House File 2533 H-8112 Amend House File 2533 as follows: 1 1. By striking everything after the enacting clause and 2 inserting: 3 < DIVISION I 4 PROFESSIONAL PERMIT TO CARRY WEAPONS 5 Section 1. Section 724.6, subsection 1, paragraph a, 6 subparagraph (1), Code 2026, is amended to read as follows: 7 (1) A person may be issued a permit to carry weapons when 8 the person’s employment in a private investigation business 9 or private security business licensed under chapter 80A , or a 10 person’s employment as a peace officer, correctional officer, 11 member of the general assembly, judicial officer, county 12 attorney, assistant county attorney, attorney general, deputy 13 attorney general, assistant attorney general, security guard, 14 bank messenger or other person transporting property of a value 15 requiring security, or in police work, reasonably justifies 16 that person going armed. 17 Sec. 2. Section 724.6, subsection 1, paragraph a, 18 subparagraph (4), Code 2026, is amended to read as follows: 19 (4) A person may be issued a permit to carry weapons if 20 the person is a member of the general assembly, judicial 21 officer, county attorney , or an assistant county attorney , 22 attorney general, deputy attorney general, or assistant 23 attorney general . An application for a permit by an assistant 24 county attorney must be approved by the county attorney of 25 each county in which the applicant serves prior to a permit 26 to carry weapons being issued. An application for a permit 27 by the attorney general or deputy attorney general or by an 28 assistant attorney general shall be delivered to the sheriff 29 for the county in which the applicant resides. The sheriff 30 of the issuing county may require the applicant to complete a 31 proficiency examination prior to issuing the permit to carry 32 weapons. The standards for a proficiency examination for 33 a member of the general assembly, judicial officer, county 34 attorney , or assistant county attorney , attorney general, 35 -1- HF 2533.3049 (1) 91 (amending this HF 2533 to CONFORM to SF 2280) as/js 1/ 5 #1.
deputy attorney general, or assistant attorney general shall 1 not exceed the standards required of a peace officer. The 2 applicant shall pay the reasonable costs associated with 3 completing a proficiency examination. 4 Sec. 3. Section 724.6, subsection 1, paragraphs b, c, and d, 5 Code 2026, are amended to read as follows: 6 b. The permit shall be on a form prescribed and published 7 by the commissioner of public safety, shall identify the 8 holder, and shall state the nature of the employment requiring 9 the holder to go armed. A permit so issued, other than to 10 a peace officer, member of the general assembly, judicial 11 officer, county attorney, or assistant county attorney, 12 attorney general, deputy attorney general, or assistant 13 attorney general, shall authorize the person to whom it is 14 issued to go armed anywhere in the state, only while engaged 15 in the employment, and while going to and from the place of the 16 employment. 17 c. A permit issued to a certified peace officer, member of 18 the general assembly, judicial officer, county attorney, or 19 assistant county attorney , attorney general, deputy attorney 20 general, or assistant attorney general shall authorize that 21 peace officer, member of the general assembly, judicial 22 officer, county attorney, or assistant county attorney , 23 attorney general, deputy attorney general, or assistant 24 attorney general to go armed anywhere in the state at all 25 times, including on the grounds of a school. 26 d. Permits shall expire twelve months after the date 27 when issued except that permits issued to peace officers, 28 members of the general assembly, judicial officers, county 29 attorneys, assistant county attorneys, the attorney general, 30 deputy attorneys general, assistant attorneys general, and 31 correctional officers are valid through the holder of the 32 permit’s period of employment unless otherwise canceled. 33 When the employment is terminated, the holder of the permit 34 shall surrender it the permit to the issuing officer for 35 -2- HF 2533.3049 (1) 91 (amending this HF 2533 to CONFORM to SF 2280) as/js 2/ 5
cancellation. 1 Sec. 4. Section 724.6, subsection 1, Code 2026, is amended 2 by adding the following new paragraph: 3 NEW PARAGRAPH . e. Notwithstanding any other provision in 4 this section, a person issued a permit to carry weapons under 5 this section may carry weapons only in a concealed manner when 6 inside a courtroom. This paragraph does not apply to peace 7 officers or correctional officers when fulfilling their duties 8 of employment. 9 Sec. 5. Section 724.6, subsection 3, Code 2026, is amended 10 to read as follows: 11 3. For purposes of this section , “emergency medical care 12 provider” : 13 a. “Emergency medical care provider” means the same as 14 defined in section 147A.1 . 15 b. “Judicial officer” means the same as defined in section 16 602.1101. 17 Sec. 6. Section 724.6, Code 2026, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 4. The supreme court may by rule impose 20 additional training or other requirements on judicial officers 21 who hold a permit issued under this section. 22 DIVISION II 23 THREATS AGAINST A JUDICIAL OFFICER OR AN IMMEDIATE FAMILY 24 MEMBER OF A JUDICIAL OFFICER 25 Sec. 7. NEW SECTION . 708.17 Threatening a judicial officer 26 or an immediate family member of a judicial officer. 27 1. No person shall threaten a judicial officer or the 28 immediate family member of a judicial officer with the intent 29 to do any of the following: 30 a. Place the judicial officer or the immediate family member 31 of a judicial officer in fear of serious injury to the judicial 32 officer or the immediate family member of the judicial officer. 33 b. c. Retaliate against a judicial officer in relation to the 1 performance of the judicial officer’s official duties during 2 the judicial officer’s term of service. 3 2. A person who violates the provisions of this section is 4 guilty of a class “C” felony. 5 3. As used in this section: 6 a. “Immediate family member” means a spouse, child, sibling, 7 parent, grandparent, or grandchild, and includes a stepparent, 8 a stepchild, a stepsibling, or an adoptive relationship. 9 b. “Judicial officer” means the same as defined in section 10 602.1101. 11 c. “Retaliate” means intentionally threatening bodily injury 12 to or damage to the property of a judicial officer with intent 13 to retaliate against the judicial officer for the judicial 14 officer’s exercise of judicial duties and causing the judicial 15 officer or the family member to reasonably believe that the 16 judicial officer’s or the family member’s person or property 17 is in danger. 18 DIVISION III 19 MALICIOUS SHARING OF PERSONAL INFORMATION 20 Sec. 8. NEW SECTION . 708.18 Malicious sharing of personal 21 information of a judicial officer or an immediate family member 22 of a judicial officer. 23 1. No person shall share the personal information of a 24 judicial officer or the immediate family member of a judicial 25 officer with the intent to do any of the following: 26 a. Cause harm to the judicial officer or the immediate 27 family member of a judicial officer. 28 b. Place the judicial officer or the immediate family member 29 of a judicial officer in fear of serious harm to the judicial 30 officer or to an immediate family member of the judicial 31 officer. 32 c. Prevent or interrupt the ability to carry out the 33 judicial officer’s job duties. 34 2. guilty of a serious misdemeanor. 1 3. As used in this section: 2 a. “Immediate family member” means a spouse, child, sibling, 3 parent, grandparent, or grandchild, and includes a stepparent, 4 a stepchild, a stepsibling, or an adoptive relationship. 5 b. “Judicial officer” means the same as defined in section 6 602.1101. 7 c. “Personal information” means a person’s personal physical 8 address, personal phone number, or physical location. 9 DIVISION IV 10 THREATS INCLUDING TO PUBLIC OFFICIALS 11 Sec. 9. Section 708.7, subsection 1, Code 2026, is amended 12 by adding the following new paragraph: 13 NEW PARAGRAPH . c. A person commits harassment when the 14 person communicates a true threat, including an intent to 15 cause bodily injury to a public official, as defined in 16 section 68B.2, and the public official becomes aware of such 17 communication within one year of the threat. > 18 2.
