The moneys appropriated in this subsection shall be 4 used for the public purpose of providing a grant to a national 5 nonprofit organization with over 80 years of experience in 6 assisting children and adults with disabilities and special 7 needs. The moneys shall be used to support a nationally 8 recognized program that began in 1986 and has been replicated 9 in at least 30 other states, but is not available through 10 any other entity in this state, and that provides assistance 11 to farmers with disabilities in all 99 counties to allow the 12 farmers to remain in their own homes and be gainfully engaged 13 in farming through provision of agricultural worksite and home 14 modification consultations, peer support services, services 15 to families, information and referral, and equipment loan 16 services. 17 c. Notwithstanding section 8.33 , moneys appropriated in 18 this subsection that remain unencumbered or unobligated at the 19 close of the fiscal year shall not revert but shall remain 20 available for expenditure for the purposes designated until the 21 close of the succeeding fiscal year. 22 6. LOESS HILLS DEVELOPMENT AND CONSERVATION FUND 23 a. For deposit in the loess hills development and 24 conservation fund created pursuant to section 161D.2 : 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 400,000 26 b. CHOOSE IOWA FOOD PURCHASING PILOT PROJECT FOR 16 SCHOOLS AND SCHOOL DISTRICTS OR FOOD BANKS AND IOWA EMERGENCY 17 FEEDING ORGANIZATIONS. 18 1. There is appropriated from the general fund of the state 19 to the department of agriculture and land stewardship for the 20 fiscal year beginning July 1, 2024, and ending June 30, 2025, 21 the following amount, or so much thereof as is necessary, to be 22 used for the purposes designated: 23 For purposes of supporting a choose Iowa food purchasing 24 pilot project to assist eligible participants in purchasing 25 qualified food products: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 27 2. Except as provided in subsection 3, the department 28 shall administer the pilot project based on the farm-to-school 29 program described in chapter 190A, in which the department 30 reimburses a school or school district for the purchase of a 31 food product originating from a farm source. 32 3. The department shall administer the pilot project 33 according to all of the following: 34 a. A farm or business that owns or operates the farm 35 -5- SF 2421.4352 (3) 90 da/ns 5/ 30
source shall be given a preference to participate in the pilot 1 project if the farm or business is currently participating in 2 the choose Iowa promotional program as provided in chapter 3 159, subchapter II, part 2, Code 2024. Otherwise, a farm 4 or business may participate in the pilot project if the farm 5 or business has applied to participate in the choose Iowa 6 promotional program and the department determines that the 7 application will be approved. 8 b. An eligible participant is limited to any of the 9 following: 10 (1) A public or private school or a school district, if the 11 public or private school or school district is not currently 12 participating in the farm-to-school program. 13 (2) An Iowa food bank or an Iowa emergency feeding 14 organization, recognized by the department. 15 c. A qualified food product is limited to the following: 16 (1) For a school or school district, meat and poultry, dairy 17 products other than milk, eggs, honey, and produce. 18 (2) For an Iowa food bank or Iowa emergency feeding 19 organization, meat and poultry, dairy products, eggs, honey, 20 and produce. 21 d. The department is not required to follow a requirement in 22 chapter 190A that the department determines is not practical 23 for the pilot project. 24 4. a. Of the moneys appropriated in subsection 1, not more 25 than $100,000 shall be used to reimburse schools or school 26 districts and not more than $150,000 shall be used to reimburse 27 Iowa food banks and Iowa emergency feeding organizations. 28 b. An eligible participant shall be reimbursed on a matching 29 basis with the department contributing $1 for every $1 expended 30 by the eligible participant. 31 c. (1) A school or school district shall not receive more 32 than $1,000 for participating in the pilot project. 33 (2) An Iowa food bank or Iowa emergency feeding organization 34 shall not receive more than $25,000 for participating in the 35 -6- SF 2421.4352 (3) 90 da/ns 6/ 30
pilot project. 1 5. The department may use not more than 5 percent of the 2 moneys appropriated in subsection 1 to pay for the costs of 3 administering the pilot project. 4 6. Notwithstanding section 8.33, moneys appropriated in 5 subsection 1 for the fiscal year beginning July 1, 2024, 6 that remain unencumbered or unobligated at the close of the 7 fiscal year shall not revert but shall remain available for 8 expenditure for the purposes designated in subsection 1 until 9 the close of the fiscal year beginning July 1, 2026. 10 7. The department shall prepare and submit a report 11 regarding its findings and recommendations to the governor and 12 general assembly not later than January 15, 2025. 13 DIVISION II 14 DEPARTMENT OF NATURAL RESOURCES 15 Sec. 6. GENERAL FUND —— DEPARTMENT. 16 1. There is appropriated from the general fund of the state 17 to the department of natural resources for the fiscal year 18 beginning July 1, 2024, and ending June 30, 2025, the following 19 amount, or so much thereof as is necessary, to be used for the 20 purposes designated: 21 For purposes of supporting the department, including its 22 divisions, for administration, regulation, and programs; for 23 salaries, support, maintenance, and miscellaneous purposes; and 24 for not more than the following full-time equivalent positions: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,500,000 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Of the number of full-time equivalent positions 28 authorized to the department pursuant to subsection 1, 50.00 29 full-time equivalent positions shall be allocated by the 30 department for seasonal employees for purposes of providing 31 maintenance, upkeep, and sanitary services at state parks. 32 This subsection shall not impact conservation officer, park 33 ranger, or park manager positions within the department. 34 3. The department shall submit a report each quarter of 35 -7- SF 2421.4352 (3) 90 da/ns 7/ 30
the fiscal year to the general assembly and the department 1 of management. The report shall describe in detail the 2 expenditure of moneys appropriated under this section to 3 support the department’s administration, regulation, and 4 programs. 5 Sec. 7. STATE FISH AND GAME PROTECTION FUND —— REGULATION 6 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 7 1. There is appropriated from the state fish and game 8 protection fund created pursuant to section 456A.17 to the 9 department of natural resources for the fiscal year beginning 10 July 1, 2024, and ending June 30, 2025, the following amount, 11 or so much thereof as is necessary, to be used for the purposes 12 designated: 13 For purposes of supporting the regulation or advancement of 14 hunting, fishing, or trapping, or the protection, propagation, 15 restoration, management, or harvest of fish or wildlife, 16 including for administration, regulation, law enforcement, and 17 programs; and for salaries, support, maintenance, equipment, 18 and miscellaneous purposes: 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 49,752,093 20 2. Notwithstanding section 455A.10 , the department may use 21 the unappropriated balance remaining in the state fish and game 22 protection fund to provide for the funding of health and life 23 insurance premium payments from unused sick leave balances of 24 conservation peace officers employed in a protection occupation 25 who retire, pursuant to section 97B.49B . 26 3. Notwithstanding section 455A.10 , the department may 27 use the unappropriated balance remaining in the state fish 28 and game protection fund for the fiscal year beginning July 29 1, 2024, and ending June 30, 2025, as is necessary to fund 30 salary adjustments for departmental employees for which the 31 general assembly has made an operating budget appropriation in 32 subsection 1. 33 Sec. 8. GROUNDWATER PROTECTION FUND —— WATER QUALITY. There 34 is appropriated from the groundwater protection fund created 35 -8- SF 2421.4352 (3) 90 da/ns 8/ 30

Paragraph “a” does not apply to a reduction made 15 to support the college of veterinary medicine if the same 16 percentage of reduction imposed on the college of veterinary 17 medicine is also imposed on all of Iowa state university of 18 science and technology’s budget units. 19 3. If by June 30, 2025, Iowa state university of science and 20 technology fails to allocate the moneys appropriated in this 21 section to the college of veterinary medicine in accordance 22 with this section, the moneys appropriated in this section for 23 that fiscal year shall revert to the general fund of the state. 24 Sec. 13. MANAGEMENT OF PRIVATE FORESTS. 25 1. There is appropriated from the general fund of the state 1 to the state university of Iowa for the fiscal year beginning 2 July 1, 2024, and ending June 30, 2025, the following amount, 3 or so much thereof as is necessary, to be used for the purposes 4 designated: 5 For supporting the operations of Iowa’s center for 6 agricultural safety and health, as part of the university’s 7 college of public health, and in cooperation with the 8 department of agriculture and land stewardship, to anticipate, 9 recognize, and prevent occupational illness and injury among 10 members of the agricultural community: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 128,154 12 2. a. As a condition of the appropriation made in 13 subsection 1, the state university of Iowa shall retain the 14 director of Iowa’s center for agricultural safety and health 15 employed on the effective date of this division of this Act for 16 at least the same number of hours for the fiscal year beginning 17 July 1, 2024, as worked by the director during the fiscal year 18 beginning July 1, 2023. 19 b. As a condition of the appropriation made in subsection 20 1, the state university of Iowa shall not reduce the amount 21 allocated to support Iowa’s center for agricultural safety and 22 health from any other source due to the appropriation made in 23 subsection 1. 24 3. If by June 30, 2025, the state university of Iowa fails 25 to use the moneys appropriated in subsection 1 in accordance 26 with the purposes and conditions of subsections 1 and 2, any 27 unencumbered or unobligated moneys appropriated in subsection 28 1 for the fiscal year beginning July 1, 2024, and ending June 29 30, 2025, shall revert to the general fund of the state. In 30 addition, if moneys revert as required pursuant to section 31 8.33 , the state university of Iowa shall transfer to the 32 general fund of the state from any otherwise unencumbered or 33 unobligated moneys from any other general fund appropriation or 34 from any moneys available from other funding sources an amount 35 -13- SF 2421.4352 (3) 90 da/ns 13/ 30
equal to the amount appropriated in subsection 1 less any 1 amount that reverted to the general fund of the state pursuant 2 to section 8.33 . 3 DIVISION V 4 ENVIRONMENT FIRST FUND 5 GENERAL APPROPRIATIONS 6 Sec. 17. Subsection 1 does not apply to moneys transferred 1 pursuant to this division of this Act to the loess hills 2 development and conservation fund created in section 161D.2 , 3 which shall not revert as provided in that section. 4 DIVISION VI 5 ENVIRONMENT FIRST FUND 6 SPECIAL APPROPRIATIONS 7 Sec. 21. WATER QUALITY INITIATIVE —— DEPARTMENT OF 8 AGRICULTURE AND LAND STEWARDSHIP. 9 1. There is appropriated from the environment first fund 10 created in section 8.57A to the department of agriculture 11 and land stewardship for the fiscal year beginning July 1, 12 2024, and ending June 30, 2025, the following amount, or so 13 much thereof as is necessary, to be used for the purposes 14 designated: 15 For deposit in the water quality initiative fund created in 16 section 466B.45 , for purposes of supporting the water quality 17 initiative administered by the division of soil conservation 18 and water quality as provided in section 466B.42 , including 19 salaries, support, maintenance, and miscellaneous purposes: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,375,000 21 2. a. The moneys appropriated in subsection 1 shall be 22 used to support projects in subwatersheds as designated by the 23 division that are part of high-priority watersheds identified 24 by the water resources coordinating council established 25 pursuant to section 466B.3 . 26 b. The moneys appropriated in subsection 1 shall be used to 27 support projects in watersheds generally, including regional 28 watersheds, as designated by the division and high-priority 29 watersheds identified by the water resources coordinating 30 council established pursuant to section 466B.3 . 31 3. In supporting projects in subwatersheds and watersheds 32 as provided in subsection 2, all of the following apply: 33 a. The demonstration projects shall utilize water quality 34 practices as described in the Iowa nutrient reduction strategy 35 -19- SF 2421.4352 (3) 90 da/ns 19/ 30
as defined in section 455B.171 . 1 b. The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, 10 except for edge-of-field practices, the state’s share of the 11 amount shall not exceed 50 percent of the estimated cost of 12 establishing the practice as determined by the division or 13 50 percent of the actual cost of establishing the practice, 14 whichever is less. 15 d. The demonstration projects shall be used to educate other 16 persons about the feasibility and value of establishing similar 17 water quality practices. The division shall promote field day 18 events for purposes of allowing interested persons to establish 19 water quality practices on their agricultural land. 20 e. The division shall conduct water quality evaluations 21 within supported subwatersheds. Within a reasonable period 22 after accumulating information from such evaluations, the 23 division shall create an aggregated database of water quality 24 practices. Any information identifying a person holding a 25 legal interest in agricultural land or specific agricultural 26 land shall be a confidential record under section 22.7 . 27 4. The moneys appropriated in subsection 1 shall be used 28 to support education and outreach in a manner that encourages 29 persons who hold a legal interest in agricultural land used for 30 farming to implement water quality practices, including the 31 establishment of such practices in watersheds generally, and 32 not limited to subwatersheds or high-priority watersheds. 33 5. The moneys appropriated in subsection 1 may be used 34 to contract with persons to coordinate the implementation of 35 -20- SF 2421.4352 (3) 90 da/ns 20/ 30
efforts provided in this section. 1 6. The moneys appropriated in subsection 1 may be used by 2 the department to support urban soil and water conservation 3 efforts, which may include but are not limited to management 4 practices related to bioretention, landscaping, the use of 5 permeable or pervious pavement, and soil quality restoration. 6 The moneys shall be allocated on a cost-share basis as provided 7 in chapter 161A . 8 7. Notwithstanding any other provision of law to the 9 contrary, the department may use moneys appropriated in 10 subsection 1 to carry out the provisions of this section on a 11 cost-share basis in combination with other moneys available to 12 the department from a state or federal source. 13 8. Not more than 10 percent of the moneys appropriated in 14 this section may be used to pay for the costs of administering 15 and implementing the water quality initiative by the 16 department’s division of soil conservation and water quality as 17 provided in section 466B.42 and this section. 18 DIVISION VII 19 IOWA RESOURCES ENHANCEMENT AND PROTECTION —— OPEN SPACES 20 Sec. 22. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. In 21 lieu of the standing appropriation in section 455A.18 , there is 22 appropriated from the environment first fund created in section 23 8.57A to the Iowa resources enhancement and protection fund 24 for the fiscal year beginning July 1, 2024, and ending June 25 30, 2025, the following amount, to be allocated as provided in 26 section 455A.19 : 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 28 Sec. 23. This part of this 19 division of this Act takes effect July 1, 2024, only if 2024 20 Iowa Acts, House File 2641, is not enacted. 21 PART B 22 MARKETING PROGRAMS —— APPROPRIATION PROVISIONS CONDITIONED ON 23 ENACTMENT OF CERTAIN LEGISLATION 24 Sec. 26. CHOOSE IOWA FUND. 25 1. agricultural grant program created in section 187.321. 1 (2) Of the amount appropriated in subsection 1, the 2 department shall use $600,000 to support the choose Iowa 3 promotional program as provided in chapter 187, subchapter III, 4 part 1. 5 (3) Of the amount appropriated in subsection 1, the 6 department shall use $750,000 to support the dairy innovation 7 and revitalization program created in section 187.311. 8 b. The department may increase or decrease the amount of 9 moneys used to support a program described in paragraph “a” 10 based on the amount of moneys awarded to persons participating 11 in the program. The department shall publish a notice of the 12 department’s action to increase or decrease the amount on the 13 department’s internet site where the programs are advertised at 14 least thirty days prior to the day that the department takes 15 such action. 16 Sec. 27. CONTINGENT EFFECTIVE DATE. This part of this 17 division of this Act takes effect July 1, 2024, only if 2024 18 Iowa Acts, House File 2641, is enacted. 19 DIVISION IX 20 BUTCHERY INNOVATION AND REVITALIZATION FUND AND PROGRAM 21 Sec. 28. APPROPRIATION TO SUPPORT THE PROGRAM. 22 1. Notwithstanding sections 161A.80A and 161A.80B, there 15 is appropriated from the blufflands protection revolving fund 16 created in section 161A.80A to the state university of Iowa for 17 the fiscal year beginning July 1, 2024, and ending June 30, 18 2025, the following amount, or so much thereof as is necessary, 19 to be used for the purposes designated: 20 For purposes of supporting a groundwater planning and 21 resource assessment project to be administered by the Iowa 22 geological survey of the state as created pursuant to section 23 456.1: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 250,000 25 2. The moneys appropriated in subsection 1 shall be used 26 by the Iowa geological survey to map and assess the condition 27 of this state’s aquifers. The Iowa geological survey may 28 measure the volume of groundwater that is available for various 29 uses, the current and predicted allocations of groundwater to 30 support those uses, the recharge rate for the aquifers, and 31 the development of models for budgeting this state’s water 32 resources. 33 3. Notwithstanding section 8.33, moneys transferred in 34 subsection 1 shall not revert to any fund but shall remain 35 -25- SF 2421.4352 (3) 90 da/ns 25/ 30
available for the purposes designated in subsection 1. 1 Sec. 30. APPROPRIATION TO SUPPORT CHOOSE IOWA FOOD 2 PURCHASING PILOT PROJECT. 3 1. Notwithstanding sections 161A.80A and 161A.80B, there 4 is appropriated from the blufflands protection revolving fund 5 created in section 161A.80A to the department of agriculture 6 and land stewardship for the fiscal year beginning July 1, 7 2024, and ending June 30, 2025, the following amount, or so 8 much thereof as is necessary, to be used for the purposes 9 designated: 10 For purposes of supporting the choose Iowa food purchasing 11 pilot project for schools and school districts or food banks 12 and Iowa emergency feeding organizations as provided in this 13 Act: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 15 2. Notwithstanding section 8.33, moneys appropriated in 16 subsection 1 shall not revert to any fund but shall remain 17 available for the purposes designated in subsection 1. 18 Sec. 31. TRANSFER OF MONEYS TO SUPPORT STATE PARK AND 19 RECREATION AREAS ACCESSIBILITY. 20 1. Notwithstanding sections 161A.80A and 161A.80B, after 21 moneys have been appropriated to support purposes described 22 in this part of this division of this Act, any unobligated or 23 unencumbered moneys remaining in the blufflands protection 24 revolving fund created in section 161A.80A shall be transferred 25 to the general fund of the state and appropriated to the 26 department of natural resources for purposes of increasing 27 accessibility for persons with disabilities when visiting state 28 parks and recreation areas. 29 2. Notwithstanding section 8.33, moneys appropriated in 30 subsection 1 shall not revert to any fund but shall remain 31 available for the purposes designated in subsection 1. 32 3. After moneys have been appropriated to support purposes 33 described in this part of this division of this Act, the 34 blufflands protection program created in section 161A.80A is 35 -26- SF 2421.4352 (3) 90 da/ns 26/ 30
suspended and moneys shall not be expended from the blufflands 1 protection revolving fund other than to wind down existing 2 obligations and comply with section 161A.80B. 3 PART B 4 CODIFIED PROVISIONS 5 Sec. 32. Section 161A.80A, subsection 2, Code 2024, is 6 amended to read as follows: 7 2. A blufflands protection revolving fund is created in 8 the state treasury. All proceeds shall be divided into two 9 equal accounts. One account shall be used for the purchase 10 of blufflands along the Mississippi river and its tributaries 11 and the other account shall be used for the purchase of 12 blufflands along the Missouri river and its tributaries. The 13 proceeds of the revolving fund are appropriated to make loans 14 to conservation organizations which that agree to purchase 15 bluffland properties adjacent to state public lands. The 16 department of agriculture and land stewardship, in conjunction 17 with the department of natural resources, shall adopt rules 18 pursuant to chapter 17A to administer the disbursement of 19 funds. Notwithstanding section 12C.7 , interest or earnings on 20 investments made pursuant to this section or as provided in 21 section 12B.10 shall be credited to the blufflands protection 22 revolving fund. Notwithstanding section 8.33 , unobligated 23 or unencumbered funds credited to the blufflands protection 24 revolving fund shall not revert at the close of a fiscal year. 25 However, the maximum balance in the blufflands protection 26 revolving fund shall not exceed two million five hundred 27 thousand dollars. Any funds in excess of two million five 28 hundred thousand dollars shall be credited to the rebuild Iowa 29 infrastructure fund. No loan shall be made under this section 30 on or after July 1, 2025. 31 Sec. 33. Section 161A.80B, subsection 1, Code 2024, is 32 amended to read as follows: 33 1. The principal and interest from any loan made pursuant to 34 section 161A.80A , as enacted in 2015 Iowa Acts, ch 132, §45 , 35 -27- SF 2421.4352 (3) 90 da/ns 27/ 30
remaining outstanding on July 1, 2025, that would have been 1 payable to the blufflands protection revolving fund created 2 in section 161A.80A , that is due shall instead be paid to the 3 division on or after July 1, 2025, pursuant to the terms of 4 the loan agreement. The moneys paid to the division shall 5 be credited to the rebuild Iowa infrastructure fund created 6 in section 8.57 transferred to the general fund of the state 7 and appropriated to the department of natural resources for 8 purposes of supporting projects increasing the accessibility 9 of persons with disabilities when visiting state parks and 10 recreation areas . 11 DIVISION XI 12 CODIFIED PROVISIONS 13 PART A 14 STATUTES CONDITIONED ON THE FAILURE TO ENACT CERTAIN 15 LEGISLATION RELATING TO MARKETING PROGRAMS 16 Sec. 34. Section 159.31, Code 2024, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 3A. The department may use not more than 19 five percent of the balance of the unencumbered and unobligated 20 moneys in the fund at the beginning of a fiscal year to pay for 21 the costs of administering this part. 22 Sec. 35. Section 159.31A, subsection 2, Code 2024, is 23 amended by adding the following new paragraph: 24 NEW PARAGRAPH . 0b. The department may use not more than 25 five percent of the balance of the unencumbered and unobligated 26 moneys in the fund at the beginning of a fiscal year to pay for 27 the costs of administering this part. 28 Sec. 36. CONTINGENT EFFECTIVE DATE. This part of this 29 division of this Act takes effect July 1, 2024, only if 2024 30 Iowa Acts, House File 2641, is not enacted. 31 PART B 32 STATUTES CONDITIONED ON THE ENACTMENT OF CERTAIN LEGISLATION 33 RELATING TO MARKETING PROGRAMS 34 Sec. 37. CONTINGENT EFFECTIVE DATE. This part of this 8 division of this Act takes effect July 1, 2024, only if 2024 9 Iowa Acts, House File 2641, is enacted. 10 DIVISION XII 11 MISCELLANEOUS CODE PROVISIONS 12 Sec. 39. Section 458A.2, subsection 7, Code 2024, is amended 13 to read as follows: 14 7. “Gas” means and includes all natural gas and all other 15 naturally occurring gasses or fluid hydrocarbons which that 16 are produced at the wellhead and not defined in this section 17 as oil. 18 Sec. 40. Section 458A.4, subsection 1, paragraph e, Code 19 2024, is amended to read as follows: 20 e. That the production from wells be separated into gaseous 21 and liquid hydrocarbons gasses and liquids , and that each be 22 accurately measured by the means and upon standards prescribed 23 by the department; 24 Sec. 41. Section 458A.4, subsection 6, Code 2024, is amended 25 to read as follows: 26 6.
