Senate Amendment to House File 2348 H-8435 Amend House File 2348, as passed by the House, as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < Section 1. Section 717B.3A, Code 2026, is amended by adding 4 the following new subsection: 5 NEW SUBSECTION . 1A. A person is guilty of animal torture 6 if the person intentionally, willfully, and maliciously 7 mutilates, burns, poisons, drowns, starves, or causes intensive 8 or prolonged pain or death to a companion animal, or causes, 9 directs, or provides anything of value to another person to do 10 the same. 11 Sec. 2. Section 717B.3A, subsections 4 and 5, Code 2026, are 12 amended to read as follows: 13 4. A person who commits animal torture in violation of 14 subsection 1 is guilty of an aggravated misdemeanor. A person 15 who commits animal torture in violation of subsection 1A is 16 guilty of a class “D” felony. 17 5. Notwithstanding subsection 4 , a person who commits 18 animal torture is guilty of a class “D” felony shall be guilty 19 of an offense one degree higher than the underlying offense if 20 the person has previously been convicted of committing animal 21 abuse pursuant to section 717B.2 , animal neglect punishable 22 as a serious misdemeanor or aggravated misdemeanor pursuant 23 to section 717B.3 , animal torture pursuant to this section , 24 injury to or interference with a police service dog pursuant to 25 section 717B.9 , bestiality pursuant to section 717C.1 , or an 26 act involving a contest event prohibited in section 717D.2 . > 27 -1- HF 2348.4350.S (1) 91 mb 1/ 1 #1.
