The 1 remaining moneys appropriated in this lettered paragraph 2 are allocated to provide grants to care providers providing 3 services to all other victims of violent crime. 4 The balance of the victim compensation fund established in 5 section 915.94 may be used to provide salary and support of not 6 more than 24.00 full-time equivalent positions and to provide 7 maintenance for the victim compensation functions of the 8 department of justice. In addition to the full-time equivalent 9 positions authorized pursuant to this unnumbered paragraph, 10 7.00 full-time equivalent positions are authorized and shall be 11 used by the department of justice to employ one accountant and 12 four program planners. The department of justice may employ 13 the additional 7.00 full-time equivalent positions authorized 14 pursuant to this unnumbered paragraph that are in excess of the 15 number of full-time equivalent positions authorized only if 16 the department of justice receives sufficient federal moneys 17 to maintain employment for the additional full-time equivalent 18 positions during the current fiscal year. The department of justice, in submitting budget 4 estimates for the fiscal year beginning July 1, 2027, pursuant 5 to section 8.23, shall include a report of funding from sources 6 other than amounts appropriated directly from the general fund 7 of the state to the department of justice or to the office of 8 consumer advocate. These funding sources must include but 9 are not limited to reimbursements from other state agencies, 10 commissions, boards, or similar entities, and reimbursements 11 from special funds or internal accounts within the department 12 of justice. The department of justice shall also report actual 13 reimbursements for the fiscal year beginning July 1, 2025, 14 and actual and expected reimbursements for the fiscal year 15 beginning July 1, 2026. 16 b. The department of justice shall include the report 17 required under paragraph “a”, as well as information regarding 18 any revisions occurring as a result of reimbursements actually 19 received or expected at a later date, in a report to the 20 general assembly. The department of justice shall submit the 21 report on or before January 15, 2027. 22 3. a. The department of justice shall fully reimburse 23 the costs and necessary related expenses incurred by the Iowa 24 law enforcement academy to continue to employ one additional 25 instructor position who shall provide training for human 26 trafficking-related issues throughout the state. 27 b. The department of justice shall obtain the moneys 28 necessary to reimburse the Iowa law enforcement academy to 29 employ such an instructor from unrestricted moneys from either 30 the victim compensation fund established in section 915.94 or 31 the human trafficking victim fund established in section 915.95 32 or the human trafficking enforcement fund established in 2015 33 Iowa Acts, chapter 138, section 141. 34 4. agreement. 1 b. It is the intent of the general assembly that as a 2 condition of receiving the appropriation provided in this 3 subsection the department of corrections shall not enter into 4 a lease or contractual agreement pursuant to section 904.809 5 with a private corporation for the use of building space for 6 the purpose of providing inmate employment without providing 7 that the terms of the lease or contract establish safeguards to 8 restrict, to the greatest extent feasible, access by inmates 9 working for the private corporation to personal identifying 10 information of citizens. 11 2. Each judicial district department of correctional 15 services, within the moneys available, shall continue programs 16 and plans established within that district to provide for 17 intensive supervision, sex offender treatment, diversion of 18 low-risk offenders to the least restrictive sanction available, 19 job development, and expanded use of intermediate criminal 20 sanctions. 21 3. Each judicial district department of correctional 22 services shall provide alternatives to prison consistent with 23 chapter 901B. The alternatives to prison must ensure public 24 safety while providing maximum rehabilitation to the offender. 25 A judicial district department of correctional services may 26 also establish a day program. 27 4. The office of drug control policy of the department 28 of public safety shall consider federal grants made to the 29 department of corrections for the benefit of each of the eight 30 judicial district departments of correctional services as local 31 government grants, as defined pursuant to federal regulations. 32 5. The department of corrections shall continue to contract 33 with a judicial district department of correctional services 34 to provide for the rental of electronic monitoring equipment 35 -9- HF 2770.4265 (1) 91 as/ns 9/ 20
available statewide. 1 6. The public safety assessment shall not be utilized in 2 pretrial hearings when determining whether to detain or release 3 a defendant before trial until such time the use of the public 4 safety assessment has been specifically authorized by the 5 general assembly. 6 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 7 APPROPRIATIONS. Notwithstanding section 8.39, within the 8 moneys appropriated in this division of this Act to the 9 department of corrections, the department may reallocate the 10 moneys appropriated and allocated as necessary to best fulfill 11 the needs of the correctional institutions, administration 12 of the department, and the judicial district departments of 13 correctional services. However, in addition to complying with 14 the requirements of section 904.116 and providing notice to 15 the legislative services agency, the department of corrections 16 shall also provide notice to the department of management, 17 prior to the effective date of the revision or reallocation of 18 an appropriation made pursuant to this section. The department 19 of corrections shall not reallocate an appropriation or 20 allocation for the purpose of eliminating any program. 21 Sec. 7. DEPARTMENT OF CORRECTIONS —— INTENT. The department 22 of corrections, in cooperation with townships, the Iowa 23 cemetery associations, and other nonprofit or governmental 24 entities, may use inmate labor during the fiscal year beginning 25 July 1, 2026, to restore or preserve rural cemeteries and 26 historical landmarks. The department, in cooperation with the 27 counties, may also use inmate labor to clean up roads, major 28 water sources, and other water sources around the state. 29 Sec. 8. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 30 1. As used in this section, unless the context otherwise 31 requires, “state agency” means the government of the state 32 of Iowa, including but not limited to all executive branch 33 departments, agencies, boards, bureaus, and commissions, the 34 judicial branch, the general assembly and all legislative 35 -10- HF 2770.4265 (1) 91 as/ns 10/ 20
agencies, institutions within the purview of the state board of 1 regents, and any corporation whose primary function is to act 2 as an instrumentality of the state. 3 2. State agencies are encouraged to purchase products from 4 Iowa state industries, as defined in section 904.802, when 5 purchases are required and the products are available from 6 Iowa state industries. State agencies shall obtain bids from 7 Iowa state industries for purchases of office furniture during 8 the fiscal year beginning July 1, 2026, exceeding $5,000 or 9 in accordance with applicable administrative rules related to 10 purchases for the agency. 11 Sec. 9. IOWA LAW ENFORCEMENT ACADEMY. 12 1. There is appropriated from the general fund of the 13 state to the Iowa law enforcement academy for the fiscal year 14 beginning July 1, 2026, and ending June 30, 2027, the following 15 amount, or so much thereof as is necessary, to be used for the 16 purposes designated: 17 a. The Iowa law enforcement academy may select at least 30 five automobiles of the department of public safety, division 31 of state patrol, prior to turning over the automobiles to 32 the department of administrative services to be disposed 33 of by public auction, and the Iowa law enforcement academy 34 may exchange any automobile owned by the academy for each 35 -11- HF 2770.4265 (1) 91 as/ns 11/ 20
automobile selected if the selected automobile is used in 1 training law enforcement officers at the academy. However, any 2 automobile exchanged by the academy must be substituted for 3 the selected vehicle of the department of public safety and 4 sold by public auction with the receipts being deposited in the 5 depreciation fund maintained pursuant to section 8A.365 to the 6 credit of the department of public safety, division of state 7 patrol. 8 3. The Iowa law enforcement academy shall provide training 9 for domestic abuse and human trafficking-related issues 10 throughout the state. The academy shall offer the training at 11 no cost to the attendees and the training shall not replace any 12 existing domestic abuse or human trafficking training offered 13 by the academy. 14 Sec. 10. STATE PUBLIC DEFENDER. 15 1.
