the

(e)
That
any
school
district,

accredited
nonpublic
school,
or
charter
school
providing

instruction
delivered
primarily
over
the
internet
pursuant
to
15
subsection
32
may
administer
any
state
assessment
required
16
pursuant
to
this
subsection
in
an
online
setting
that
is
17
similar
to
the
student’s
regular
academic
instruction,
if
all
18
of
the
following
conditions
are
satisfied:
19
(i)
The
student
takes
the
assessment
at
a
date
and
time
that
20
are
assigned
by
personnel
designated
by
the
school
district,
21
accredited
nonpublic
school,
or
charter
school.
22
(ii)
The
student
participates
in
a
synchronous
assessment
23
session
that
is
initiated
and
managed
by
personnel
designated
24
by
the
school
district,
accredited
nonpublic
school,
or
charter
25
school.

(iii)
(A)
The
student
takes
the
assessment
using
a
device
27
and
an
assessment
platform
that
allow
an
assessment
proctor
to
28
monitor
the
student
for
the
duration
of
the
assessment
through
29
a
video
feed
that
allows
the
assessment
proctor
to
view
the
30
student
taking
the
assessment
and
the
student’s
background.

(B)
If
the
device
or
assessment
platform
does
not
allow
32
an
assessment
proctor
to
monitor
the
student
for
the
duration
33
of
the
assessment
through
a
video
feed
in
accordance
with
34
subparagraph
part
(A),
the
requirements
of
this
subparagraph

proctor

the

assessment
and
the

background.

(iv)
The
school
district,
accredited
nonpublic
school,

or
charter
school
maintains
a
ratio
of
students
taking
the
7
assessment
to
assessment
proctors
of
not
greater
than
ten
to
8
one.

(v)
The
student
does
not
exit
the
assessment
session
until
10
instructed
to
do
so
by
the
assessment
proctor.

(vi)
An
assessment
administrator
employed
or
designated
by
12
the
school
district,
accredited
nonpublic
school,
or
charter
13
school
verifies
student
submission
of
the
assessment.
