Page 5, by striking lines 4 through 16 and inserting: 3 < The department shall continuously request that the United 4 States department of agriculture, food and nutrition service, 5 provide approval, for purposes of state administration of the 6 supplemental food and nutrition program and the summer EBT 7 program, if the state participates in the summer EBT program, 8 for a modification to the list of eligible foods in 7 C.F.R. 9 §271.2 to only include foods that are eligible as of January 10 1, 2026. The department may seek approval for additional 11 foods to be excluded based on healthy food standards if the 12 state provides all authorized SNAP retailers with a list of 13 ineligible foods identified by universal product code, and 14 instructions for point-of-sale compliance. The department 15 shall implement each modification upon receipt of approval. > 16 3.
