House File 969 H-1202 Amend the amendment, H-1191, to House File 969, as follows: 1 1. By striking page 1, line 2, through page 3, line 18, and 2 inserting: 3 < 1. Page 1, after line 6 by inserting: 4 < Sec. ___. Section 97B.11, subsection 3, paragraphs b and c, 5 Code 2025, are amended to read as follows: 6 b. For members in special service in a protection occupation 7 as described in section 97B.49B : 8 (1) “Applicable employee percentage” means the percentage 9 rate equal to forty percent of the required contribution rate 10 for members described in section 97B.49B . For the fiscal year 11 beginning July 1, 2025, and for each fiscal year thereafter, 12 the system shall increase the applicable employee percentage 13 calculated under this subparagraph for that fiscal year by one 14 hundred twenty-five thousandths of one percent. 15 (2) “Applicable employer percentage” means the percentage 16 rate equal to sixty percent of the required contribution rate 17 for members described in section 97B.49B . For the fiscal year 18 beginning July 1, 2025, and for each fiscal year thereafter, 19 the system shall decrease the applicable employer percentage 20 calculated under this subparagraph for that fiscal year by one 21 hundred twenty-five thousandths of one percent. 22 c. For members in special service as a county sheriff or 23 deputy sheriff as described in section 97B.49C : 24 (1) “Applicable employee percentage” means the percentage 25 rate equal to fifty percent of the required contribution rate 26 for members described in section 97B.49C . For the fiscal year 27 beginning July 1, 2025, and for each fiscal year thereafter, 28 the system shall increase the applicable employee percentage 29 calculated under this subparagraph for that fiscal year by one 30 hundred twenty-five thousandths of one percent. 31 (2) “Applicable employer percentage” means the percentage 32 rate equal to fifty percent of the required contribution rate 33 for members described in section 97B.49C . Section 411.8, subsection 1, paragraph f, 5 subparagraph (8), Code 2025, is amended to read as follows: 6 (8) Beginning July 1, 1996, and each fiscal year thereafter, 7 an amount equal to the member’s contribution rate times each 8 member’s compensation shall be paid to the fund from the 9 earnable compensation of the member. For the purposes of this 10 subparagraph, the member’s contribution rate shall be nine and 11 thirty-five hundredths percent until June 30, 2009, nine and 12 four-tenths percent until June 30, 2024, and, beginning July 13 1, 2024, nine and fifty-five hundredths percent until June 14 30, 2025, and, beginning July 1, 2025, nine and six hundred 15 seventy-five thousandths percent . However, the system shall 16 increase the member’s contribution rate as necessary to cover 17 any increase in cost to the system resulting from statutory 18 changes which are enacted by any session of the general 19 assembly meeting after January 1, 1991, if the increase cannot 20 be absorbed within the contribution rates otherwise established 21 pursuant to this paragraph, but subject to a maximum employee 22 contribution rate of eleven and three-tenths percent or, 23 beginning July 1, until June 30, 2009, eleven and thirty-five 24 hundredths percent until June 30, 2025, and, beginning July 25 1, 2025, eleven and four hundred seventy-five thousandths 26 percent . The contribution rate increases specified in 1994 27 Iowa Acts, ch. 1183 , pursuant to this chapter and chapter 28 97A shall be the only member contribution rate increases for 29 these systems resulting from the statutory changes enacted in 30 1994 Iowa Acts, ch. 1183 , and shall apply only to the fiscal 31 periods specified in 1994 Iowa Acts, ch. 1183 . After the 32 employee contribution reaches eleven and three-tenths percent 33 or eleven and thirty-five hundredths percent, as applicable, 34 the applicable maximum employee contribution rate, sixty 35 -2- H 1191.1284 (1) 91 sc/ns 2/ 3
percent of the additional cost of such statutory changes shall 1 be paid by employers under paragraph “c” and forty percent 2 of the additional cost shall be paid by employees under this 3 paragraph. > 4 ___. The Iowa public employees’ 6 retirement system may adopt emergency rules under section 7 17A.4, subsection 3, and section 17A.5, subsection 2, paragraph 8 “b”, to implement section 97B.11, subsection 3, paragraphs 9 “b” and “c”, as amended by this Act, and the rules shall be 10 effective immediately upon filing unless a later date is 11 specified in the rules. Any rules adopted in accordance with 12 this section shall also be published as a notice of intended 13 action as provided in section 17A.4. 14 Sec. ___. EFFECTIVE DATE.
