APPROPRIATION REALLOCATION 2 Notwithstanding section 8.39 , the department of inspections, 3 appeals, and licensing, in consultation with the department of 4 management, may reallocate moneys appropriated in this section 5 as necessary to best fulfill the needs of the department 6 provided for in the appropriation. However, the department of 7 inspections, appeals, and licensing shall not reallocate moneys 8 appropriated for labor services or the division of workers’ 9 compensation. 10 Sec. 8. DEPARTMENT OF INSPECTIONS, APPEALS, AND LICENSING 11 —— LICENSE OR REGISTRATION FEES. 12 1. For the fiscal year beginning July 1, 2024, and ending 13 June 30, 2025, the department of inspections, appeals, and 14 licensing shall collect any license or registration fees or 15 electronic transaction fees generated during the fiscal year 16 as a result of licensing and registration activities under 17 chapters 99B , 137C , 137D , and 137F . 18 2. From the fees collected by the department under this 19 section on behalf of a municipal corporation with which 20 the department has an agreement pursuant to section 137F.3 , 21 through a statewide electronic licensing system operated by 22 the department, notwithstanding section 137F.6, subsection 2 , 23 the department shall remit the amount of those fees to the 24 municipal corporation for whom the fees were collected less 25 any electronic transaction fees collected by the department to 26 enable electronic payment. 27 3. From the fees collected by the department under this 28 section, other than those fees described in subsection 2, 29 the department shall deposit the amount of $800,000 into the 30 general fund of the state prior to June 30, 2025. 31 4. From the fees collected by the department under this 32 section, other than those fees described in subsections 2 and 33 3, the department shall retain the remainder of the fees for 34 the purposes of enforcing the provisions of chapters 99B , 137C , 35 -9- SF 2433.4380 (3) 90 sc/ns 9/ 19
137D , and 137F . Notwithstanding section 8.33 , moneys retained 1 by the department pursuant to this subsection that remain 2 unencumbered or unobligated at the close of the fiscal year 3 shall not revert but shall remain available for expenditure 4 for the purposes of enforcing the provisions of chapters 99B , 5 137C , 137D , and 137F during the succeeding fiscal year. The insurance division shall use 1.00 full-time 8 equivalent position authorized in this subsection for an 9 employee whose sole responsibility is investigating complaints 10 and notifications related to financial exploitation of eligible 11 adults. 12 d. Except as provided in paragraphs “b” and “c”, the 13 insurance division may reallocate authorized full-time 14 equivalent positions as necessary to respond to accreditation 15 recommendations or requirements. 16 e. The insurance division expenditures for examination 17 purposes may exceed the projected receipts, refunds, and 18 reimbursements, estimated pursuant to section 505.7, subsection 19 7, including the expenditures for retention of additional 20 personnel, if the expenditures are fully reimbursable and the 21 division first does all of the following: 22 (1) Notifies the department of management, the legislative 23 services agency, and the legislative fiscal committee of the 24 need for the expenditures. 25 (2) Files with each of the entities named in subparagraph 26 (1) the legislative and regulatory justification for the 27 expenditures, along with an estimate of the expenditures. 28 Sec. 13.
