A person shall not, directly or indirectly, 3 discriminate in price offered to different grocery store 4 purchasers of commodities of like grade and quality based on a 5 grocery store purchaser’s participation in the program where 6 the effect of the discrimination in price between a grocery 7 store that participates in the program, and a grocery store 8 that does not participate in the program, may substantially 9 lessen competition between the grocery stores, or tend to 10 create a monopoly among the grocery stores. 11 b.
