Section 97A.1, subsection 6, Code 2024, is 3 amended by striking the subsection and inserting in lieu 4 thereof the following: 5 6. “Cancer” means a group of diseases involving abnormal 6 cell growth with the potential to invade or spread to other 7 parts of the body. 8 Sec. ___. Section 411.1, subsection 6, Code 2024, is amended 9 by striking the subsection and inserting in lieu thereof the 10 following: 11 6. “Cancer” means a group of diseases involving abnormal 12 cell growth with the potential to invade or spread to other 13 parts of the body. 14 Sec. ___. Section 411.1, Code 2024, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 8A. “Cost-sharing” means any coverage 17 limit, copayment, coinsurance, deductible, or other 18 out-of-pocket cost obligation related to an injury or disease 19 incurred while in the performance of duties. 20 Sec. ___. Section 411.15, Code 2024, is amended to read as 21 follows: 22 411.15 Hospitalization and medical attention. 23 1. Cities shall provide hospital, nursing, and physical 24 or mental medical attention for the members of the police and 25 fire departments of the cities, when injured while in the 26 performance of their duties as members of such department, and 27 shall continue to provide hospital, nursing, and physical or 28 mental medical attention for injuries or diseases incurred 29 while in the performance of their duties for members receiving 30 a retirement allowance under section 411.6, subsection 6 . 31 2. Cities may fund the cost of the hospital, nursing, and 32 physical or mental medical attention required by this section 33 through the purchase of insurance, including by processing 34 claims concerning the cancer, heart, and lung or respiratory 35 -1- SF 2158.3759 (2) 90 as/js 1/ 2 #1.
issues described in section 411.6, subsection 5, paragraph “c” , 1 through their group health insurance plan as long as the member 2 is not responsible for any cost-sharing; by self-insuring 3 the obligation , ; or through payment of moneys into a local 4 government risk pool established for the purpose of covering 5 the costs associated with the requirements of this section . 6 However, the cost of the hospital, nursing, and physical or 7 mental medical attention required by this section shall not 8 be funded through an employee-paid health insurance policy , 9 except as otherwise specified in this subsection . Cancers, 10 heart disease, and lung or respiratory diseases described in 11 section 411.6, subsection 5, paragraph “c” , shall not be deemed 12 work-related for purposes of coverage through the employer’s 13 group health insurance plan. 14 3. The cost of the hospital, nursing, and physical or mental 15 medical attention required by this section shall be paid from 16 moneys held in a trust and agency fund established pursuant to 17 section 384.6 , or out of the appropriation for the department 18 to which the injured person belongs or belonged ; , provided 19 that any amounts received by the injured person from any other 20 source for such specific purposes , shall be deducted from the 21 amount paid by the city under the provisions of this section . > 22 2.
