Section 2.11, Code 2026, is amended by adding 3 the following new subsection: 4 NEW SUBSECTION . 3. a. Each house of the general assembly 5 shall use the e-verify system of the United States citizenship 6 and immigration services to confirm the employment eligibility 7 of newly hired employees. 8 b. An employee may challenge the results of the submission 9 of the employee’s information to the e-verify system of 10 the United States citizenship and immigration services by 11 submitting a challenge, including documentation proving that 12 the results are incorrect, to the legislative council within 13 ten calendar days of receipt of the results. The legislative 14 council shall review the challenge and communicate the results 15 of the appeal to the employee and the appropriate house of the 16 general assembly as soon as practicable. 17 c. Each house of the general assembly shall transmit the 18 results of the e-verify system check to the United States 19 immigration and customs enforcement and other appropriate 20 federal immigration agencies if the check shows that the 21 subject of the check does not have legal status to be present 22 in the United States. 23 Sec. ___. Section 2A.2, subsection 2, Code 2026, is amended 24 by adding the following new paragraph: 25 NEW PARAGRAPH . 0i. The department shall adopt rules pursuant to chapter 17A 12 to allow an employee of a school district, a city, a county, 13 or the executive branch including the state board of regents 14 and each institution of higher education governed by the board, 15 or a person who has applied for a professional license in 16 this state, to challenge the results of the submission of the 17 person’s information to the SAVE program or the e-verify system 18 of the United States citizenship and immigration services with 19 the department. 20 2. A person must submit a challenge pursuant to subsection 1 21 and documentation proving that the results are incorrect within 22 ten calendar days of receipt of the results. 23 3. The department shall review a challenge submitted 24 pursuant to subsection 1 and communicate the results of the 25 appeal to the person who submitted the challenge and the hiring 26 authority or licensing board, as applicable, within seven 27 calendar days of receipt of the challenge.
