The owner of a driverless-capable vehicle is deemed to 5 be operating the vehicle while the automated driving system 6 is engaged and shall be liable for personal injury, death, or 7 property damage that results in connection with the operation 8 of the vehicle. 9 2. An owner’s liability under subsection 1 does not preclude 10 a person injured by a driverless-capable vehicle, while the 11 automated driving system was engaged, from bringing an action 12 against the manufacturer of the driverless-capable vehicle 13 and any person who installed the vehicle’s automated driving 14 system if the driverless-capable vehicle malfunctioned or if 15 the automated driving system malfunctioned. 16 3.
