, and 12 cost-effective land use for housing purposes. 13 7. Community character Property rights . Planning, zoning, 14 development, and resource management should promote activities 15 and development that are consistent with the character and 16 architectural style of the community and should respond to 17 local values regarding the physical character of the community 18 property rights, including a property owner’s right to maintain 19 and improve property without unnecessary and burdensome 20 governmental or community interference . 21 8. Natural resources , water quality, and agricultural 22 protection. Planning, zoning, development, and resource 23 management should emphasize protection, preservation, and 24 restoration the conservation and improvement of natural 25 resources, water quality, while also supporting agricultural 26 land , and cultural and historic landscapes, and should increase 27 the availability of open spaces and recreational facilities and 28 the responsible use of Iowa’s natural resources . 29 9. Sustainable design development . Planning, zoning, 30 development, and resource management should promote 31 developments , buildings, and infrastructure that utilize 32 sustainable design and construction standards and conserve 33 natural resources by reducing waste and pollution through 34 efficient use of land, energy, water, air, and materials that 35 -3- HF 2618.3559 (3) 91 sc/ns 3/ 5
expand on prior developments and offer the community continued 1 reinvestment opportunities, including through housing, 2 employment, or amenities within or near the community that 3 prioritize population growth . 4 10. Transportation diversity . Planning, zoning, 5 development, and resource management should promote expanded 6 safe and economical transportation options systems for 7 residents of the community. Consideration should be given to 8 transportation options policies that maximize mobility, reduce 9 congestion, conserve fuel, and improve air quality reduce 10 transportation costs, prioritize methods of transportation 11 used by the community, and remove unnecessary land development 12 regulations that limit transportation access and parking 13 availability . 14 Sec. 2. Section 18B.2, subsection 2, paragraphs a, f, h, and 15 i, Code 2026, are amended to read as follows: 16 a. Information relating to public nongovernmental 17 participation during the creation of the comprehensive plan or 18 land development regulations, including documentation of the 19 public nongovernmental participation process, a compilation 20 of objectives, policies, and goals identified in the public 21 comment received, and identification of the groups or 22 individuals comprising any work groups or committees that were 23 created to assist the planning and zoning commission or other 24 appropriate decision-making body of the municipality. 25 f. Objectives, policies, and programs to guide the future 26 development of a safe, convenient, efficient, and economical 27 transportation system. Plans for such a transportation system 28 may be coordinated with state and regional transportation 29 plans and take into consideration the need for diverse modes 30 of transportation, accessibility, improved air quality, and 31 interconnectivity of the various modes of transportation. 32 However, a municipality shall give first priority to safe and 33 economical transportation options. 34 h. Objectives, policies, and programs addressing 35 -4- HF 2618.3559 (3) 91 sc/ns 4/ 5
preservation and protection improving water quality and 1 conserving and promoting the responsible use of agricultural 2 and natural resources. 3 i. Objectives, policies, and programs to assist future 4 development of educational facilities, cemeteries, health 5 care facilities, child care facilities, law enforcement and 6 fire protection facilities, libraries, and other governmental 7 facilities that are necessary or desirable to meet the 8 projected needs of the municipality. 9 Sec. 3. Section 18B.2, Code 2026, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 4. A municipality’s comprehensive plan 12 developed using the guidelines under this section shall 13 prioritize expanding housing supply, growing economic and 14 business opportunities, and reducing tax burdens. > 15 2.
