House File 2754 H-8372 Amend the amendment, H-8371, to House File 2754, as follows: 1 1. Page 53, after line 13 by inserting: 2 < DIVISION ___ 3 PRIVATE INSTRUCTION 4 Sec. ___. Section 299.4, subsection 1, Code 2026, is amended 5 to read as follows: 6 1. The parent, guardian, or legal custodian of a child 7 who is of compulsory attendance age, who places the child 8 under competent private instruction under section 299A.2 , not 9 in an accredited school or a home school assistance program 10 operated by a school district or accredited nonpublic school, 11 shall furnish a report in duplicate on forms provided by the 12 public school district, to the district by September 1 of the 13 school year in which the child will be under competent private 14 instruction. The secretary shall retain and file one copy 15 and forward the other copy to the district’s area education 16 agency. The report shall state the name and age of the child, 17 the period of time during which the child has been or will be 18 under competent private instruction for the year, an outline 19 of the course of study , or texts that will be used, and the 20 name and address of the instructor. The parent, guardian, or 21 legal custodian of a child, who is placing the child under 22 competent private instruction for the first time, shall also 23 provide the district with evidence that the child has had the 24 immunizations required under section 139A.8 , and, if the child 25 is elementary school age, a blood lead test in accordance with 26 section 135.105D . The term “outline of course of study” shall 27 include subjects covered, lesson plans, and time spent on the 28 areas of study. 29 Sec. ___. Section 299A.1, subsection 2, paragraph b, Code 30 2026, is amended to read as follows: 31 b. “Independent private instruction” means private 32 instruction that meets the following criteria: 33 (1) Is not accredited. 34 (2) Enrolls not more than four unrelated students. 35 -1- H 8371.4053 (2) 91 jda/jh 1/ 4 #1.
(3) Does not charge tuition, fees, or other remuneration for 1 instruction. 2 (4) (2) Provides private or religious-based instruction as 3 its primary purpose. 4 (5) (3) Provides enrolled students in all grade levels with 5 instruction in mathematics, reading and language arts, science, 6 and social studies. 7 (6) (4) Provides, upon written request from the 8 superintendent of the school district in which the independent 9 private instruction is provided, or from the director of the 10 department of education, a report identifying the primary 11 instructor, location, name of the authority responsible for the 12 independent private instruction, and the names of the students 13 enrolled receiving the instruction, who need not be related to 14 the primary instructor . 15 (7) (5) Is not a nonpublic school and does not provide 16 competent private instruction as defined in this subsection . 17 (8) (6) Is exempt from all state statutes and 18 administrative rules applicable to a school, a school board, or 19 a school district, except as otherwise provided in chapter 299 20 and this chapter . 21 Sec. ___. NEW SECTION . 299A.13 Recognition of private 22 instruction diplomas, final transcripts, and other written 23 documentation. 24 1. A student who completes a program of secondary education 25 under competent private instruction or independent private 26 instruction in accordance with this chapter shall be deemed to 27 have completed a high school education. 28 2. The parent, guardian, legal custodian, or instructor 29 responsible for providing the program of secondary education 30 under competent private instruction or independent private 31 instruction in accordance with this chapter may issue a 32 diploma, final transcript, or other written documentation 33 evidencing academic achievements and the completion of the 34 program of secondary education. 35 -2- H 8371.4053 (2) 91 jda/jh 2/ 4

A diploma, final transcript, or other written 1 documentation issued pursuant to subsection 2 shall be accepted 2 under the laws of this state in the same manner as a high school 3 diploma, final transcript, or other written documentation 4 issued by a school district or an accredited nonpublic school 5 for all purposes, including but not limited to all of the 6 following: 7 a. Admission to postsecondary education or training 8 programs. 9 b. Eligibility for employment. 10 c. Qualification for occupational licensure, certification, 11 or registrations. 12 d. Access to state and local programs, benefits, and 13 opportunities. 14 e. Any other purpose under the laws of this state in which a 15 high school diploma is a condition or a qualification. 16 4. The state, a political subdivision of the state, or any 17 other person shall not deny or restrict any right, privilege, 18 or benefit available to an individual solely because the 19 individual’s diploma, final transcript, or other written 20 documentation was issued pursuant to subsection 2. 21 5. A student who completes a program of secondary education 22 under competent private instruction or independent private 23 instruction in accordance with this chapter shall not be 24 required to obtain a high school equivalency diploma or other 25 alternative credential. 26 Sec. ___. NEW SECTION . 299A.14 Verification of enrollment. 27 The parent, guardian, or legal custodian of a child of 28 compulsory attendance age shall have the authority to execute 29 any document required by law to verify any of the following: 30 1. The placement of a child under competent private 31 instruction or independent private instruction. 32 2. The child’s full-time or part-time status in competent 33 private instruction or independent private instruction. 34 3. instruction or independent private instruction. 1 4. Any other required educational information. 2 Sec. ___. APPLICABILITY.
