Section 97B.11, subsection 3, paragraphs b and c, 3 Code 2025, are amended to read as follows: 4 b. For members in special service in a protection occupation 5 as described in section 97B.49B : 6 (1) “Applicable employee percentage” means the percentage 7 rate equal to forty percent of the required contribution rate 8 for members described in section 97B.49B . For the fiscal year 9 beginning July 1, 2025, and for each fiscal year thereafter, 10 the system shall increase the applicable employee percentage 11 calculated under this subparagraph for that fiscal year by one 12 eighth of one percent. 13 (2) “Applicable employer percentage” means the percentage 14 rate equal to sixty percent of the required contribution rate 15 for members described in section 97B.49B . For the fiscal year 16 beginning July 1, 2025, and for each fiscal year thereafter, 17 the system shall decrease the applicable employer percentage 18 calculated under this subparagraph for that fiscal year by one 19 eighth of one percent. 20 c. For members in special service as a county sheriff or 21 deputy sheriff as described in section 97B.49C : 22 (1) “Applicable employee percentage” means the percentage 23 rate equal to fifty percent of the required contribution rate 24 for members described in section 97B.49C . For the fiscal year 25 beginning July 1, 2025, and for each fiscal year thereafter, 26 the system shall increase the applicable employee percentage 27 calculated under this subparagraph for that fiscal year by one 28 eighth of one percent. 29 (2) “Applicable employer percentage” means the percentage 30 rate equal to fifty percent of the required contribution rate 31 for members described in section 97B.49C . Section 411.8, subsection 1, paragraph f, 3 subparagraph (8), Code 2025, is amended to read as follows: 4 (8) Beginning July 1, 1996, and each fiscal year thereafter, 5 an amount equal to the member’s contribution rate times each 6 member’s compensation shall be paid to the fund from the 7 earnable compensation of the member. For the purposes of this 8 subparagraph, the member’s contribution rate shall be nine and 9 thirty-five hundredths percent until June 30, 2009, nine and 10 four-tenths percent until June 30, 2024, and, beginning July 11 1, 2024, nine and fifty-five hundredths percent until June 12 30, 2025, and, beginning July 1, 2025, nine and six hundred 13 seventy-five thousandths percent . However, the system shall 14 increase the member’s contribution rate as necessary to cover 15 any increase in cost to the system resulting from statutory 16 changes which are enacted by any session of the general 17 assembly meeting after January 1, 1991, if the increase cannot 18 be absorbed within the contribution rates otherwise established 19 pursuant to this paragraph, but subject to a maximum employee 20 contribution rate of eleven and three-tenths percent or, 21 beginning July 1, 2009, eleven and thirty-five hundredths 22 percent. The contribution rate increases specified in 1994 23 Iowa Acts, ch. 1183 , pursuant to this chapter and chapter 24 97A shall be the only member contribution rate increases for 25 these systems resulting from the statutory changes enacted in 26 1994 Iowa Acts, ch. 1183 , and shall apply only to the fiscal 27 periods specified in 1994 Iowa Acts, ch. 1183 . After the 28 employee contribution reaches eleven and three-tenths percent 29 or eleven and thirty-five hundredths percent, as applicable, 30 sixty percent of the additional cost of such statutory changes 31 shall be paid by employers under paragraph “c” and forty percent 32 of the additional cost shall be paid by employees under this 33 paragraph. > 34 3. < Sec. ___. EMERGENCY RULES. The Iowa public employees’ 1 retirement system may adopt emergency rules under section 2 17A.4, subsection 3, and section 17A.5, subsection 2, paragraph 3 “b”, to implement section 97B.11, subsection 3, paragraphs 4 “b” and “c”, as amended by this Act, and the rules shall be 5 effective immediately upon filing unless a later date is 6 specified in the rules. Any rules adopted in accordance with 7 this section shall also be published as a notice of intended 8 action as provided in section 17A.4. 9 Sec. ___. EFFECTIVE DATE.
