Senate Amendment to House File 2542 H-8470 Amend House File 2542, as amended, passed, and reprinted by 1 the House, as follows: 2 1. By striking everything after the enacting clause and 3 inserting: 4 < Section 1. Section 902.8, Code 2026, is amended to read as 5 follows: 6 902.8 Minimum sentence —— habitual offender. 7 An A habitual offender is any person convicted of a class 8 “C” or a class “D” felony, who has twice before been convicted 9 of any felony in a court of this or any other state, or of the 10 United States. An offense is a felony if, by the law under 11 which the person is convicted, it is so classified at the time 12 of the person’s conviction. A person convicted of a third 13 qualifying felony shall be sentenced as a habitual offender and 14 shall serve a minimum of seven years of the sentence imposed 15 by law. A person sentenced as an a habitual offender shall not 16 be eligible for parole until the person has served the minimum 17 sentence of confinement of three seven years. Earned time 18 accrued pursuant to chapter 903A shall not reduce the minimum 19 sentence of confinement of seven years. 20 Sec. 2. Section 902.9, subsection 1, paragraph c, Code 2026, 21 is amended to read as follows: 22 c. An A habitual offender shall be confined for no more than 23 fifteen twenty years. 24 Sec. 3. Section 907.2, Code 2026, is amended by adding the 25 following new subsection: 26 NEW SUBSECTION . 3. Probation officers shall report 27 probation violations to the proper authorities. 28 Sec. 4. Section 907.3, subsection 2, paragraph a, Code 2026, 29 is amended by adding the following new subparagraph: 30 NEW SUBPARAGRAPH . (10) An offense qualifying the defendant 31 as a habitual offender under section 902.8. 32 Sec. 5. Section 907.3, subsection 3, Code 2026, is amended 33 by adding the following new paragraph: 34 NEW PARAGRAPH . i. A sentence imposed pursuant to section 35 -1- HF 2542.4519.S (2) 91 mb 1/ 2 #1.
