Section 256F.4, subsection 2, Code 2026, is 11 amended by adding the following new paragraph: 12 NEW PARAGRAPH . w. Be subject to and comply with 13 the requirements of section 279.89 relating to student 14 instructional technology standards in the same manner as a 15 school district. 16 Sec. ___. NEW SECTION . 279.89 Student instructional 17 technology standards. 18 1. As used in this section, unless the context otherwise 19 requires: 20 a. “Digital instruction” means lessons, assignments, 21 assessments, or instructional activities delivered through 22 instructional technology. 23 b. “Instructional technology” means a laptop, tablet, 24 computer, smart device, software platform, or other similar 25 device or platform used for student learning. 26 c. “One-to-one digital device program” means a program 27 through which a school district provides or assigns a digital 28 device to each student for instructional use. 29 2. a. For students enrolled in grades kindergarten through 30 five, digital instruction shall not exceed sixty minutes per 31 school day. 32 b. The following uses shall not count toward the daily 33 limit: 34 (1) Use required pursuant to an individualized education 35 -1- HF 2676.3024 (1) 91 ss/ko 1/ 3 #1.
program or a plan developed pursuant to section 504 of the 1 federal Rehabilitation Act of 1973. 2 (2) Assistive or adaptive technology necessary to provide a 3 student access to instruction. 4 (3) Teacher-directed demonstrations using a projector, 5 smartboard, or similar display device when students are not 6 individually operating a digital device. 7 (4) State assessments and progress monitoring that requires 8 the use of a one-to-one digital device. 9 (5) Dedicated computer science and technology curriculum. 10 3. a. The board of directors of each school district shall 11 adopt a written technology use policy applicable to grades 12 kindergarten through five. 13 b. The policy shall include all of the following: 14 (1) The district’s daily digital instruction limits. 15 (2) A list of digital platforms and applications used for 16 instruction. 17 (3) Notice of a parent’s or guardian’s right to request 18 additional reductions in the parent’s or guardian’s child’s 19 digital instruction. 20 (4) A statement that instructional technology shall 21 support, and not supplant, foundational learning. 22 (5) A prohibition on the use of digital devices during 23 recess. 24 c. The policy shall be published on each elementary school’s 25 internet site. 26 4. a. Prior to adopting or renewing a one-to-one digital 27 device program for any grade level, the board of directors of a 28 school district shall complete a technology adoption checklist 29 that documents consideration of all of the following: 30 (1) The instructional purpose of the device. 31 (2) Age appropriateness of the device and associated 32 software. 33 (3) Content-filtering limitations and the district’s 34 capacity to mitigate those limitations. 35 -2- HF 2676.3024 (1) 91 ss/ko 2/ 3
(4) Whether student data is collected, stored, or shared, 1 and the nature of such data practices. 2 b. The checklist shall be retained by the board and made 3 available to the department of education upon request for audit 4 or compliance purposes. 5 c. Each school district shall make publicly available on the 6 district’s internet site a list of one-to-one digital device 7 programs in use, and information regarding opt-out options for 8 parents who decline participation in digital instruction. 9 5. This section shall not apply to students enrolled in an 10 online learning program operating pursuant to section 256.43. > 11 2.
