NEW SECTION . 29D.1 Information sharing —— 4 school safety. 5 1. For purposes of this section: 6 a. (1) “Covered entity” includes all of the following: 7 (a) A criminal or juvenile justice agency as defined in 8 section 692.1. 9 (b) A city, county, or township. 10 (c) A state agency. 11 (d) Any service or support provider that contracts with an 12 entity described in subparagraph divisions (a) through (c). 13 (2) “Covered entity” does not include the judicial branch. 14 b. “School” means all of the following: 15 (1) A school corporation organized under chapter 274. 16 (2) A nonpublic school as defined in section 280.2. 17 (3) A charter school established pursuant to chapter 256E. 18 (4) A charter school or innovation zone school established 19 pursuant to chapter 256F. 20 (5) Any service or support provider that contracts with an 21 entity described in subparagraphs (1) through (4). 22 c. “State agency” means a department, board, bureau, 23 commission, or other agency or authority of the state of Iowa. 24 2. Notwithstanding any provision of law to the contrary, 25 including section 22.7, any covered entity or school that 26 provides services to students enrolled in kindergarten through 27 grade twelve who are experiencing or at risk of an emotional 28 disturbance or mental illness, or who pose an articulable and 29 significant threat to the health and safety of any person, 30 shall, upon the request of another covered entity or school 31 when the covered entity or school is acting as part of a 32 multidisciplinary school safety assessment team established 33 pursuant to section 280.36, share records or information that 34 are reasonably necessary to ensure access to appropriate 35 -1- HF 163.1656 (1) 91 (amending this HF 163 to CONFORM to SF 583) jda/jh 1/ 5 #1.
services for such students, or to ensure the safety of such 1 students or others, with any other such covered entity or 2 school. 3 3. Notwithstanding any provision of law to the contrary, 4 including section 22.7, a multidisciplinary school safety 5 assessment team established pursuant to section 280.36 may 6 request and receive records or information that are related to 7 students enrolled in kindergarten through grade twelve who are 8 experiencing or at risk of an emotional disturbance or mental 9 illness, or who pose an articulable and significant threat to 10 the health and safety of any person. 11 4. When acting as part of a multidisciplinary school safety 12 assessment team established pursuant to section 280.36, a 13 covered entity and a school may communicate, collaborate, and 14 coordinate efforts with other covered entities to best serve 15 students enrolled in kindergarten through grade twelve who are 16 experiencing or at risk of an emotional disturbance or mental 17 illness, or who pose an articulable and significant threat to 18 the health and safety of any person. 19 Sec. 2. Section 256E.7, subsection 2, Code 2025, is amended 20 by adding the following new paragraphs: 21 NEW PARAGRAPH . 0d. Be subject to and comply with the 22 requirements of section 29D.1 relating to the sharing of 23 records or information, and the communication, collaboration, 24 and coordination of efforts to best serve students, in the same 25 manner as a school district. 26 NEW PARAGRAPH . 0t. Be subject to and comply with the 27 requirements of section 280.36 relating to the establishment of 28 a multidisciplinary school safety assessment team in the same 29 manner as a school district. 30 Sec. 3. Section 256F.4, subsection 2, Code 2025, is amended 31 by adding the following new paragraphs: 32 NEW PARAGRAPH . 0d. and coordination of efforts to best serve students, in the same 1 manner as a school district. 2 NEW PARAGRAPH . r. Be subject to and comply with the 3 requirements of section 280.36 relating to the establishment of 4 a multidisciplinary school safety assessment team in the same 5 manner as a school district. 6 Sec. 4. NEW SECTION . 280.36 Multidisciplinary school safety 7 assessment teams —— immunity. 8 1. The board of directors of each school district and the 9 authorities in charge of each accredited nonpublic school may 10 establish a multidisciplinary school safety assessment team. 11 If established, the multidisciplinary school safety assessment 12 team shall coordinate resources and assess and intervene when a 13 student enrolled in the school district or accredited nonpublic 14 school exhibits behavior that may pose a threat to the safety 15 of the school district or accredited nonpublic school, 16 employees of the school district or accredited nonpublic 17 school, or other student enrolled in the school district or 18 accredited nonpublic school. 19 2. The multidisciplinary school safety assessment team may 20 consist of any of the following members: 21 a. A local law enforcement official. 22 b. A representative from juvenile court services. 23 c. A mental health professional. 24 d. A social services representative. 25 e. A school official. 26 3. The board of directors of a school district or the 27 authorities in charge of an accredited nonpublic school 28 may enter into an agreement with another school district, 29 accredited nonpublic school, charter school, or innovation zone 30 school to create a multidisciplinary school safety assessment 31 team that shall coordinate resources among the schools and 32 assess and intervene when a student enrolled in either school 33 exhibits behavior that may pose a threat to the safety of 34 either school, employees of either school, or students enrolled 35 -3- HF 163.1656 (1) 91 (amending this HF 163 to CONFORM to SF 583) jda/jh 3/ 5
in either school. 1 4. A multidisciplinary school safety assessment team may do 2 any of the following: 3 a. Share or request records or information in accordance 4 with section 29D.1. 5 b. Request records from the state court administrator. 6 5. In addition to any other immunity available, any person 7 who, in good faith with reasonable cause and without malice, 8 acts to report, investigate, or cause any investigation to 9 be made into the activities of a student or other person as 10 such report or investigation relates to conduct or information 11 indicating that the student or person poses a credible danger 12 of serious bodily injury or death to one or more students, 13 school employees, or others on school property shall be immune 14 from all criminal and civil liability that might otherwise 15 be incurred or imposed as the result of the making of such a 16 report, investigation, or disclosure. 17 6. Notwithstanding sections 22.7, 232.147, 232.149, 18 232.149A, and 232.151, a representative from juvenile court 19 services who is a member of a multidisciplinary school safety 20 assessment team may share records or information among the 21 other members of the multidisciplinary school safety assessment 22 team if the records or information are reasonably necessary to 23 ensure the safety of students or others, and if the records or 24 information are not sealed by a court order. 25 7. a. Notwithstanding sections 22.7, 232.147, 232.149, 26 232.149A, and 232.151, upon the request of a multidisciplinary 27 school safety assessment team, the state court administrator 28 shall disclose to the multidisciplinary school safety 29 assessment team a record if the record is reasonably necessary 30 to ensure the safety of students or others, and if the record 31 is not sealed by a court order. 32 b. Paragraph “a” shall not be construed to prohibit a 33 multidisciplinary school safety assessment team from submitting 34 an application to the state court administrator for release of 35 -4- HF 163.1656 (1) 91 (amending this HF 163 to CONFORM to SF 583) jda/jh 4/ 5
