The fee shall be determined by dividing the 25 actual remaining costs to purchase the statewide license for 26 the school year by the number of pupils assessed under the 27 system in the current fiscal year. School districts may use 28 moneys received pursuant to section 257.10, subsection 11 , and 29 moneys received for purposes of implementing section 279.68, 30 subsection 2 , to pay the early warning assessment system fee. 31 16. IOWA READING RESEARCH CENTER 32 a. For purposes of the Iowa reading research center in 33 order to implement, in collaboration with the area education 34 agencies, the provisions of section 256.9, subsection 49 , 35 -5- SF 560.2171 (2) 90 jda/ns 5/ 40

The department shall work with the community colleges to 6 develop STEM professional development programs for community 7 college instructors and STEM curriculum development. 8 c. From the moneys appropriated in this subsection, not less 9 than $500,000 shall be used to provide technology education 10 opportunities to high school, career academy, and community 11 college students through a public-private partnership, as 12 well as opportunities for students and faculties at these 13 institutions to secure broad-based information technology 14 certification. The partnership shall provide all of the 15 following: 16 (1) A research-based curriculum. 17 (2) Online access to the curriculum. 18 (3) Instructional software for classroom and student use. 19 (4) Certification of skills and competencies in a broad base 20 of information technology-related skill areas. 21 (5) Professional development for teachers. 22 (6) Deployment and program support, including but not 23 limited to integration with current curriculum standards. 24 d. AT-RISK CHILDREN. Notwithstanding the standing 24 appropriation in section 279.51 for the fiscal year beginning 25 July 1, 2023, and ending June 30, 2024, the amount appropriated 26 from the general fund of the state to the department of 27 education for programs for at-risk children under section 28 279.51 shall be not more than $10,524,389. The amount of any 29 reduction in this section shall be prorated among the programs 30 specified in section 279.51, subsection 1 , paragraphs “a”, “b”, 31 and “c”. 32 Sec. 9. WORK-STUDY APPROPRIATION. Notwithstanding section 33 261.85, as amended by 2023 Iowa Acts, Senate File 514, for the 34 fiscal year beginning July 1, 2023, and ending June 30, 2024, 35 -21- SF 560.2171 (2) 90 jda/ns 21/ 40
the amount appropriated from the general fund of the state 1 to the college student aid commission of the department of 2 education for the work-study program under section 261.85, as 3 amended by 2023 Iowa Acts, Senate File 514, shall be zero. 4 Sec. 10. Section 261.25, subsections 1 and 2, Code 2023, are 5 amended to read as follows: 6 1. There is appropriated from the general fund of the state 7 to the commission for each fiscal year the sum of fifty million 8 one hundred eighteen thousand four hundred fifty-one million 9 four hundred twenty-one thousand five hundred thirty-one 10 dollars for tuition grants to qualified students who are 11 enrolled in accredited private institutions. 12 2. There is appropriated from the general fund of the state 13 to the commission for each fiscal year the sum of five hundred 14 one hundred eight thousand dollars for tuition grants for 15 qualified students who are enrolled in eligible institutions. 16 Of the moneys appropriated under this subsection , not more than 17 one hundred thousand dollars annually shall be used for tuition 18 grants to qualified students who are attending an eligible 19 institution under section 261.9, subsection 3 , paragraph “b” . 20 DIVISION V 21 DIVERSITY, EQUITY, AND INCLUSION 22 Sec. 11. DIVERSITY, EQUITY, AND INCLUSION EFFORTS —— STUDY 23 —— HIRING FREEZE —— USE OF MONEYS. 24 1. The state board of regents shall conduct a comprehensive 25 study and review of the diversity, equity, and inclusion 26 programs and efforts of each institution of higher learning 27 under the state board’s control. The study and review must 28 include but is not limited to an assessment of all of the 29 following: 30 a. Each institution of higher learning’s current diversity, 31 equity, and inclusion programming, curricula, training, and 32 related activities. 33 b. The salary, benefits, and any other compensation paid to 34 employees or individuals tasked with furthering an institution 35 -22- SF 560.2171 (2) 90 jda/ns 22/ 40
of higher learning’s diversity, equity, and inclusion efforts. 1 c. Each institution of higher learning’s contracts or 6 grants requiring diversity, equity, and inclusion efforts, 7 and the requirements of third-party accreditors or similar 8 entities in order to assess whether and to what extent these 9 efforts are aligned with the overall mission and purpose of the 10 institution. 11 2. The state board of regents shall prepare a report 12 containing its findings and recommendations to be considered 13 by the state board during its November 2023 meeting. The 14 state board of regents shall submit a final report containing 15 findings and recommendations to the governor and the general 16 assembly no later than December 1, 2023. 17 3. For the fiscal year beginning July 1, 2023, and ending 18 June 30, 2024, each institution of higher learning under the 19 control of the state board of regents shall cease all hiring 20 related to the institution’s diversity, equity, and inclusion 21 efforts. 22 DIVISION VI 23 IOWA WORKFORCE GRANT AND INCENTIVE PROGRAM 24 Sec. 12. Section 84A.1B, Code 2023, is amended by adding the 25 following new subsection: 26 NEW SUBSECTION . 17. Create, in collaboration with the state 27 board of regents, a list of high-wage and high-demand jobs and 28 corresponding academic majors offered by institutions of higher 29 education governed by the state board of regents for purposes 30 of the Iowa workforce grant and incentive program established 31 under section 256.230. The workforce development board, in 32 collaboration with the state board of regents, shall update the 33 list at least once every two years. In creating a list under 34 this subsection, the following criteria, at a minimum, apply: 35 -23- SF 560.2171 (2) 90 jda/ns 23/ 40
a. An entry-level annual salary of not less than forty 1 thousand dollars. 2 b. Educational attainment of a qualifying credential of 3 at least a bachelor’s degree, or attainment of an initial or 4 intern Iowa teaching license issued under chapter 256 through 5 a pathway to licensure offered by an institution of higher 6 education under the control of the state board of regents or an 7 accredited private institution as defined in section 261.9. 8 c. At least one of any of the following: 9 (1) Projected annual job openings of at least two hundred 10 fifty during the next five years. 11 (2) Projected annual growth in the number of job openings 12 of at least one percent. 13 Sec. 13. NEW SECTION . 256.230 Iowa workforce grant and 14 incentive program. 15 1. Definitions. As used in this section, unless the context 16 otherwise requires: 17 a. “Commission” means the college student aid commission. 18 b. “Eligible institution” means an institution of higher 19 learning governed by the state board of regents. 20 c. “Eligible program” means any of the following: 21 (1) A program of study or an academic major jointly approved 22 by the workforce development board and the state board of 23 regents pursuant to section 84A.1B, subsection 17. If a 24 job is removed from the list created under section 84A.1B, 25 subsection 17, an eligible student who received a grant for 26 a program based on that job shall continue to receive the 27 grant until the eligible program is completed as long as the 28 student continuously enrolls and continues to meet all other 29 eligibility requirements. 30 (2) A teacher preparation program that leads to a bachelor’s 31 degree, or initial or intern teaching license issued under this 32 chapter. 33 d. “Eligible student” means an Iowa resident who has 34 established financial need and who meets all of the following 35 -24- SF 560.2171 (2) 90 jda/ns 24/ 40
requirements: 1 (1) Completes and submits application forms required by the 2 commission, including the free application for federal student 3 aid, by the deadline prescribed by the commission. 4 (2) Enrolls in at least three semester hours, or the 5 equivalent, in an eligible program. 6 (3) Is making satisfactory academic progress as defined by 7 the eligible institution. 8 e. “Financial need” means the difference between the 9 student’s financial resources available, including those 10 available from the student’s parents as determined by a 11 completed parents’ confidential statement, and the student’s 12 anticipated expenses while attending an eligible institution. 13 f. “Full-time” means enrollment in at least twelve semester 14 hours or the equivalent. 15 g. “Part-time” means enrollment in at least three semester 16 hours or the equivalent but less than twelve semester hours or 17 the equivalent. 18 2. Student eligibility. An eligible institution shall 19 report promptly to the commission information requested to 20 establish or verify student eligibility. 21 3. Grant limitations —— requirements. 22 a. A full-time eligible student may receive an Iowa 23 workforce grant for not more than four semesters, or the 24 equivalent, or until the eligible student completes the 25 eligible program, whichever occurs first. A part-time 26 eligible student may receive the grant for not more than eight 27 semesters, or the equivalent, on a prorated basis, or until 28 the eligible student completes the eligible program, whichever 29 occurs first. 30 b. The amount of an Iowa workforce grant to a full-time 31 eligible student shall not exceed two thousand dollars per 32 semester, or the equivalent. The amount of an Iowa workforce 33 grant to a part-time eligible student shall be equal to the 34 amount that would be awarded to a full-time student except that 35 -25- SF 560.2171 (2) 90 jda/ns 25/ 40
the commission shall prorate the amount based on the recipient 1 student’s semester hour or equivalent enrollment. 2 c. An Iowa workforce grant shall be awarded on an annual 3 basis, requiring reapplication by an eligible student each 4 year. Payments under the grant shall be allocated equally 5 among the semesters, or the equivalent, and paid upon 6 certification by the eligible institution that the student 7 meets the requirements of subsection 1, paragraph “d” . 8 d. If a grant recipient discontinues attendance before the 9 end of any semester, or the equivalent, after receiving grant 10 payments, the entire amount of any refund due that recipient, 11 up to the full amount of grant payments made during that 12 semester, or the equivalent, shall be paid by the eligible 13 institution to the commission. 14 4. Annual submission of applications. To receive a renewal 15 of a grant awarded under this section, an eligible student 16 must annually submit a new application to the commission for 17 reevaluation of eligibility. 18 5. Priority for grant awards. In making awards under this 19 section, the commission shall give priority to: 20 a. Applicants who received an award under this section in 21 the prior academic year. 22 b. Applicants with the least financial ability to pay, 23 using a metric that ranks relative financial ability among all 24 applicants. 25 6. Iowa workforce incentive payment. Notwithstanding the 26 grant limitations in subsection 3, an individual who was an 27 eligible student who received an Iowa workforce grant in the 28 academic year in which the eligible program is completed, and 29 who accepts and begins employment in an aligned occupation 30 in this state within six months of completing the eligible 31 program, may apply for one incentive payment of up to two 32 thousand dollars. The incentive payment shall be paid upon 33 completion of twelve consecutive months of full-time employment 34 in the aligned occupation in this state, following completion 35 -26- SF 560.2171 (2) 90 jda/ns 26/ 40
of the eligible program. 1 7. Commission’s duties and responsibilities. Subject to an 2 appropriation of moneys by the general assembly for purposes 3 of this section, the commission shall administer the Iowa 4 workforce grant and incentive program and shall do all of the 5 following: 6 a. Provide application forms for distribution to students by 7 eligible institutions. 8 b. Adopt rules under chapter 17A for administration of this 9 section, including establishing the duties and responsibilities 10 of eligible institutions under the program, defining residence 11 and satisfactory academic progress for purposes of the program, 12 determining financial need, and establishing procedures for 13 grant and incentive payment application, processing, and 14 approval. The rules shall provide for determining the priority 15 awarding of grants and incentives if moneys available for 16 purposes of this section are insufficient to pay all eligible 17 applicants. 18 c. Approve and award grants and incentive payments on an 19 annual basis. 20 8. Fund created. An Iowa workforce grant and incentive 21 program fund is created in the state treasury under the control 22 of the commission. All moneys deposited or paid into the 23 fund are appropriated to the commission to be used for grants 24 and incentive payments awarded as provided in this section. 25 Notwithstanding section 8.33, moneys in the fund that remain 26 unencumbered or unobligated at the close of a fiscal year shall 27 not revert but shall remain available for expenditure for the 28 purposes designated. Notwithstanding section 12C.7, subsection 29 2, interest or earnings on moneys in the fund shall be credited 30 to the fund. 31 DIVISION VII 32 DEPARTMENT OF EDUCATION —— TASK FORCE 33 Sec. 14. DEPARTMENT OF EDUCATION —— FUNDING FOR AT-RISK 34 STUDENTS AND DROPOUT PREVENTION PROGRAMS —— TASK FORCE. 35 -27- SF 560.2171 (2) 90 jda/ns 27/ 40
1. The department of education shall convene and provide 1 administrative support to a task force that shall study all of 2 the following: 3 a. How schools currently utilize state funding for programs 4 for at-risk students and dropout prevention programs. 5 b. The effectiveness of programs for at-risk students and 6 dropout prevention programs. 7 c. Whether and to what extent state funding for programs 8 for at-risk students and dropout prevention programs should 9 be reallocated to direct intervention by a jobs for America’s 10 graduates specialist. 11 d. How to best utilize state funding for programs for 12 at-risk students and dropout prevention programs. 13 2. Any expenses incurred by a member of the task force 14 shall be the responsibility of the individual member or the 15 respective entity represented by the member. 16 3. The task force shall submit its findings and 17 recommendations to the general assembly in a report by December 18 31, 2023. 19 DIVISION VIII 20 FUTURE READY IOWA SKILLED WORKFORCE GRANT PROGRAM 21 Sec. 15. Section 261.132, subsections 1 and 2, Code 2023, 22 are amended to read as follows: 23 1. Definitions. As used in this section , unless the context 24 otherwise requires: 25 a. “Approved virtual institution” means a nonprofit 26 institution of higher learning that satisfies all of the 27 following requirements: 28 (1) Is accredited by a national accrediting agency 29 recognized by the United States department of education. 30 (2) Provides instruction using exclusively a 31 competency-based educational model. 32 (3) Adopts a policy to require that the nonprofit 33 institution of higher learning shall, by December 15 of each 34 year, file a report with the governor and the general assembly 35 -28- SF 560.2171 (2) 90 jda/ns 28/ 40
providing information and statistics for the previous five 1 academic years on the number of Iowa resident students per year 2 who are veterans who received education credit for military 3 education, training, and service, that number as a percentage 4 of veterans known to be enrolled at the nonprofit institution 5 of higher learning, the average number of credits received by 6 students, and the average number of credits applied towards the 7 award or completion of a course of instruction, postsecondary 8 diploma, degree, or other evidences of distinction. For 9 purposes of this subparagraph, “veteran” means a veteran as 10 defined in section 35.1 or a member of the reserve forces 11 of the United States or the national guard as defined in 12 section 29A.1 who has served at least one year of the member’s 13 commitment and is eligible for or has exhausted federal 14 veterans education benefits under 38 U.S.C. ch. 30, 32, 33, or 15 36, or 10 U.S.C. ch. 1606 or 1607, respectively. 16 a. b. “Commission” means the college student aid 17 commission. 18 b. c. “Eligible institution” means an institution of 19 higher learning governed by the state board of regents , or an 20 accredited private institution as defined in section 261.9 , 21 or an approved virtual institution, that meets all of the 22 following criteria: 23 (1) Applies to and is approved by the commission to 24 participate in the future ready Iowa skilled workforce grant 25 program. 26 (2) Requires eligible students to complete and file 27 application forms required by the commission, apply for 28 all available state and federal financial aid, apply to the 29 eligible institution to participate in the program, attend 30 orientation in person or virtually, register for classes 31 with the assistance of an academic advisor, and participate 32 in academic and career advising sessions required under the 33 program. 34 (3) Certifies that prior to participating in the program 35 -29- SF 560.2171 (2) 90 jda/ns 29/ 40
an eligible student has earned at least half of the credits 1 necessary for a bachelor’s degree and is able to complete a 2 bachelor’s degree in an eligible program of study or academic 3 major leading to a designated high-demand job in the prescribed 4 grant time frame. 5 (4) (3) Facilitates the assignment of a volunteer mentor 6 or a mentor who is a member of the faculty of the eligible 7 institution to each eligible student based on the eligible 8 student’s interest. The A volunteer mentor shall have 9 successfully passed a background investigation and a check of 10 the national sex offender registry as required under section 11 15H.10, subsection 2 , and both the eligible student and the 12 volunteer mentor shall have entered into a written agreement as 13 provided in section 15H.10, subsection 3 . 14 (5) (4) Facilitates connections through campus career 15 centers and services to internships and similar local, state, 16 and federal programs. 17 (6) (5) Markets the eligible institution’s eligible 18 program and optional incentives, which may include but not be 19 limited to credit for military experience, on the eligible 20 institution’s internet site and to other relevant agencies 21 and organizations as recommended by the college student 22 aid commission, the commission on volunteer service, or the 23 department of workforce development. 24 (7) (6) Submits annually information and data regarding 25 the eligible program operated by the eligible institution, the 26 students and volunteer mentors participating in the eligible 27 program, and statistics on employment outcomes for eligible 28 program participants by industry, to the commission in the 29 manner required by the commission. 30 c. d. “Eligible program” means a program of study or an 31 academic major jointly approved by the commission and the 32 department of workforce development, in consultation with the 33 eligible institution, that leads to a bachelor’s degree aligned 34 with a high-demand job designated by the workforce development 35 -30- SF 560.2171 (2) 90 jda/ns 30/ 40
board pursuant to section 84A.1B, subsection 14 . If the 1 department removes a high-demand job from the list created 2 under section 84A.1B, subsection 14 , an eligible student who 3 received a grant for a program based on that high-demand 4 job shall continue to receive the grant until achieving a 5 bachelor’s degree as long as the student continues to meet all 6 other eligibility requirements. 7 d. e. “Eligible student” means an Iowa resident who meets 8 all of the following requirements: 9 (1) Has earned at least half of the credits necessary for a 10 bachelor’s degree and is able to complete a bachelor’s degree 11 in an eligible program of study or academic major leading to a 12 designated high-demand job in the prescribed grant time frame. 13 (2) (1) Completes and submits application forms required 14 by the commission, including the free application for federal 15 student aid; applies for all available state and federal 16 financial aid; attends orientation in person or virtually; 17 registers for classes with the assistance of an academic 18 advisor; and participates in academic and career advising 19 sessions required under the eligible program. To receive a 20 renewal of a grant awarded under this section , an eligible 21 student must annually submit a new application to the 22 commission for reevaluation of eligibility. 23 (3) Has not been enrolled in postsecondary education 24 during the twenty-four months preceding the date on which the 25 commission receives the individual’s application to participate 26 in the program. 27 (2) Is at least twenty-five years of age at the time the 28 individual enrolls in an eligible program. 29 (4) (3) Enrolls in at least six semester hours, or the 30 equivalent, in an eligible program. However, an eligible 31 student may enroll in fewer than six semester hours, or the 32 equivalent, if the eligible student needs fewer than six 33 semester hours of credit, or the equivalent, to achieve a 34 bachelor’s degree under the eligible program. 35 -31- SF 560.2171 (2) 90 jda/ns 31/ 40
(5) (4) Is making satisfactory academic progress as defined 1 by the eligible institution. 2 (6) (5) Remains continuously enrolled unless granted a 3 leave of absence by the eligible institution based on criteria 4 adopted by rule by the commission. 5 e. f. “Full-time” means enrollment in at least twelve 6 semester hours or the equivalent. 7 f. g. “Part-time” means enrollment in at least six but less 8 than twelve semester hours or the equivalent. 9 2. Allowable activities. An eligible student may work with 10 an assigned volunteer mentor , or a mentor who is a member of 11 the faculty of the eligible institution, to help the student 12 meet the requirements of this section or the requirements of 13 an eligible program, identify and participate in work-based 14 learning opportunities with the approval of the eligible 15 institution, and make other career-related connections. 16 Sec. 16. Section 261.132, subsection 3, paragraph c, Code 17 2023, is amended to read as follows: 18 c. A future ready Iowa skilled workforce grant shall be 19 awarded on an annual basis, requiring reapplication by an 20 eligible student each year. Payments under the grant shall be 21 allocated equally among the semesters, or the equivalent, and 22 paid upon certification by the eligible institution that the 23 student meets the requirements of subsection 1 , paragraph “d” 24 “e” . 25 Sec. 17. Section 261.132, subsection 4, paragraph d, Code 26 2023, is amended to read as follows: 27 d. Transmit to the department of workforce development the 28 compilation of information, data, and statistics submitted in 29 accordance with subsection 1 , paragraph “b” “c” , subparagraph 30 (7) (6) , for the annual report required under section 84A.1B . 31 Sec. 18. Section 261.132, subsection 6, Code 2023, is 32 amended by striking the subsection. 33 Sec. 19. APPROVED VIRTUAL INSTITUTIONS —— 34 APPLICATIONS. For the fiscal year beginning July 1, 2023, and 35 -32- SF 560.2171 (2) 90 jda/ns 32/ 40
ending June 30, 2024, an approved virtual institution may apply 1 to the college student aid commission to participate in the 2 future ready Iowa skilled workforce grant program established 3 pursuant to section 261.132 in the current academic year. 4 DIVISION IX 5 ALL IOWA OPPORTUNITY SCHOLARSHIP PROGRAM 6 Sec. 20. Section 261.87, subsection 1, paragraph b, 7 unnumbered paragraph 1, Code 2023, is amended to read as 8 follows: 9 “Eligible foster care student” means a person under 10 twenty-six years of age who has a high school diploma or a high 11 school equivalency diploma under chapter 259A and is described 12 by any of the following: 13 Sec. 21. Section 261.87, subsection 2, paragraph f, Code 14 2023, is amended to read as follows: 15 f. (1) Begins Except as provided in subparagraph (2), 16 begins enrollment at an eligible institution within two 17 academic years of graduation from high school or receipt of 18 a high school equivalency diploma under chapter 259A and 19 continuously receives awards as a full-time or part-time 20 student to maintain eligibility. However, the student may 21 defer or suspend participation in the program for up to two 22 years in order to pursue obligations that meet conditions 23 established by the commission by rule or to fulfill military 24 obligations. 25 (2) The requirements of subparagraph (1) do not apply to an 26 eligible foster care student. 27 Sec. 22. APPLICABILITY. This division of this Act applies 28 to applications submitted under the all Iowa opportunity 29 scholarship program established pursuant to section 261.87 30 before, on, or after the effective date of this division of 31 this Act. 32 DIVISION X 33 EDUCATION SAVINGS ACCOUNTS —— CORRECTIONS 34 Sec. 23. Section 257.11B, subsection 2, paragraph a, 35 -33- SF 560.2171 (2) 90 jda/ns 33/ 40
subparagraph (1), subparagraph division (c), as enacted by 2023 1 Iowa Acts, House File 68, section 7, is amended to read as 2 follows: 3 (c) A resident pupil who is eligible to enroll in grades one 4 through twelve and was enrolled in a nonpublic school for the 5 school year immediately preceding the school year for which the 6 education savings account payment is requested if the pupil’s 7 household has an annual income less than or equal to three 8 hundred percent of the most recently revised poverty income 9 guidelines published by the United States department of health 10 and human services. 11 Sec. 24. Section 257.46, subsection 3, Code 2023, as amended 12 by 2023 Iowa Acts, House File 68, section 16, is amended to 13 read as follows: 14 3. If any portion of the gifted and talented program budget 15 remains unexpended at the end of the budget year, the remainder 16 shall be carried over to the subsequent budget year and added 17 to the gifted and talented program budget for that year. At 18 the end of a fiscal year beginning on or after July 1, 2022, 19 the school district may use all or a portion of funds for 20 the purposes authorized under section 257.10, subsection 9, 21 paragraph “d” . 22 Sec. 25. EFFECTIVE DATE. This division of this Act, being 23 deemed of immediate importance, takes effect upon enactment. 24 Sec. 26. RETROACTIVE APPLICABILITY. This division of this 25 Act applies retroactively to January 24, 2023. 26 DIVISION XI 27 EDUCATION SAVINGS ACCOUNTS —— DEPOSIT OF MONEYS 28 Sec. 27. EDUCATION SAVINGS ACCOUNTS —— DEPOSIT OF 29 MONEYS. Notwithstanding any other provision of law to the 30 contrary, for the fiscal year beginning July 1, 2023, and 31 ending June 30, 2024, moneys in the education savings account 32 fund established in section 257.11B, as enacted by 2023 Iowa 33 Acts, House File 68, may be deposited into an account at any 34 financial institution, including but not limited to financial 35 -34- SF 560.2171 (2) 90 jda/ns 34/ 40
institutions outside the state of Iowa, if such deposits 1 are adequately protected and necessary for the effective 2 administration of the education savings account program. All 3 liability protections of sections 12C.8 and 12C.24 apply in 4 connection with any such deposits as if the deposits were made 5 in compliance with chapter 12C. 6 DIVISION XII 7 GAP TUITION ASSISTANCE 8 Sec. 28. Section 260I.3, subsections 2 and 5, Code 2023, are 9 amended by striking the subsections. 10 Sec. 29. Section 260I.4, subsections 1, 5, 6, and 7, Code 11 2023, are amended by striking the subsections. 12 Sec. 30. Section 260I.5, subsection 2, Code 2023, is amended 13 to read as follows: 14 2. Direct training costs and support services . 15 Sec. 31. Section 260I.6, subsection 1, unnumbered paragraph 16 1, Code 2023, is amended to read as follows: 17 The program is not offered for credit, but is aligned with 18 a certificate, diploma, or degree for credit, is either not 19 offered for credit or is offered for short-term credit that is 20 not eligible under the federal Pell grant program, and does any 21 of the following: 22 DIVISION XIII 23 STATE GOVERNMENT REALIGNMENT —— MODIFICATIONS 24 Sec. 32. Section 256.103, as enacted by 2023 Iowa Acts, 25 Senate File 514, section 2480, is amended to read as follows: 26 256.103 Employees —— contracts —— termination and discharge 27 procedures. 28 Sections 279.12 through 279.19 and section 279.27 apply to 29 employees of the Iowa educational services for the blind and 30 visually impaired program and employees of the Iowa school for 31 the deaf, who are licensed pursuant to subchapter VII, part 3. 32 In following those sections in chapter 279, the references to 33 boards of directors of school districts shall be interpreted to 34 apply to the department. 35 -35- SF 560.2171 (2) 90 jda/ns 35/ 40
Sec. 33. Section 258.6, subsection 1, Code 2023, as amended 1 by 2023 Iowa Acts, Senate File 514, section 2529, is amended 2 to read as follows: 3 1. “Approved career and technical education program” means 4 a career and technical education program offered by a school 5 district or community college and approved by the bureau 6 department which meets the standards for career and technical 7 education programs adopted by the state board under this part. 8 Sec. 34. 2023 Iowa Acts, Senate File 514, section 2514, 9 subsection 1, is amended to read as follows: 10 1. The property and records in the custody of the state 11 board of regents relating to the Iowa braille and sight saving 12 school, the Iowa school for the deaf, the Iowa educational 13 services for the blind and visually impaired program, the hall 14 of fame for distinguished graduates at the Iowa braille and 15 sight saving school, and the hall of fame for distinguished 16 graduates at the Iowa school for the deaf shall be transferred 17 to the department of education. 18 DIVISION XIV 19 STATE PROGRAM ALLOCATION —— FINE ARTS BEGINNING TEACHER 20 MENTORING PROGRAM 21 Sec. 35. Section 256.34, subsection 2, Code 2023, is amended 22 to read as follows: 23 2. Program criteria shall include a required match of one 24 dollar provided by the organization contracting to deliver 25 services under subsection 1 for each dollar provided to the 26 organization by the department. Moneys in the fund established 27 under subsection 6 shall not be disbursed until the department 28 receives evidence that the organization meets or will meet 29 the match requirement. The department may consider in-kind 30 contributions received by the organization for matching 31 purposes. 32 Sec. 36. Section 284.13, subsection 1, paragraphs a, b, c, 33 e, f, and g, Code 2023, are amended to read as follows: 34 a. For the fiscal year beginning July 1, 2022 2023 , and 35 -36- SF 560.2171 (2) 90 jda/ns 36/ 40
ending June 30, 2023 2024 , to the department, the amount of 1 five hundred eight thousand two hundred fifty dollars for the 2 issuance of national board certification awards in accordance 3 with section 256.44 . Of the amount allocated under this 4 paragraph, not less than eighty-five thousand dollars shall 5 be used to administer the ambassador to education position in 6 accordance with section 256.45 . 7 b. For the fiscal year beginning July 1, 2022 2023 , and 8 ending June 30, 2023 2024 , up to seven hundred twenty-eight 9 thousand two hundred sixteen dollars to the department for 10 purposes of implementing the professional development program 11 requirements of section 284.6 , assistance in developing model 12 evidence for teacher quality committees established pursuant to 13 section 284.4, subsection 1 , paragraph “b” , and the evaluator 14 training program in section 284.10 . A portion of the funds 15 allocated to the department for purposes of this paragraph may 16 be used by the department for administrative purposes and for 17 not more than four full-time equivalent positions. 18 c. For the fiscal year beginning July 1, 2022 2023 , 19 and ending June 30, 2023 2024 , an amount up to one million 20 seventy-seven thousand eight hundred ten dollars to the 21 department for the establishment of teacher development 22 academies in accordance with section 284.6, subsection 10 . A 23 portion of the funds allocated to the department for purposes 24 of this paragraph may be used for administrative purposes. 25 e. For the fiscal year beginning July 1, 2022 2023 , and 26 ending June 30, 2023 2024 , to the department an amount up to 27 twenty-five fifty thousand dollars for purposes of the fine 28 arts beginning teacher mentoring program established under 29 section 256.34 . 30 f. For the fiscal year beginning July 1, 2022 2023 , and 31 ending June 30, 2023 2024 , to the department an amount up 32 to six hundred twenty-six thousand one hundred ninety-one 33 dollars shall be used by the department for a delivery system, 34 in collaboration with area education agencies, to assist in 35 -37- SF 560.2171 (2) 90 jda/ns 37/ 40
implementing the career paths and leadership roles considered 1 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 2 not limited to planning grants to school districts and area 3 education agencies, technical assistance for the department, 4 technical assistance for districts and area education agencies, 5 training and staff development, and the contracting of external 6 expertise and services. In using moneys allocated for purposes 7 of this paragraph, the department shall give priority to school 8 districts with certified enrollments of fewer than six hundred 9 students. A portion of the moneys allocated annually to the 10 department for purposes of this paragraph may be used by the 11 department for administrative purposes and for not more than 12 five full-time equivalent positions. 13 g. For the fiscal year beginning July 1, 2023 2024 , and 14 for each subsequent fiscal year, to the department, ten 15 million dollars for purposes of implementing the supplemental 16 assistance for high-need schools provisions of section 284.11 . 17 Annually, of the moneys allocated to the department for 18 purposes of this paragraph, up to one hundred thousand dollars 19 may be used by the department for administrative purposes and 20 for not more than one full-time equivalent position. 21 DIVISION XV 22 EQUIPMENT REPLACEMENT AND PROGRAM-SHARING PROPERTY TAX LEVY 23 Sec. 37. Section 260C.28, subsection 2, Code 2023, is 24 amended to read as follows: 25 2. However, the board of directors may annually certify 26 for levy a tax on taxable property in the merged area at a 27 rate in excess of the three cents per thousand dollars of 28 assessed valuation specified under subsection 1 if the excess 29 tax levied does not cause the total rate certified to exceed a 30 rate of nine cents per thousand dollars of assessed valuation, 31 and the excess revenue generated is used for purposes of 32 program sharing between community colleges or for the purchase 33 of instructional equipment. Programs that are shared shall 34 be designed to increase student access to community college 35 -38- SF 560.2171 (2) 90 jda/ns 38/ 40
programs and to achieve efficiencies in program delivery at the 1 community colleges, including , but not limited to , the programs 2 described under section 260C.46 . Prior to expenditure of the 3 excess revenues generated under this subsection , the board of 4 directors shall obtain the approval of the director of the 5 department of education. 6 Sec. 38. EFFECTIVE DATE. This division of this Act, being 7 deemed of immediate importance, takes effect upon enactment. 8 DIVISION XVI 9 ONLINE STATE JOB POSTING SYSTEM —— REPEAL 10 Sec. 39. Section 84A.6, Code 2023, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 4. a. The department of workforce 13 development, in consultation with the department of education, 14 shall establish a system that allows the department of 15 education, school districts, charter schools, area education 16 agencies, and accredited nonpublic schools to post job openings 17 on an internet site. The system must include a mechanism for 18 the electronic submission of job openings for posting on the 19 internet site. The system and each job posting on the internet 20 site must include a statement that an employer submitting a job 21 opening for posting on the internet site will not discriminate 22 in hiring on the basis of race, ethnicity, national origin, 23 gender, age, physical disability, sexual orientation, gender 24 identity, religion, marital status, or status as a veteran. 25 b. The department of education, school districts, charter 26 schools, and area education agencies shall submit all job 27 openings to the department of workforce development for posting 28 on the internet site. An accredited nonpublic school may 29 submit job openings to the department of workforce development 30 for posting on the internet site. 31 c. This subsection shall not be construed to do any of the 32 following: 33 (1) Prohibit any employer from advertising job openings and 34 recruiting employees independently of the internet site. 35 -39- SF 560.2171 (2) 90 jda/ns 39/ 40
(2) Prohibit any employer from using another method of 1 advertising job openings or another applicant tracking system 2 in addition to the system. 3 (3) Provide the department of workforce development with 4 any regulatory authority in the hiring process or hiring 5 decisions of any employer. 6 Sec. 40. REPEAL. Section 256.27, Code 2023, is repealed. > 7 2.
