Section 123.3, Code 2026, is amended by adding 3 the following new subsection: 4 NEW SUBSECTION . 5A. “Authorized noninstitutional investor” 5 means a person who has an ownership interest in a business that 6 manufactures, bottles, sells at wholesale, or sells at retail 7 alcoholic beverages, if the person meets all of the following 8 criteria: 9 1. The ownership interest of the person does not exceed five 10 percent of the entire ownership interest of the business that 11 manufactures, bottles, sells at wholesale, or sells at retail 12 alcoholic beverages. 13 2. The person is not engaged as a director, officer, 14 employee, broker, or agent of the business that manufactures, 15 bottles, sells at wholesale, or sells at retail alcoholic 16 beverages. > 17 2.
