Page 25, before line 9 by inserting: 12 < Sec. ___. Section 163.15, subsection 1, Code 2025, is 13 amended to read as follows: 14 1. If the secretary of agriculture determines that the 15 outbreak of the infectious or contagious disease tuberculosis 16 among an animal population constitutes a threat to the general 17 welfare or the public health of the inhabitants of this state, 18 the secretary shall formulate a program of eradication which 19 shall include the condemnation and destroying of the animals 20 exposed to or afflicted with the disease tuberculosis. The 21 program of eradication shall provide for the indemnification 22 of owners of the livestock under this section , if there are no 23 other sources of indemnification. The program shall not be 24 effective until the program has been approved by the executive 25 council. 26 Sec. ___. Section 163.15, subsection 2, Code 2025, is 27 amended by striking the subsection. 28 Sec. ___. Section 163A.12, Code 2025, is amended to read as 29 follows: 30 163A.12 Owner requesting test. 31 If the owner requests the department to inspect and test 32 breeding swine for brucellosis, and agrees to comply with 33 the rules made by the department under section 163A.9 , the 34 department may designate a veterinarian to make an inspection 35 -1- S 3150.1979 (1) 91 sb/js 1/ 3 #1. #2. #3.

and test, with the expense to be paid as provided in section 1 164.6 for cattle brucellosis testing , but only to the extent 2 the funds provided in that section are not required for the 3 cattle testing program . > 4 4. By striking page 25, line 21, through page 26, line 8, 10 and inserting: 11 < Sec. ___. Section 164.21, subsection 2, Code 2025, is 12 amended to read as follows: 13 2. The owner shall may be indemnified to the extent 14 that money is available in the brucellosis and tuberculosis 15 eradication fund as created in section 165.18 and 16 indemnification is also made by the United States department 17 of agriculture. However, if the United States department of 18 agriculture is unable to indemnify the owner, the department 19 may indemnify the owner, if money is available. 20 Sec. ___. Section 164.21, subsection 3, Code 2025, is 21 amended by striking the subsection. 22 Sec. ___. Section 165.2, subsection 1, Code 2025, is amended 23 to read as follows: 24 1. The state of Iowa is declared to be and is established as 25 an accredited area for the eradication of bovine tuberculosis 26 from the dairy and breeding cattle of the state. It shall be 27 the duty of the department to eradicate bovine tuberculosis in 28 all of the counties of the state in the manner provided by law 29 as it appears in this chapter . The department shall proceed 30 with the examination, including the tuberculin test, of all 31 such cattle as rapidly as practicable and as is consistent 32 with efficient work , and as funds are available for paying the 33 indemnities as provided by law . 34 Sec. ___. follows: 1 165.10 Examination by department. 2 The department may at any time, on its own motion, make an 3 examination of any herd , and in case animals are destroyed, 4 the appraisement and payment shall be made as provided in this 5 chapter . > 6 6. Section 165.26, Code 2025, is amended to read as 8 follows: 9 165.26 Permitting test. 10 Every owner of dairy or breeding cattle in the state shall 11 permit the owner’s cattle to be tested for tuberculosis as 12 provided in this chapter , and shall confine the cattle in a 13 proper place so that the examination and test can be applied. 14 If the owner refuses to so confine the cattle the department 15 may employ sufficient help to properly confine them and the 16 expense of such help shall be paid by the owner or deducted 17 from the indemnity if any is paid . Such owner shall comply 18 with all the requirements for the establishment and maintenance 19 of a tuberculosis-free accredited herd. > 20 7. Page 27, after line 26 by inserting: 21 < Sec. ___.
