To either subparagraph (1) or (2): 15 (1) That the vapor products manufacturer has received a 16 marketing authorization or similar order for the vapor product 17 from the United States food and drug administration pursuant 18 to 21 U.S.C. §387j. 19 (2) That the vapor products manufacturer holds a valid 20 permit under this chapter and will comply with all applicable 21 requirements of 15 U.S.C. §375 and 376. 22 b. If the vapor products manufacturer is a nonresident 23 vapor products manufacturer, that the nonresident vapor 24 products manufacturer has provided a safety data sheet to the 25 director in a form that meets the requirements of 29 C.F.R. 26 §1910.1200(g). > 27 ___.
