Senate File 397 H-1211 Amend Senate File 397, as follows: 1 1. Page 3, after line 32 by inserting: 2 < Sec. ___. Section 708.3A, Code 2025, is amended by adding 3 the following new subsection: 4 NEW SUBSECTION . 4A. a. A person who is a victim of an 5 assault under subsection 1, 2, 3, or 4 that resulted in the 6 victim coming in contact with the blood, seminal fluid, urine, 7 saliva, or feces of the person committing the assault, when 8 there is reason to believe that the person committing the 9 assault has or may have a communicable disease, may request 10 that law enforcement make application to the court for the 11 issuance of a search warrant, in accordance with chapter 808, 12 for the purpose of requiring the person committing the assault 13 to submit to testing for communicable diseases. 14 b. The medical professional conducting testing of the person 15 committing the assault for communicable diseases shall, upon 16 receipt of the test results, without delay, contact the victim 17 of the assault with the test results. > 18 2.
