Section 708.3A, subsections 1, 2, 3, and 4, Code 4 2025, are amended to read as follows: 5 1. A person who commits an assault, as defined in section 6 708.1 , against a peace officer, jailer, correctional or 7 juvenile detention staff, member or employee of the board 8 of parole, health care provider, employee of the department 9 of health and human services, employee of the department of 10 inspections, appeals, and licensing who conducts investigations 11 or inspections, employee of the department of revenue, national 12 guard member engaged in national guard duty or state active 13 duty, civilian employee of a law enforcement agency, civilian 14 employee of a fire department, or fire fighter, whether paid or 15 volunteer, with the knowledge that the person against whom the 16 assault is committed is a peace officer, jailer, correctional 17 or juvenile detention staff, member or employee of the board 18 of parole, health care provider, employee of the department 19 of health and human services, employee of the department of 20 inspections, appeals, and licensing who conducts investigations 21 or inspections, employee of the department of revenue, national 22 guard member engaged in national guard duty or state active 23 duty, civilian employee of a law enforcement agency, civilian 24 employee of a fire department, or fire fighter and with the 25 intent to inflict a serious injury upon the peace officer, 26 jailer, correctional or juvenile detention staff, member or 27 employee of the board of parole, health care provider, employee 28 of the department of health and human services, employee of the 29 department of inspections, appeals, and licensing who conducts 30 investigations or inspections, employee of the department of 31 revenue, national guard member engaged in national guard duty 32 or state active duty, civilian employee of a law enforcement 33 agency, civilian employee of a fire department, or fire 34 fighter, is guilty of a class “D” “C” felony. 35 -1- HF 177.1293 (1) 91 (amending this HF 177 to CONFORM to SF 397) as/js 1/ 4 #1.
2. A person who commits an assault, as defined in section 1 708.1 , against a peace officer, jailer, correctional or 2 juvenile detention staff, member or employee of the board 3 of parole, health care provider, employee of the department 4 of health and human services, employee of the department of 5 inspections, appeals, and licensing who conducts investigations 6 or inspections, employee of the department of revenue, national 7 guard member engaged in national guard duty or state active 8 duty, civilian employee of a law enforcement agency, civilian 9 employee of a fire department, or fire fighter, whether paid 10 or volunteer, who knows that the person against whom the 11 assault is committed is a peace officer, jailer, correctional 12 or juvenile detention staff, member or employee of the board 13 of parole, health care provider, employee of the department 14 of health and human services, employee of the department of 15 inspections, appeals, and licensing who conducts investigations 16 or inspections, employee of the department of revenue, national 17 guard member engaged in national guard duty or state active 18 duty, civilian employee of a law enforcement agency, civilian 19 employee of a fire department, or fire fighter and who uses or 20 displays a dangerous weapon in connection with the assault, is 21 guilty of a class “D” “C” felony. 22 3. A person who commits an assault, as defined in section 23 708.1 , against a peace officer, jailer, correctional or 24 juvenile detention staff, member or employee of the board 25 of parole, health care provider, employee of the department 26 of health and human services, employee of the department of 27 inspections, appeals, and licensing who conducts investigations 28 or inspections, employee of the department of revenue, national 29 guard member engaged in national guard duty or state active 30 duty, civilian employee of a law enforcement agency, civilian 31 employee of a fire department, or fire fighter, whether paid 32 or volunteer, who knows that the person against whom the 33 assault is committed is a peace officer, jailer, correctional 34 or juvenile detention staff, member or employee of the board 35 -2- HF 177.1293 (1) 91 (amending this HF 177 to CONFORM to SF 397) as/js 2/ 4
of parole, health care provider, employee of the department 1 of health and human services, employee of the department of 2 inspections, appeals, and licensing who conducts investigations 3 or inspections, employee of the department of revenue, national 4 guard member engaged in national guard duty or state active 5 duty, civilian employee of a law enforcement agency, civilian 6 employee of a fire department, or fire fighter, and who causes 7 bodily injury or mental illness, is guilty of an aggravated 8 misdemeanor a class “D” felony . 9 4. Any other assault, as defined in section 708.1 , including 10 an assault causing another to come into contact with saliva 11 by throwing, tossing, spitting, or expelling the fluid, 12 committed against a peace officer, jailer, correctional or 13 juvenile detention staff, member or employee of the board 14 of parole, health care provider, employee of the department 15 of health and human services, employee of the department of 16 inspections, appeals, and licensing who conducts investigations 17 or inspections, employee of the department of revenue, national 18 guard member engaged in national guard duty or state active 19 duty, civilian employee of a law enforcement agency, civilian 20 employee of a fire department, or fire fighter, whether paid 21 or volunteer, by a person who knows that the person against 22 whom the assault is committed is a peace officer, jailer, 23 correctional or juvenile detention staff, member or employee 24 of the board of parole, health care provider, employee of 25 the department of health and human services, employee of the 26 department of inspections, appeals, and licensing who conducts 27 investigations or inspections, employee of the department of 28 revenue, national guard member engaged in national guard duty 29 or state active duty, civilian employee of a law enforcement 30 agency, civilian employee of a fire department, or fire 31 fighter, is a serious an aggravated misdemeanor. A person 32 convicted of violating this subsection shall serve a minimum 33 term of seven days of the sentence imposed by law, and shall 34 not be eligible for suspension of the minimum sentence. 35 -3- HF 177.1293 (1) 91 (amending this HF 177 to CONFORM to SF 397) as/js 3/ 4
Sec. 2. Section 708.3B, Code 2025, is amended to read as 1 follows: 2 708.3B Inmate assaults —— bodily fluids or secretions. 3 A person who, while confined in a jail or in an institution 4 or facility under the control of the department of corrections, 5 commits any of the following acts commits a class “D” felony: 6 1. An assault, as defined under section 708.1 , upon an 7 employee of the jail or institution or facility under the 8 control of the department of corrections , which that results 9 in the employee’s contact with blood, seminal fluid, urine, 10 saliva, or feces. 11 2. An act which that is intended to cause pain or injury 12 or be insulting or offensive and which that results in blood, 13 seminal fluid, urine, saliva, or feces being cast or expelled 14 upon an employee of the jail or institution or facility under 15 the control of the department of corrections. > 16 ______________________________ WILLS of Dickinson -4- HF 177.1293 (1) 91 (amending this HF 177 to CONFORM to SF 397) as/js 4/ 4
