By striking page 1, line 5, through page 26, line 17, and 3 inserting: 4 < Section 1. AREA EDUCATION AGENCY COMMISSION. 5 1. A commission is established to conduct a comprehensive 6 study of area education agencies and make recommendations 7 related to how to improve the outcomes of students who utilize 8 services provided by area education agencies. 9 2. a. A statewide association located in this state that 10 represents educational professionals shall appoint one co-chair 11 to the commission. 12 b. The co-chair appointed pursuant to paragraph “a” must be 13 a current or recently retired special education teacher or a 14 current or recently retired superintendent who has many years 15 of experience as a licensed educator or administrator in this 16 state. 17 c. The co-chair appointed pursuant to paragraph “a” shall 18 not be a member of the general assembly. 19 3. a. A statewide organization located in this state 20 that represents educational administrators shall appoint one 21 co-chair to the commission. 22 b. The co-chair appointed pursuant to paragraph “a” must be 23 a current or recently retired special education teacher or a 24 current or recently retired superintendent who has many years 25 of experience as a licensed educator or administrator in this 26 state. 27 c. The co-chair appointed pursuant to paragraph “a” shall 28 not be a member of the general assembly. 29 4. The association described in subsection 2, paragraph 30 “a”, and the organization described in subsection 3, paragraph 31 “a”, shall consult to ensure that one co-chair has declared a 32 political party affiliation with the republican party and the 33 other co-chair has declared a political party affiliation with 34 the democratic party. 35 -1- S 5043.3452 (5) 90 jda/jh 1/ 4 #1.

Subject to paragraphs “b” and “c”, the co-chairs 1 shall appoint additional members to the commission, as 2 determined by the co-chairs, including members representing 3 the office of the governor, the general assembly, and the 4 department of education. 5 b. The commission shall be bipartisan in its composition. 6 c. All members of the commission appointed by the co-chairs 7 must be residents of this state. 8 6. All contractors engaged by the commission shall be 9 residents of this state. 10 7. The co-chairs may create working groups to study and make 11 recommendations related to any of the following: 12 a. Area education agency funding and finances. 13 b. Area education agency governance structures. 14 c. Area education agency oversight. 15 d. Services area education agencies should provide in the 16 school year beginning July 1, 2024, and subsequent school 17 years. 18 e. The educational and service standards that apply to area 19 education agencies. 20 f. The quality of the educational programs and services 21 provided by area education agencies to school districts. 22 g. The role of school districts in guiding the services 23 provided by area education agencies. 24 h. The role of parents, students, and communities in guiding 25 the services provided by area education agencies. 26 i. How to improve the outcomes of students in this state who 27 receive special education programs and services. 28 8. The commission shall submit a report, including findings 29 and recommendations for policy changes, to the general assembly 30 by December 31, 2024. > 31 2.
