DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 3 —— CHOOSE IOWA FOOD PURCHASING PILOT PROJECT FOR SCHOOLS AND 4 SCHOOL DISTRICTS OR FOOD BANKS AND IOWA EMERGENCY FEEDING 5 ORGANIZATIONS. 6 1. There is appropriated from the general fund of the state 7 to the department of agriculture and land stewardship for the 8 fiscal year beginning July 1, 2025, and ending June 30, 2026, 9 the following amount, or so much thereof as is necessary, to be 10 used for the purposes designated: 11 For purposes of supporting a choose Iowa food purchasing 12 pilot project to assist eligible participants in purchasing 13 qualified food products: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 15 2. Except as provided in subsection 3, the department 16 shall administer the pilot project based on the farm-to-school 17 program described in chapter 190A, in which the department 18 reimburses a school or school district for the purchase of a 19 food product originating from a farm source. 20 3. The department shall administer the pilot project 21 according to all of the following: 22 a. A farm or business that owns or operates the farm 23 source shall be given a preference to participate in the pilot 24 project if the farm or business is currently participating in 25 the choose Iowa promotional program as provided in chapter 26 159, subchapter II, part 2, Code 2024. Otherwise, a farm 27 or business may participate in the pilot project if the farm 28 or business has applied to participate in the choose Iowa 29 promotional program and the department determines that the 30 application will be approved. 31 b. An eligible participant is limited to any of the 32 following: 33 (1) A public or private school or a school district, if the 34 public or private school or school district is not currently 35 -1- HF 851.1022 (3) 91 jda/jh 1/ 2 #1.
participating in the farm-to-school program. 1 (2) An Iowa food bank or an Iowa emergency feeding 2 organization, recognized by the department. 3 c. A qualified food product is limited to the following: 4 (1) For a school or school district, meat and poultry, dairy 5 products other than milk, eggs, honey, and produce. 6 (2) For an Iowa food bank or Iowa emergency feeding 7 organization, meat and poultry, dairy products, eggs, honey, 8 and produce. 9 d. The department is not required to follow a requirement in 10 chapter 190A that the department determines is not practical 11 for the pilot project. 12 4. An eligible participant shall be reimbursed on a matching 13 basis with the department contributing $1 for every $1 expended 14 by the eligible participant. 15 5. The department may use not more than 5 percent of the 16 moneys appropriated in subsection 1 to pay for the costs of 17 administering the pilot project. 18 6. Notwithstanding section 8.33, moneys appropriated in 19 subsection 1 for the fiscal year beginning July 1, 2025, 20 that remain unencumbered or unobligated at the close of the 21 fiscal year shall not revert but shall remain available for 22 expenditure for the purposes designated in subsection 1 until 23 the close of the fiscal year beginning July 1, 2027. 24 7. The department shall prepare and submit a report 25 regarding its findings and recommendations to the governor and 26 general assembly not later than January 15, 2026. > 27 2.
