Section 708.3A, subsections 1, 2, 3, and 4, Code 10 2026, are amended to read as follows: 11 1. A person who commits an assault, as defined in section 12 708.1 , against a peace officer, jailer, correctional or 13 juvenile detention staff, member or employee of the board of 14 parole, pilot, health care provider, employee of the department 15 of health and human services, employee of the department of 16 inspections, appeals, and licensing who conducts investigations 17 or inspections, employee of the department of revenue, national 18 guard member engaged in national guard duty or state active 19 duty, civilian employee of a law enforcement agency, civilian 20 employee of a fire department, or fire fighter, whether paid or 21 volunteer, with the knowledge that the person against whom the 22 assault is committed is a peace officer, jailer, correctional 23 or juvenile detention staff, member or employee of the board of 24 parole, pilot, health care provider, employee of the department 25 of health and human services, employee of the department of 26 inspections, appeals, and licensing who conducts investigations 27 or inspections, employee of the department of revenue, national 28 guard member engaged in national guard duty or state active 29 duty, civilian employee of a law enforcement agency, civilian 30 employee of a fire department, or fire fighter and with the 31 intent to inflict a serious injury upon the peace officer, 32 jailer, correctional or juvenile detention staff, member or 33 employee of the board of parole, pilot, health care provider, 34 employee of the department of health and human services, 35 -1- HF 2778.4125 (2) 91 jm/jh 1/ 4 #1. #2. #3.
employee of the department of inspections, appeals, and 1 licensing who conducts investigations or inspections, employee 2 of the department of revenue, national guard member engaged in 3 national guard duty or state active duty, civilian employee 4 of a law enforcement agency, civilian employee of a fire 5 department, or fire fighter, is guilty of a class “C” felony. 6 2. A person who commits an assault, as defined in section 7 708.1 , against a peace officer, jailer, correctional or 8 juvenile detention staff, member or employee of the board of 9 parole, pilot, health care provider, employee of the department 10 of health and human services, employee of the department of 11 inspections, appeals, and licensing who conducts investigations 12 or inspections, employee of the department of revenue, national 13 guard member engaged in national guard duty or state active 14 duty, civilian employee of a law enforcement agency, civilian 15 employee of a fire department, or fire fighter, whether paid or 16 volunteer, who knows that the person against whom the assault 17 is committed is a peace officer, jailer, correctional or 18 juvenile detention staff, member or employee of the board of 19 parole, pilot, health care provider, employee of the department 20 of health and human services, employee of the department of 21 inspections, appeals, and licensing who conducts investigations 22 or inspections, employee of the department of revenue, national 23 guard member engaged in national guard duty or state active 24 duty, civilian employee of a law enforcement agency, civilian 25 employee of a fire department, or fire fighter and who uses or 26 displays a dangerous weapon in connection with the assault, is 27 guilty of a class “C” felony. 28 3. A person who commits an assault, as defined in section 29 708.1 , against a peace officer, jailer, correctional or 30 juvenile detention staff, member or employee of the board of 31 parole, pilot, health care provider, employee of the department 32 of health and human services, employee of the department of 33 inspections, appeals, and licensing who conducts investigations 34 or inspections, employee of the department of revenue, national 35 -2- HF 2778.4125 (2) 91 jm/jh 2/ 4
guard member engaged in national guard duty or state active 1 duty, civilian employee of a law enforcement agency, civilian 2 employee of a fire department, or fire fighter, whether paid or 3 volunteer, who knows that the person against whom the assault 4 is committed is a peace officer, jailer, correctional or 5 juvenile detention staff, member or employee of the board of 6 parole, pilot, health care provider, employee of the department 7 of health and human services, employee of the department of 8 inspections, appeals, and licensing who conducts investigations 9 or inspections, employee of the department of revenue, national 10 guard member engaged in national guard duty or state active 11 duty, civilian employee of a law enforcement agency, civilian 12 employee of a fire department, or fire fighter, and who causes 13 bodily injury or mental illness, is guilty of a class “D” 14 felony. 15 4. Any other assault, as defined in section 708.1 , including 16 an assault causing another to come into contact with saliva by 17 throwing, tossing, spitting, or expelling the fluid, committed 18 against a peace officer, jailer, correctional or juvenile 19 detention staff, member or employee of the board of parole, 20 pilot, health care provider, employee of the department of 21 health and human services, employee of the department of 22 inspections, appeals, and licensing who conducts investigations 23 or inspections, employee of the department of revenue, national 24 guard member engaged in national guard duty or state active 25 duty, civilian employee of a law enforcement agency, civilian 26 employee of a fire department, or fire fighter, whether paid 27 or volunteer, by a person who knows that the person against 28 whom the assault is committed is a peace officer, jailer, 29 correctional or juvenile detention staff, member or employee of 30 the board of parole, pilot, health care provider, employee of 31 the department of health and human services, employee of the 32 department of inspections, appeals, and licensing who conducts 33 investigations or inspections, employee of the department of 34 revenue, national guard member engaged in national guard duty 35 -3- HF 2778.4125 (2) 91 jm/jh 3/ 4
or state active duty, civilian employee of a law enforcement 1 agency, civilian employee of a fire department, or fire 2 fighter, is an aggravated misdemeanor. A person convicted of 3 violating this subsection shall serve a minimum term of seven 4 days of the sentence imposed by law, and shall not be eligible 5 for suspension of the minimum sentence. 6 Sec. ___. Section 708.3A, subsection 5, Code 2026, is 7 amended by adding the following new paragraph: 8 NEW PARAGRAPH . 0h. “Pilot” means a person in the act of 9 operating a commercial, private, or recreational aircraft that 10 is not a remotely piloted aircraft. > 11 4.
