The moneys appropriated in this subsection shall be 21 used for the public purpose of providing a grant to a national 22 nonprofit organization with over 80 years of experience in 23 assisting children and adults with disabilities and special 24 needs. The moneys shall be used to support a nationally 25 recognized program that began in 1986 and has been replicated 26 in at least 30 other states, but is not available through 27 any other entity in this state, and that provides assistance 28 to farmers with disabilities in all 99 counties to allow the 29 farmers to remain in their own homes and be gainfully engaged 30 in farming through provision of agricultural worksite and home 31 modification consultations, peer support services, services 32 to families, information and referral, and equipment loan 33 services. 34 c. value-added agricultural grant program created in section 1 187.321. 2 (2) Of the amount appropriated in this subsection, the 3 department may use up to $813,000 to support the choose Iowa 4 promotional program as provided in chapter 187, subchapter III, 5 part 1. 6 (3) Of the amount appropriated in this subsection, the 7 department shall use at least $500,000 to support the dairy 8 innovation and revitalization program created in section 9 187.311. 10 c. The department may increase or decrease the amount of 11 moneys used to support a program described in paragraph “b” 12 based on the amount of moneys awarded to persons participating 13 in the program. The department shall publish a notice of the 14 department’s action to increase or decrease the amount on the 15 department’s internet site where the programs are advertised at 16 least thirty days prior to the day that the department takes 17 such action. 18 10. CHOOSE IOWA FOOD PURCHASING PROGRAM 19 a. For purposes of supporting the choose Iowa food 20 purchasing program to assist eligible participants in 21 purchasing qualified food products pursuant to section 187.331, 22 as enacted by this Act: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 24 b. Notwithstanding section 8.33, moneys appropriated in 25 this subsection that remain unencumbered or unobligated at the 26 close of the fiscal year shall not revert but shall remain 27 available for expenditure for the purposes designated until the 28 close of the succeeding fiscal year. 29 Sec. 6. NEW SECTION . 187.331 Choose Iowa food purchasing 30 program. 31 1. There is created within the department a choose Iowa food 32 purchasing program. 33 2. The department shall administer the program according to 34 all of the following: 35 -6- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 6/ 30
a. A farm or business that owns or operates the farm 1 source shall be given a preference to participate in the 2 program if the farm or business is currently participating 3 in the choose Iowa promotional program as provided in this 4 part 1 of subchapter III. Otherwise, a farm or business may 5 participate in the program if the farm or business has applied 6 to participate in the choose Iowa promotional program and the 7 department determines that the application will be approved. 8 b. An eligible participant is limited to any Iowa food bank 9 or an Iowa emergency feeding organization, recognized by the 10 department. 11 c. A qualified food product is limited to meat and poultry, 12 dairy products, grains, flour, eggs, honey, and produce. 13 3. a. Of the moneys appropriated to support the program in 14 a fiscal year, not more than two hundred thousand dollars shall 15 be used to reimburse Iowa food banks and Iowa emergency feeding 16 organizations. 17 b. An eligible participant shall be reimbursed on a matching 18 basis with the department contributing one dollar for every one 19 dollar expended by the eligible participant. 20 c. An Iowa food bank or Iowa emergency feeding organization 21 shall not receive more than fifty thousand dollars per fiscal 22 year for participating in the program. 23 4. The department may use not more than five percent of the 24 moneys appropriated to support the program in a fiscal year to 25 pay for the costs of administering the program. 26 5. The department shall prepare and submit a report 27 regarding its findings and recommendations to the governor and 28 general assembly not later than January 15 of each year. 29 6. This section is repealed July 1, 2030. 30 Sec. 7. DIRECTIONS TO CODE EDITOR. The report shall describe in detail the 23 expenditure of moneys appropriated under this section to 24 support the department’s administration, regulation, and 25 programs. 26 Sec. 9. STATE FISH AND GAME PROTECTION FUND —— REGULATION 27 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 28 1. There is appropriated from the state fish and game 29 protection fund created pursuant to section 456A.17 to the 30 department of natural resources for the fiscal year beginning 31 July 1, 2025, and ending June 30, 2026, the following amount, 32 or so much thereof as is necessary, to be used for the purposes 33 designated: 34 For purposes of supporting the regulation or advancement of 35 -8- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 8/ 30

There is appropriated from the general fund of the state 2 to the state university of Iowa for the fiscal year beginning 3 July 1, 2025, and ending June 30, 2026, the following amount, 4 or so much thereof as is necessary, to be used for the purposes 5 designated: 6 For supporting the operations of Iowa’s center for 7 agricultural safety and health, as part of the university’s 8 college of public health, and in cooperation with the 9 department of agriculture and land stewardship, to anticipate, 10 recognize, and prevent occupational illness and injury among 11 members of the agricultural community: 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 128,154 13 2. a. As a condition of the appropriation made in 14 subsection 1, the state university of Iowa shall retain the 15 director of Iowa’s center for agricultural safety and health 16 employed on the effective date of this division of this Act for 17 at least the same number of hours for the fiscal year beginning 18 July 1, 2025, as worked by the director during the fiscal year 19 beginning July 1, 2024. 20 b. As a condition of the appropriation made in subsection 21 1, the state university of Iowa shall not reduce the amount 22 allocated to support Iowa’s center for agricultural safety and 23 health from any other source due to the appropriation made in 24 subsection 1. 25 3. If by June 30, 2026, the state university of Iowa fails 26 to use the moneys appropriated in subsection 1 in accordance 27 with the purposes and conditions of subsections 1 and 2, any 28 unencumbered or unobligated moneys appropriated in subsection 29 1 for the fiscal year beginning July 1, 2025, and ending June 30 30, 2026, shall revert to the general fund of the state. In 31 addition, if moneys revert as required pursuant to section 32 8.33 , the state university of Iowa shall transfer to the 33 general fund of the state from any otherwise unencumbered or 34 unobligated moneys from any other general fund appropriation or 35 -13- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 13/ 30
from any moneys available from other funding sources an amount 1 equal to the amount appropriated in subsection 1 less any 2 amount that reverted to the general fund of the state pursuant 3 to section 8.33 . 4 Sec. 16. IOWA GEOLOGICAL SURVEY —— GROUNDWATER PLANNING AND 5 RESOURCE ASSESSMENT PROJECT. 6 1. There is appropriated from the general fund of the state 7 to the state university of Iowa for the fiscal year beginning 8 July 1, 2025, and ending June 30, 2026, the following amount, 9 or so much thereof as is necessary, to be used for the purposes 10 designated: 11 For purposes of supporting a groundwater planning and 12 resource assessment project to be administered by the Iowa 13 geological survey of the state as created pursuant to section 14 456.1: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 16 2. The moneys appropriated in subsection 1 shall be used 17 by the Iowa geological survey to map and assess the condition 18 of this state’s aquifers. The Iowa geological survey may 19 measure the volume of groundwater that is available for various 20 uses, the current and predicted allocations of groundwater to 21 support those uses, the recharge rate for the aquifers, and 22 the development of models for budgeting this state’s water 23 resources. 24 3. Notwithstanding section 8.33, moneys appropriated in 25 subsection 1 that remain unencumbered or unobligated at the 26 close of the fiscal year shall not revert but shall remain 27 available for expenditure for the purposes designated in 28 subsection 1. 29 DIVISION V 30 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS 31 Sec. 17. Notwithstanding section 8.33 , moneys appropriated for 16 the fiscal year beginning July 1, 2025, in this division of 17 this Act to the department of agriculture and land stewardship 18 to provide financial assistance for the establishment of 19 permanent soil and water conservation practices that remain 20 unencumbered or unobligated at the close of the fiscal year 21 shall not revert but shall remain available for expenditure 22 for the purposes designated until the close of the fiscal year 23 beginning July 1, 2028. 24 2. Subsection 1 does not apply to moneys transferred 25 pursuant to this division of this Act to the loess hills 26 development and conservation fund created in section 161D.2 , 27 which shall not revert as provided in that section. 28 DIVISION VI 29 ENVIRONMENT FIRST FUND —— SPECIAL APPROPRIATIONS 30 Sec. 21. WATER QUALITY INITIATIVE —— DEPARTMENT OF 31 AGRICULTURE AND LAND STEWARDSHIP. 32 1. The moneys appropriated in subsection 1 shall be 10 used to support projects in subwatersheds as designated by the 11 division that are part of high-priority watersheds identified 12 by the water resources coordinating council established 13 pursuant to section 466B.3 . 14 b. The moneys appropriated in subsection 1 shall be used to 15 support projects in watersheds generally, including regional 16 watersheds, as designated by the division and high-priority 17 watersheds identified by the water resources coordinating 18 council established pursuant to section 466B.3 . 19 3. In supporting projects in subwatersheds and watersheds 20 as provided in subsection 2, all of the following apply: 21 a. The demonstration projects shall utilize water quality 22 practices as described in the Iowa nutrient reduction strategy 23 as defined in section 455B.171 . 24 b. The division shall implement demonstration projects as 25 provided in paragraph “a” by providing for participation by 26 persons who hold a legal interest in agricultural land used in 27 farming. To every extent practical, the division shall provide 28 for collaborative participation by such persons who hold a 29 legal interest in agricultural land located within the same 30 subwatershed. 31 c. The division shall implement a demonstration project on 32 a cost-share basis as determined by the division. However, 33 except for edge-of-field practices, the state’s share of the 34 amount shall not exceed 50 percent of the estimated cost of 35 -20- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 20/ 30
establishing the practice as determined by the division or 1 50 percent of the actual cost of establishing the practice, 2 whichever is less. 3 d. The demonstration projects shall be used to educate other 4 persons about the feasibility and value of establishing similar 5 water quality practices. The division shall promote field day 6 events for purposes of allowing interested persons to establish 7 water quality practices on their agricultural land. 8 e. The division shall conduct water quality evaluations 9 within supported subwatersheds. Within a reasonable period 10 after accumulating information from such evaluations, the 11 division shall create an aggregated database of water quality 12 practices. Any information identifying a person holding a 13 legal interest in agricultural land or specific agricultural 14 land shall be a confidential record under section 22.7 . 15 4. The moneys appropriated in subsection 1 shall be used 16 to support education and outreach in a manner that encourages 17 persons who hold a legal interest in agricultural land used for 18 farming to implement water quality practices, including the 19 establishment of such practices in watersheds generally, and 20 not limited to subwatersheds or high-priority watersheds. 21 5. The moneys appropriated in subsection 1 may be used 22 to contract with persons to coordinate the implementation of 23 efforts provided in this section. 24 6. The moneys appropriated in subsection 1 may be used by 25 the department to support urban soil and water conservation 26 efforts, which may include but are not limited to management 27 practices related to bioretention, landscaping, the use of 28 permeable or pervious pavement, and soil quality restoration. 29 The moneys shall be allocated on a cost-share basis as provided 30 in chapter 161A . 31 7. Notwithstanding any other provision of law to the 32 contrary, the department may use moneys appropriated in 33 subsection 1 to carry out the provisions of this section on a 34 cost-share basis in combination with other moneys available to 35 -21- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 21/ 30
the department from a state or federal source. 1 8. Not more than 10 percent of the moneys appropriated in 2 this section may be used to pay for the costs of administering 3 and implementing the water quality initiative by the 4 department’s division of soil conservation and water quality as 5 provided in section 466B.42 and this section. 6 DIVISION VII 7 RESOURCES ENHANCEMENT AND PROTECTION —— OPEN SPACES 8 Sec. 22. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. In 9 lieu of the standing appropriation in section 455A.18 , there is 10 appropriated from the environment first fund created in section 11 8.57A to the Iowa resources enhancement and protection fund 12 for the fiscal year beginning July 1, 2025, and ending June 13 30, 2026, the following amount, to be allocated as provided in 14 section 455A.19 : 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 16 Sec. 23. REAP —— OPEN SPACES ACCOUNT —— STATE PARK 17 MAINTENANCE, OPERATIONS, AND FACILITY REFURBISHMENT. 18 Notwithstanding section 455A.19, subsection 1 , paragraph “a”, 19 subparagraph (1), of the moneys allocated to the open spaces 20 account of the Iowa resources enhancement and protection fund, 21 up to $1,000,000 may be used by the department of natural 22 resources for state park maintenance, development, operations, 23 and facility refurbishment for the fiscal year beginning July 24 1, 2025, and ending on June 30, 2026. 25 Sec. 24. Section 455A.18, subsection 3, paragraph a, Code 26 2025, is amended to read as follows: 27 a. For each fiscal year of the fiscal period beginning 28 July 1, 1997, and ending June 30, 2026 2028 , there is 29 appropriated from the general fund, to the Iowa resources 30 enhancement and protection fund, the amount of twenty million 31 dollars, to be used as provided in this chapter . However, 32 in any fiscal year of the fiscal period, if moneys from the 33 lottery are appropriated by the state to the fund, the amount 34 appropriated under this subsection shall be reduced by the 35 -22- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 22/ 30

Section 159.5, subsection 11, paragraph a, 15 subparagraph (5), Code 2025, is amended by striking the 16 subparagraph. 17 Sec. 27. Section 163.3B, subsection 3, Code 2025, is amended 18 to read as follows: 19 3. Moneys in the fund are appropriated to the department and 20 shall be used exclusively to develop, establish, and implement 21 for the following purposes: 22 a. Developing, establishing, and implementing a foreign 23 animal disease preparedness and response strategy as described 24 in section 163.3C , and shall not require further special 25 authorization by the general assembly . 26 b. Supporting activities related to animal health and 27 disease response that strengthen the state’s overall ability 28 to prevent, prepare for, and respond to emerging or reemerging 29 animal diseases, including but not limited to salaries, 30 support, maintenance, and miscellaneous purposes. 31 Sec. 28. to or afflicted with an infectious or contagious disease. 1 However, cattle exposed to or infected with tuberculosis shall 2 not be destroyed without the owner’s consent, unless there 3 are sufficient moneys to reimburse the owner for the cattle, 4 which may be paid as an expense authorized as provided in 5 section 163.15, from moneys in the brucellosis and tuberculosis 6 eradication fund created in section 165.18, or from moneys made 7 available by the United States department of agriculture. 8 Sec. 29. Section 163.15, subsection 1, Code 2025, is amended 9 to read as follows: 10 1. If the secretary of agriculture determines that the 11 outbreak of the infectious or contagious disease tuberculosis 12 among an animal population constitutes a threat to the general 13 welfare or the public health of the inhabitants of this state, 14 the secretary shall formulate a program of eradication which 15 shall include the condemnation and destroying of the animals 16 exposed to or afflicted with the disease tuberculosis. The 17 program of eradication shall provide for the indemnification 18 of owners of the livestock under this section , if there are no 19 other sources of indemnification. The program shall not be 20 effective until the program has been approved by the executive 21 council. 22 Sec. 30. Section 163.15, subsection 2, Code 2025, is amended 23 by striking the subsection. 24 Sec. 31. Section 163A.12, Code 2025, is amended to read as 25 follows: 26 163A.12 Owner requesting test. 27 If the owner requests the department to inspect and test 28 breeding swine for brucellosis, and agrees to comply with 29 the rules made by the department under section 163A.9 , the 30 department may designate a veterinarian to make an inspection 31 and test, with the expense to be paid as provided in section 32 164.6 for cattle brucellosis testing , but only to the extent 33 the funds provided in that section are not required for the 34 cattle testing program . 35 -25- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 25/ 30
Sec. 32. Section 164.6, Code 2025, is amended to read as 1 follows: 2 164.6 Expense of test. 3 The expense for an inspection and official test of a 4 designated animal other than for bovine animals shall be borne 5 by the owner. If the designated animal is a bovine animal, and 6 the owner agrees to comply with and carry out the provisions 7 of this chapter and the rules adopted by the department under 8 section 164.4, the expense of the inspection and test shall 9 may be borne by the United States department of agriculture , 10 or by the department, or by the brucellosis and tuberculosis 11 eradication fund or any combination of these sources . 12 Sec. 33. Section 164.21, subsection 2, Code 2025, is amended 13 to read as follows: 14 2. The owner shall may be indemnified to the extent 15 that money is available in the brucellosis and tuberculosis 16 eradication fund as created in section 165.18 and 17 indemnification is also made by the United States department 18 of agriculture. However, if the United States department of 19 agriculture is unable to indemnify the owner, the department 20 may indemnify the owner, if money is available. 21 Sec. 34. Section 164.21, subsection 3, Code 2025, is amended 22 by striking the subsection. 23 Sec. 35. Section 165.2, subsection 1, Code 2025, is amended 24 to read as follows: 25 1. The state of Iowa is declared to be and is established as 26 an accredited area for the eradication of bovine tuberculosis 27 from the dairy and breeding cattle of the state. It shall be 28 the duty of the department to eradicate bovine tuberculosis in 29 all of the counties of the state in the manner provided by law 30 as it appears in this chapter . The department shall proceed 31 with the examination, including the tuberculin test, of all 32 such cattle as rapidly as practicable and as is consistent 33 with efficient work , and as funds are available for paying the 34 indemnities as provided by law . 35 -26- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 26/ 30
Sec. 36. Section 165.10, Code 2025, is amended to read as 1 follows: 2 165.10 Examination by department. 3 The department may at any time, on its own motion, make an 4 examination of any herd , and in case animals are destroyed, 5 the appraisement and payment shall be made as provided in this 6 chapter . 7 Sec. 37. Section 165.18, Code 2025, is amended to read as 8 follows: 9 165.18 Brucellosis and tuberculosis eradication Iowa animal 10 disease prevention fund. 11 1. A brucellosis and tuberculosis eradication fund is 12 created in the office of the secretary of agriculture, to be 13 used together with state and federal funds available to pay: 14 a. The indemnity and other expenses provided in this 15 chapter . 16 b. The indemnity as set out in section 164.21 and other 17 expenses provided in chapter 164 . 18 c. The expenses of the inspection and testing program 19 provided in chapter 163A , but only to the extent that the 20 moneys in the fund are not required for expenses incurred under 21 chapter 164 or this chapter . 22 d. Indemnities as provided in section 159.5, subsection 23 11 , but only to the extent that the moneys in the fund are not 24 required to pay expenses under chapter 163A , chapter 164 , or 25 this chapter . 26 2. If it appears to the secretary of agriculture that the 27 balance in the fund on January 20 is insufficient to carry 28 on the work in the state for the following fiscal year, the 29 secretary shall notify the board of supervisors of each county 30 to levy an amount sufficient to pay the expenses estimated to 31 be incurred under subsection 1 for the following fiscal year, 32 subject to a maximum levy of thirty-three and three-fourths 33 cents per thousand dollars of assessed value of all taxable 34 property in the county. 35 -27- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 27/ 30
3. Not later than December 15 or June 15 of a year in which 1 the tax is collected, the county treasurer shall transmit the 2 amount of the tax levied and collected to the treasurer of 3 state, who shall credit it to the brucellosis and tuberculosis 4 eradication fund. 5 1. An Iowa animal disease prevention fund is created in 6 the state treasury under the control and management of the 7 department. 8 2. The fund shall include moneys appropriated by the general 9 assembly credited to the fund. The fund may include other 10 moneys available to and obtained or accepted by the department 11 as provided in section 159.6A, including but not limited to the 12 federal government, other public sources, or private sources. 13 3. Moneys in the fund are appropriated to the department to 14 develop, establish, and implement an animal disease prevention 15 strategy. 16 4. a. Notwithstanding section 12C.7, interest or earnings 17 on moneys in the fund shall be credited to the fund. 18 b. Notwithstanding section 8.33, moneys in the fund that 19 remain unencumbered or unobligated at the end of a fiscal year 20 shall not revert. 21 Sec. 38. Section 165.26, Code 2025, is amended to read as 22 follows: 23 165.26 Permitting test. 24 Every owner of dairy or breeding cattle in the state shall 25 permit the owner’s cattle to be tested for tuberculosis as 26 provided in this chapter , and shall confine the cattle in a 27 proper place so that the examination and test can be applied. 28 If the owner refuses to so confine the cattle the department 29 may employ sufficient help to properly confine them and the 30 expense of such help shall be paid by the owner or deducted 31 from the indemnity if any is paid . Such owner shall comply 32 with all the requirements for the establishment and maintenance 33 of a tuberculosis-free accredited herd. 34 Sec. 39. Section 331.512, subsection 1, paragraph e, Code 35 -28- HF 1043.2023 (2) 91 (amending this HF 1043 to CONFORM to SF 646) sb/js 28/ 30
2025, is amended by striking the paragraph. 1 Sec. 40. Section 331.559, subsection 2, Code 2025, is 2 amended by striking the subsection. 3 Sec. 41. REPEAL. Sections 163.16, 165.6, and 165.8, Code 4 2025, are repealed. 5 Sec. 42. TRANSFER OF MONEYS. There is transferred from the 6 brucellosis and tuberculosis eradication fund created pursuant 7 to section 165.18, Code 2025, to the Iowa animal disease 8 prevention fund created pursuant to section 165.18, as amended 9 by this Act, all unencumbered or unobligated moneys remaining 10 on the effective date of this division of this Act. 11 DIVISION IX 12 PROCEEDS FROM SALES OF REAL PROPERTY —— EXPENDITURES FOR STATE 13 PARKS 14 Sec. 43. Section 461A.32, subsection 1, Code 2025, is 15 amended to read as follows: 16 1. The commission may sell or exchange such parts of public 17 lands or structures under the jurisdiction of the commission as 18 in its judgment may be undesirable for conservation purposes, 19 excepting state-owned meandered lands already surveyed and 20 platted at state expense as a conservation plan and project 21 tentatively adopted and now in the process of rehabilitation 22 and development authorized by a special legislative Act. The 23 sale or exchange shall be made upon the terms, conditions , 24 or considerations as the commission may approve, whereupon 25 the secretary of state shall issue a patent therefor in the 26 manner provided by law in other cases. Moneys generated from 27 any such sale from a state park shall be deposited in the 28 state conservation fund created in section 456A.17 and are 29 appropriated to the department to be used exclusively for 30 structure or infrastructure costs at the specific state park 31 from which the moneys were generated. The proceeds of any 32 other such sale or exchange shall become a part of the funds 33 moneys to be expended under the provisions of this chapter . > 34 2.
