Section 256.46, subsection 1, Code 2024, is 4 amended by adding the following new paragraph: 5 NEW PARAGRAPH . j. The child participates in extracurricular 6 interscholastic contests or competitions pursuant to section 7 280.13D. 8 Sec. 2. NEW SECTION . 280.13D Participation in 9 extracurricular interscholastic athletic contests or competitions 10 provided by public schools. 11 1. The board of directors of a school district shall allow 12 a student who resides within the school district and who is 13 enrolled in a nonpublic school to participate immediately 14 in any extracurricular interscholastic athletic contest or 15 competition that is provided by the school district, but that 16 is not provided by the nonpublic school, if the authorities 17 in charge of the nonpublic school have not entered into 18 an agreement with any school district or nonpublic school 19 under section 280.13A with respect to the extracurricular 20 interscholastic athletic contest or competition in which the 21 student will participate. 22 2. If the board of directors of a school district has 23 established a fee for the cost of a student’s participation 24 in an extracurricular interscholastic athletic contest or 25 competition, a student who is enrolled in a nonpublic school 26 and is participating in a contest or competition at a public 27 school pursuant to subsection 1, or the student’s parent or 28 guardian, shall be responsible for the payment of such fee. 29 3. An organization, as defined in section 280.13, shall not 30 take into account the number of students who participate in an 31 extracurricular interscholastic athletic contest or competition 32 provided by a school district pursuant to this section when 33 determining the classification of a public school. > 34 -1- HF 2553.4312 (1) 90 jda/jh 1/ 2 #1.
