House File 2533 H-8331 Amend House File 2533 as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < DIVISION I 4 PROFESSIONAL PERMIT TO CARRY WEAPONS 5 Section 1. Section 724.6, subsection 1, paragraph a, 6 subparagraph (1), Code 2026, is amended to read as follows: 7 (1) A person may be issued a permit to carry weapons when 8 the person’s employment in a private investigation business 9 or private security business licensed under chapter 80A , or a 10 person’s employment as a peace officer, correctional officer, 11 member of the general assembly, judicial officer, county 12 attorney, assistant county attorney, attorney general, deputy 13 attorney general, assistant attorney general, security guard, 14 bank messenger or other person transporting property of a value 15 requiring security, or in police work, reasonably justifies 16 that person going armed. 17 Sec. 2. Section 724.6, subsection 1, paragraph a, 18 subparagraph (4), Code 2026, is amended to read as follows: 19 (4) A person may be issued a permit to carry weapons if 20 the person is a member of the general assembly, judicial 21 officer, county attorney , or an assistant county attorney , 22 attorney general, deputy attorney general, or assistant 23 attorney general . An application for a permit by an assistant 24 county attorney must be approved by the county attorney of 25 each county in which the applicant serves prior to a permit 26 to carry weapons being issued. An application for a permit 27 by the attorney general or deputy attorney general or by an 28 assistant attorney general shall be delivered to the sheriff 29 for the county in which the applicant resides. The sheriff 30 of the issuing county may require the applicant to complete a 31 proficiency examination prior to issuing the permit to carry 32 weapons. The standards for a proficiency examination for 33 a member of the general assembly, judicial officer, county 34 attorney , or assistant county attorney , attorney general, 35 -1- HF 2533.3915 (2) 91 (amending this HF 2533 to CONFORM to SF 2280) as/js 1/ 6 #1.
deputy attorney general, or assistant attorney general shall 1 not exceed the standards required of a peace officer. The 2 applicant shall pay the reasonable costs associated with 3 completing a proficiency examination. 4 Sec. 3. Section 724.6, subsection 1, paragraphs b, c, and d, 5 Code 2026, are amended to read as follows: 6 b. The permit shall be on a form prescribed and published 7 by the commissioner of public safety, shall identify the 8 holder, and shall state the nature of the employment requiring 9 the holder to go armed. A permit so issued, other than to 10 a peace officer, member of the general assembly, judicial 11 officer, county attorney, or assistant county attorney, 12 attorney general, deputy attorney general, or assistant 13 attorney general, shall authorize the person to whom it is 14 issued to go armed anywhere in the state, only while engaged 15 in the employment, and while going to and from the place of the 16 employment. 17 c. A permit issued to a certified peace officer, member of 18 the general assembly, judicial officer, county attorney, or 19 assistant county attorney , attorney general, deputy attorney 20 general, or assistant attorney general shall authorize that 21 peace officer, member of the general assembly, judicial 22 officer, county attorney, or assistant county attorney , 23 attorney general, deputy attorney general, or assistant 24 attorney general to go armed anywhere in the state at all 25 times, including on the grounds of a school. 26 d. Permits shall expire twelve months after the date 27 when issued except that permits issued to peace officers, 28 members of the general assembly, judicial officers, county 29 attorneys, assistant county attorneys, the attorney general, 30 deputy attorneys general, assistant attorneys general, and 31 correctional officers are valid through the holder of the 32 permit’s period of employment unless otherwise canceled. 33 When the employment is terminated, the holder of the permit 34 shall surrender it the permit to the issuing officer for 35 -2- HF 2533.3915 (2) 91 (amending this HF 2533 to CONFORM to SF 2280) as/js 2/ 6
cancellation. 1 Sec. 4. Section 724.6, subsection 1, Code 2026, is amended 2 by adding the following new paragraph: 3 NEW PARAGRAPH . e. Notwithstanding any other provision in 4 this section, a person issued a permit to carry weapons under 5 this section may carry weapons only in a concealed manner when 6 inside a courtroom. This paragraph does not apply to peace 7 officers or correctional officers when fulfilling their duties 8 of employment. 9 Sec. 5. Section 724.6, subsection 3, Code 2026, is amended 10 to read as follows: 11 3. For purposes of this section , “emergency medical care 12 provider” : 13 a. “Emergency medical care provider” means the same as 14 defined in section 147A.1 . 15 b. “Judicial officer” means the same as defined in section 16 602.1101. 17 Sec. 6. Section 724.6, Code 2026, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 4. The supreme court may by rule impose 20 additional training or other requirements on judicial officers 21 who hold a permit issued under this section. 22 DIVISION II 23 THREATS AGAINST MEMBERS OF THE GENERAL ASSEMBLY OR JUDICIAL 24 OFFICERS —— IMMEDIATE FAMILY MEMBERS 25 Sec. 7. NEW SECTION . 708.17 Threatening a member of the 26 general assembly, judicial officer, or an immediate family member 27 of a member of the general assembly or a judicial officer. 28 1. No person shall threaten a member of the general 29 assembly, a judicial officer, or an immediate family member of 30 a member of the general assembly or judicial officer with the 31 intent to do any of the following: 32 a. Place the general assembly member or a judicial officer 33 or the immediate family member of a general assembly member 34 or judicial officer in fear of serious injury to the general 35 -3- HF 2533.3915 (2) 91 (amending this HF 2533 to CONFORM to SF 2280) as/js 3/ 6
assembly member or judicial officer or the immediate family 1 member of the general assembly member or judicial officer. 2 b. Prevent or interrupt the ability of the general assembly 3 member or judicial officer to carry out the general assembly 4 member’s or judicial officer’s job duties. 5 c. Retaliate against a general assembly member or a 6 judicial officer in relation to the performance of the general 7 assembly member’s or judicial officer’s official duties during 8 the general assembly member’s or judicial officer’s term of 9 service. 10 2. A person who violates the provisions of this section is 11 guilty of a class “C” felony. 12 3. As used in this section: 13 a. “Immediate family member” means a spouse, child, sibling, 14 parent, grandparent, or grandchild, and includes a stepparent, 15 a stepchild, a stepsibling, or an adoptive relationship. 16 b. “Judicial officer” means the same as defined in section 17 602.1101. 18 c. “Retaliate” means intentionally threatening bodily injury 19 to or damage to the property of a general assembly member or a 20 judicial officer with intent to retaliate against the general 21 assembly member for the general assembly member’s exercise 22 of legislative duties or judicial officer for the judicial 23 officer’s exercise of judicial duties and causing the general 24 assembly member, judicial officer, or the family member to 25 reasonably believe that the general assembly member’s, the 26 judicial officer’s, or the family member’s person or property 27 is in danger. 28 DIVISION III 29 MALICIOUS SHARING OF PERSONAL INFORMATION 30 Sec. 8. NEW SECTION . 708.18 Malicious sharing of personal 31 information of a general assembly member or a judicial officer 32 or an immediate family member of a general assembly member or a 33 judicial officer. 34 1. general assembly member or judicial officer or the immediate 1 family member of a general assembly member or a judicial 2 officer with the intent to do any of the following: 3 a. Cause harm to the general assembly member or judicial 4 officer or the immediate family member of a general assembly 5 member or a judicial officer. 6 b. Place the general assembly member or judicial officer 7 or the immediate family member of a general assembly member 8 or a judicial officer in fear of serious harm to the general 9 assembly member or judicial officer or to an immediate family 10 member of the general assembly member or judicial officer. 11 c. Prevent or interrupt the ability to carry out the general 12 assembly member’s or judicial officer’s job duties. 13 2. A person who violates the provisions of this section is 14 guilty of a serious misdemeanor. 15 3. As used in this section: 16 a. “Immediate family member” means a spouse, child, sibling, 17 parent, grandparent, or grandchild, and includes a stepparent, 18 a stepchild, a stepsibling, or an adoptive relationship. 19 b. “Judicial officer” means the same as defined in section 20 602.1101. 21 c. “Personal information” means a person’s personal physical 22 address, personal phone number, or physical location. 23 DIVISION IV 24 THREATS INCLUDING TO PUBLIC OFFICIALS 25 Sec. 9. Section 708.7, subsection 1, Code 2026, is amended 26 by adding the following new paragraph: 27 NEW PARAGRAPH . c. A person commits harassment when the 28 person communicates a true threat, including an intent to 29 cause bodily injury to a public official, as defined in 30 section 68B.2, and the public official becomes aware of such 31 communication within one year of the threat. > 32 2.
