A school district shall install and maintain school 28 infrastructure, as defined in section 423F.3, subsection 29 6, paragraph “a” , subparagraph (5), so that such school 30 infrastructure performs as expected for the operational life 31 of the school infrastructure. 32 2. is not included on the list established by the department 1 of homeland security and emergency management pursuant to 2 section 423F.3, subsection 6, paragraph “a” , subparagraph (5), 3 subparagraph division (a), subparagraph subdivision (vii), 4 subparagraph part (C). 5 3. If a school district purchases school infrastructure, 6 as defined in section 423F.3, subsection 6, paragraph 7 “a” , subparagraph (4), or other school safety and security 8 equipment, including radios, cameras, panic buttons, automated 9 locks, or shatter-resistant window film, the school district 10 shall install and maintain in an operable condition such school 11 infrastructure or school safety and security equipment. 12 Sec. ___. Section 423F.3, subsection 6, paragraph a, Code 13 2024, is amended by adding the following new subparagraph: 14 NEW SUBPARAGRAPH . (5) (a) Additionally, “school 15 infrastructure” includes software or other innovative 16 technology, and the cost of subscription and monitoring fees 17 associated with such software or other innovative technology, 18 that meets all of the following requirements: 19 (i) Is designed to detect and alert school district 20 employees and first responders if there is a visible, 21 unholstered firearm on property owned by the school district. 22 (ii) Is capable of integrating with local public safety 23 answering point technology. 24 (iii) Is designed to integrate with a school district’s 25 existing security camera infrastructure. 26 (iv) Was developed in the United States without the use of 27 any third-party data or open-source data. 28 (v) Was developed in the United States by an organization in 29 which a majority interest and a controlling interest is owned 30 by shareholders who are citizens of the United States. 31 (vi) Is not associated with any company that is owned or 32 controlled by the People’s Republic of China. 33 (vii) All of the video processing, data processing, 34 and data storage occurs on school district property or on 35 -2- HF 2652.4314 (2) 90 jda/jh 2/ 5
servers located within the United States that follow data 1 retention policies that are consistent with rules adopted by 2 the department of homeland security and emergency management. 3 The department of homeland security and emergency management 4 shall adopt rules pursuant to chapter 17A to administer this 5 subparagraph subdivision. The rules adopted by the department 6 of homeland security and emergency management shall do all of 7 the following: 8 (A) Establish security standards related to the 9 transmission and storage of video and data. 10 (B) Establish model data retention policies related to the 11 storage of video and data. 12 (C) Establish a list of organizations that satisfy the 13 standards established by the department of homeland security 14 and emergency management pursuant to this subparagraph 15 subdivision. An organization may submit a request to the 16 department of homeland security and emergency management to be 17 included on this list. 18 (viii) Was developed by an organization that is on the 19 list established by the department of homeland security and 20 emergency management pursuant to subparagraph subdivision 21 (vii), subparagraph part (C). 22 (ix) Beginning July 1, 2025, is designated by the secretary 23 of homeland security as qualified anti-terrorism technology 24 under 6 U.S.C. §441 et seq. 25 (b) For purposes of this subparagraph, “school 26 infrastructure” does not include the cost of personnel. > 27 3. Section 724.6, subsection 1, paragraph a, 6 subparagraph (3), if enacted by 2024 Iowa Acts, House File 7 2586, section 2, is amended to read as follows: 8 (3) A person may be issued a permit to carry weapons if the 9 person is a school employee of a school district, a private 10 school, or an institution of higher education as defined 11 in section 722.11. The person shall complete a prescribed 12 firearm safety training course offered pursuant to section 13 724.9, subsection 1, prior to being issued a permit, and not be 14 disqualified under section 724.8. A person issued a permit to 15 carry weapons under this subparagraph shall receive one-time, 16 in-person legal training, including training on qualified 17 immunity, annual emergency medical training, and annual 18 communication training that is approved by the department of 19 public safety. The department of public safety shall implement 20 required annual live scenario training and quarterly live 21 firearm training for school employees of a school district, 22 a private school, or an institution of higher education that 23 has opted into participating in the professional permitting 24 of school employees. A school employee issued a professional 25 permit to carry by the department of public safety who is up 26 to date with department of public safety-approved training, 27 and the school district that employs the school employee, 28 shall be entitled to qualified immunity from criminal or civil 29 liability for all damages incurred pursuant to the application 30 of reasonable force at the place of employment. The identity 31 of a person who has been issued a permit pursuant to this 32 subparagraph shall be confidential and shall not be a public 33 record subject to disclosure under chapter 22.
