CCH-2200 REPORT OF THE CONFERENCE COMMITTEE 1 ON HOUSE FILE 2200 2 To the Speaker of the House of Representatives and the 3 President of the Senate: 4 We, the undersigned members of the conference committee 5 appointed to resolve the differences between the House of 6 Representatives and the Senate on House File 2200, a bill for 7 an Act relating to prohibited activities in the administration 8 of alcoholic beverage control by the department of revenue, 9 and including effective date provisions, respectfully make the 10 following report: 11 1. That the Senate recedes from its amendment, H-8285. 12 2. That House File 2200, as passed by the House, is amended 13 to read as follows: 14 1. Page 1, before line 1 by inserting: 15 < Section 1. Section 123.3, Code 2026, is amended by adding 16 the following new subsection: 17 NEW SUBSECTION . 5A. “Authorized noninstitutional investor” 18 means a person who has an ownership interest in a business that 19 manufactures, imports, bottles, sells at wholesale, or sells 20 at retail alcoholic beverages, if the person meets all of the 21 following criteria: 22 -1- HF 2200.4157 (6) 91 jm/ns 1/ 3

The ownership interest of the person does not exceed five 1 percent of the entire ownership interest of the business that 2 manufactures, imports, bottles, sells at wholesale, or sells 3 at retail alcoholic beverages. 4 b. The person is not engaged as a director, officer, 5 employee, broker, or agent of the business that manufactures, 6 imports, bottles, sells at wholesale, or sells at retail 7 alcoholic beverages. > 8 2. Notwithstanding any other provision of law to the 12 contrary, an authorized noninstitutional investor of a business 13 engaged in the manufacturing, importing, bottling, selling at 14 wholesale, or selling at retail of alcoholic beverages may 15 directly or indirectly have an ownership interest in another 16 licensee or permittee authorized under this chapter to sell 17 at retail alcoholic beverages, if the person remains only 18 an authorized noninstitutional investor of the licensee or 19 permittee authorized under this chapter to sell at retail 20 alcoholic beverages. 21 2. Any authorized noninstitutional investor of a business 22 engaged in the manufacturing, importing, bottling, or selling 23 at wholesale of alcoholic beverages that is also an authorized 24 noninstitutional investor of another business holding a retail 25 alcohol license issued under this chapter shall annually 26 disclose the ownership interest to the department in a manner 27 prescribed by the director. Notwithstanding chapter 22, 28 the disclosure made under this subsection shall be kept 29 confidential by the department. > 30 3.
