amended
to
read

Exemptions.

1.
In
order
to
accomplish
the
objectives
of
this
chapter
,
7
the
secretary
may
exempt
the
following
types
of
operations
from
8
inspection:

1.
a.
Slaughtering
and
preparation
by
any
person
of
10
livestock
and
poultry
of
the
person’s
own
raising
exclusively
11
for
use
by
the
person
and
members
of
the
person’s
household,
12
and
the
person’s
nonpaying
guests
and
employees.
13
2.
b.
Any
other
operations
which
the
secretary
may
14
determine
would
best
be
exempted
to
further
the
purposes
of
15
this
chapter
,
to
the
extent
such
exemptions
conform
to
the
16
federal
Meat
Inspection
Act
and
the
federal
Poultry
Products
17
Inspection
Act
and
the
regulations
thereunder.

2.
a.
The
secretary
may
allow
a
poultry
establishment
at
19
which
inspection
is
maintained
to
engage
in
custom
operations,
20
and
exempt
from
inspection
any
poultry
slaughtered
or
any
21
poultry
or
poultry
products
otherwise
prepared
on
such
custom
22
basis,
provided
that
any
carcasses,
parts
thereof,
poultry,
or
23
poultry
products
wherever
handled
on
a
custom
basis,
or
any
24
containers
or
packages
containing
such
articles,
are
separated
25
at
all
times
from
carcasses,
parts
thereof,
poultry,
or
poultry
26
products
prepared
for
sale,
and
that
all
such
articles
prepared
27
on
a
custom
basis,
or
any
containers
or
packages
containing
28
such
articles,
are
plainly
marked
“Not
for
Sale”
immediately
29
after
being
prepared
and
kept
so
identified
until
delivered
to
30
the
owner,
and
that
the
establishment
conducting
the
custom
31
operation
is
maintained
and
operated
in
a
sanitary
manner.

(1)
Paragraph
“a”
shall
be
implemented,
including
33
administered
and
enforced
by
the
department
of
agriculture

and
land
stewardship,
on
and
after
the
publication
date
of

issue
of
the
Iowa
administrative
bulletin
that
includes

a
notice
by
the
secretary
of
agriculture
stating
any
of
the

following:

(a)
Federal
law,
including
a
statute
or
regulation,
allows
4
for
the
implementation.
5
(b)
The
United
States
department
of
agriculture
has
6
delivered
to
the
department
of
agriculture
and
land
stewardship
7
an
official
approval
of
the
implementation
in
writing.
8
(2)
The
department
of
agriculture
and
land
stewardship
9
shall
send
a
copy
of
the
notice
to
the
Iowa
Code
editor
at
10
least
two
weeks
prior
to
the
publication
date
of
the
Iowa
11
administrative
bulletin
as
described
in
subparagraph
(1).

(3)
This
paragraph
is
repealed
on
the
date
that
paragraph
13
“a”
is
implemented.
