crime victims of domestic abuse or to crime victims of rape and 1 sexual assault. 2 The balance of the victim compensation fund established 3 in section 915.94 may be used to provide salary and support 4 of not more than 24.00 full-time equivalent positions and to 5 provide maintenance for the victim compensation functions 6 of the department of justice. In addition to the full-time 7 equivalent positions authorized pursuant to this paragraph, 8 7.00 full-time equivalent positions are authorized and shall 9 be used by the department of justice to employ one accountant 10 and four program planners. The department of justice may 11 employ the additional 7.00 full-time equivalent positions 12 authorized pursuant to this paragraph that are in excess of the 13 number of full-time equivalent positions authorized only if 14 the department of justice receives sufficient federal moneys 15 to maintain employment for the additional full-time equivalent 16 positions during the current fiscal year. The department 17 of justice shall only employ the additional 7.00 full-time 18 equivalent positions in succeeding fiscal years if sufficient 19 federal moneys are received during each of those succeeding 20 fiscal years. 21 The department of justice shall transfer at least $150,000 22 from the victim compensation fund established in section 915.94 23 to the victim assistance grant program established in section 24 13.31. 25 Notwithstanding section 8.33, moneys appropriated in this 26 lettered paragraph that remain unencumbered or unobligated at 27 the close of the fiscal year shall not revert but shall remain 28 available for expenditure for the purposes designated until the 29 close of the succeeding fiscal year. 30 c. The department of justice, in submitting budget 2 estimates for the fiscal year beginning July 1, 2024, pursuant 3 to section 8.23, shall include a report of funding from sources 4 other than amounts appropriated directly from the general fund 5 of the state to the department of justice or to the office of 6 consumer advocate. These funding sources shall include but 7 are not limited to reimbursements from other state agencies, 8 commissions, boards, or similar entities, and reimbursements 9 from special funds or internal accounts within the department 10 of justice. The department of justice shall also report actual 11 reimbursements for the fiscal year beginning July 1, 2022, 12 and actual and expected reimbursements for the fiscal year 13 beginning July 1, 2023. 14 b. The department of justice shall fully reimburse 21 the costs and necessary related expenses incurred by the Iowa 22 law enforcement academy to continue to employ one additional 23 instructor position who shall provide training for human 24 trafficking-related issues throughout the state. 25 b. The department of justice shall obtain the moneys 26 necessary to reimburse the Iowa law enforcement academy to 27 employ such an instructor from unrestricted moneys from either 28 the victim compensation fund established in section 915.94 or 29 the human trafficking victim fund established in section 915.95 30 or the human trafficking enforcement fund established in 2015 31 Iowa Acts, chapter 138, section 141. 32 Sec. 2. It is the intent of the general assembly that each 19 lease negotiated by the department of corrections with a 20 private corporation for the purpose of providing private 21 industry employment of inmates in a correctional institution 22 shall prohibit the private corporation from utilizing inmate 23 labor for partisan political purposes for any person seeking 24 election to public office in this state and that a violation 25 of this requirement shall result in a termination of the lease 26 agreement. 27 b. It is the intent of the general assembly that as a 28 condition of receiving the appropriation provided in this 29 subsection the department of corrections shall not enter into 30 a lease or contractual agreement pursuant to section 904.809 31 with a private corporation for the use of building space for 32 the purpose of providing inmate employment without providing 33 that the terms of the lease or contract establish safeguards to 34 restrict, to the greatest extent feasible, access by inmates 35 -6- SF 562.2115 (1) 90 as/ns 6/ 27
working for the private corporation to personal identifying 1 information of citizens. 2 2. It is the intent of the general assembly that the seventh 1 judicial district department of correctional services maintains 2 the drug court operated by the district department. 3 h. For the eighth judicial district department of 4 correctional services: 5 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 9,238,778 6 2. Each judicial district department of correctional 7 services, within the moneys available, shall continue programs 8 and plans established within that district to provide for 9 intensive supervision, sex offender treatment, diversion of 10 low-risk offenders to the least restrictive sanction available, 11 job development, and expanded use of intermediate criminal 12 sanctions. 13 3. Each judicial district department of correctional 14 services shall provide alternatives to prison consistent with 15 chapter 901B. The alternatives to prison shall ensure public 16 safety while providing maximum rehabilitation to the offender. 17 A judicial district department of correctional services may 18 also establish a day program. 19 4. The office of drug control policy of the department 20 of public safety shall consider federal grants made to the 21 department of corrections for the benefit of each of the eight 22 judicial district departments of correctional services as local 23 government grants, as defined pursuant to federal regulations. 24 5. The department of corrections shall continue to contract 25 with a judicial district department of correctional services to 26 provide for the rental of electronic monitoring equipment which 27 shall be available statewide. 28 6. The public safety assessment shall not be utilized in 29 pretrial hearings when determining whether to detain or release 30 a defendant before trial until such time the use of the public 31 safety assessment has been specifically authorized by the 32 general assembly. 33 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 34 APPROPRIATIONS. Notwithstanding section 8.39, within the 35 -9- SF 562.2115 (1) 90 as/ns 9/ 27
moneys appropriated in this division of this Act to the 1 department of corrections, the department may reallocate the 2 moneys appropriated and allocated as necessary to best fulfill 3 the needs of the correctional institutions, administration 4 of the department, and the judicial district departments of 5 correctional services. However, in addition to complying with 6 the requirements of sections 904.116 and 905.8 and providing 7 notice to the legislative services agency, the department 8 of corrections shall also provide notice to the department 9 of management, prior to the effective date of the revision 10 or reallocation of an appropriation made pursuant to this 11 section. The department of corrections shall not reallocate an 12 appropriation or allocation for the purpose of eliminating any 13 program. 14 Sec. 7. INTENT —— REPORTS. 15 1. The department of corrections, in cooperation with 16 townships, the Iowa cemetery associations, and other nonprofit 17 or governmental entities, may use inmate labor during the 18 fiscal year beginning July 1, 2023, to restore or preserve 19 rural cemeteries and historical landmarks. The department, in 20 cooperation with the counties, may also use inmate labor to 21 clean up roads, major water sources, and other water sources 22 around the state. 23 2. By January 15, 2024, the department shall provide an 24 annual status report regarding private-sector employment to 25 the general assembly. The report shall include the number 26 of offenders employed in the private sector, the combined 27 number of hours worked by the offenders, the total amount of 28 allowances, and the distribution of allowances pursuant to 29 section 904.702, including any moneys deposited in the general 30 fund of the state. 31 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 32 corrections shall submit a report on electronic monitoring 33 to the general assembly by January 15, 2024. The report 34 shall specifically address the number of persons being 35 -10- SF 562.2115 (1) 90 as/ns 10/ 27
electronically monitored and break down the number of persons 1 being electronically monitored by offense committed. The 2 report shall also include a comparison of any data from the 3 prior fiscal year with the current fiscal year. 4 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 5 1. As used in this section, unless the context otherwise 6 requires, “state agency” means the government of the state 7 of Iowa, including but not limited to all executive branch 8 departments, agencies, boards, bureaus, and commissions, the 9 judicial branch, the general assembly and all legislative 10 agencies, institutions within the purview of the state board of 11 regents, and any corporation whose primary function is to act 12 as an instrumentality of the state. 13 2. State agencies are encouraged to purchase products from 14 Iowa state industries, as defined in section 904.802, when 15 purchases are required and the products are available from 16 Iowa state industries. State agencies shall obtain bids from 17 Iowa state industries for purchases of office furniture during 18 the fiscal year beginning July 1, 2023, exceeding $5,000 or 19 in accordance with applicable administrative rules related to 20 purchases for the agency. 21 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 22 1. There is appropriated from the general fund of the 23 state to the Iowa law enforcement academy for the fiscal year 24 beginning July 1, 2023, and ending June 30, 2024, the following 25 amount, or so much thereof as is necessary, to be used for the 26 purposes designated: 27 a. The Iowa law enforcement academy may select at least 5 five automobiles of the department of public safety, division 6 of state patrol, prior to turning over the automobiles to 7 the department of administrative services to be disposed 8 of by public auction, and the Iowa law enforcement academy 9 may exchange any automobile owned by the academy for each 10 automobile selected if the selected automobile is used in 11 training law enforcement officers at the academy. However, any 12 automobile exchanged by the academy shall be substituted for 13 the selected vehicle of the department of public safety and 14 sold by public auction with the receipts being deposited in the 15 depreciation fund maintained pursuant to section 8A.365 to the 16 credit of the department of public safety, division of state 17 patrol. 18 3. The Iowa law enforcement academy shall provide training 19 for domestic abuse and human trafficking-related issues 20 throughout the state. The training shall be offered at no 21 cost to the attendees and the training shall not replace any 22 existing domestic abuse or human trafficking training offered 23 by the academy. 24 Sec. 11. STATE PUBLIC DEFENDER. 25 1. Section 815.7, subsections 6 and 7, Code 2023, are 34 amended to read as follows: 35 -19- SF 562.2115 (1) 90 as/ns 19/ 27
6. For appointments made on or after July 1, 2021, through 1 June 30, 2022, the reasonable compensation shall be calculated 2 on the basis of seventy-six dollars per hour for class “A” 3 felonies, seventy-one dollars per hour for class “B” felonies, 4 and sixty-six dollars per hour for all other cases. 5 7. For appointments made on or after July 1, 2022, through 6 June 30, 2023, the reasonable compensation shall be calculated 7 on the basis of seventy-eight dollars per hour for class 8 “A” felonies, seventy-three dollars per hour for class “B” 9 felonies, and sixty-eight dollars per hour for all other cases. 10 Sec. 20. Section 815.7, Code 2023, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 7A. For appointments made on or after July 13 1, 2023, the reasonable compensation shall be calculated on the 14 basis of eighty-three dollars per hour for class “A” felonies, 15 seventy-eight dollars per hour for class “B” felonies, and 16 seventy-three dollars per hour for all other cases. 17 Sec. 21. NEW SECTION . 815.7A Travel time for attorney or 18 guardian ad litem. 19 1. Compensation for time spent by an attorney or guardian 20 ad litem traveling outside of the attorney’s or guardian ad 21 litem’s county of domicile is payable when the travel is 22 reasonable and necessary to represent the indigent client and 23 shall be calculated at a rate of thirty-five dollars per hour. 24 Compensation for travel for a court proceeding other than a 25 trial or other contested proceeding shall only be paid if the 26 attorney or guardian ad litem files a motion for a remote 27 hearing and the motion is denied. This section does not affect 28 any allowable compensation for time spent traveling already 29 compensated pursuant to any other applicable provision of law. 30 2. Compensation for travel for an arraignment, pretrial 31 conference, scheduling conference, or any other uncontested or 32 nontestimonial judicial proceeding, for which a request for a 33 remote hearing was denied, paid to the attorney or guardian ad 34 litem from the indigent defense fund created in section 815.11 35 -20- SF 562.2115 (1) 90 as/ns 20/ 27
shall be reimbursed by the judicial branch. 1 3. For purposes of this section, “county of domicile” means 2 the address the attorney or guardian ad litem has on file with 3 the office of the state public defender. 4 DIVISION III 5 ATTORNEY GENERAL —— ANTITRUST FUND —— CONSUMER EDUCATION AND 6 LITIGATION FUND 7 Sec. 22. 2014 Iowa Acts, chapter 1138, section 21, as 8 amended by 2016 Iowa Acts, chapter 1137, section 18, 2017 Iowa 9 Acts, chapter 167, section 24, 2019 Iowa Acts, chapter 163, 10 section 26, and 2021 Iowa Acts, chapter 166, section 23, is 11 amended to read as follows: 12 SEC. 21. CONSUMER EDUCATION AND LITIGATION 13 FUND. Notwithstanding section 714.16C , for each fiscal 14 year of the period beginning July 1, 2014, and ending June 15 30, 2023 2025 , the annual appropriations in section 714.16C , 16 are increased from $1,125,000 to $1,875,000, and $75,000 to 17 $125,000 respectively. 18 Sec. 23. DEPARTMENT OF JUSTICE LITIGATION 19 FUNDS. Notwithstanding sections 553.19 and 714.16C, 20 for the fiscal years beginning July 1, 2022, and ending June 21 30, 2023, and beginning July 1, 2023, and ending June 30, 22 2024, any moneys not otherwise appropriated from the antitrust 23 fund created in section 553.19 and the consumer education and 24 litigation fund created in section 714.16C are appropriated to 25 the department of justice for salaries, support, maintenance, 26 and miscellaneous purposes necessary to perform the duties 27 described in section 13.2. 28 Sec. 24. EFFECTIVE DATE. The following, being deemed of 29 immediate importance, takes effect upon enactment: 30 The section of this division of this Act regarding the use of 31 moneys not otherwise appropriated from the antitrust fund and 32 the consumer education and litigation fund. 33 Sec. 25. RETROACTIVE APPLICABILITY. The following applies 34 retroactively to July 1, 2022: 35 -21- SF 562.2115 (1) 90 as/ns 21/ 27
The section of this division of this Act regarding the use of 1 moneys not otherwise appropriated from the antitrust fund and 2 the consumer education and litigation fund. 3 DIVISION IV 4 DEPARTMENT OF CORRECTIONS 5 Sec. 26. Section 904.317, Code 2023, is amended to read as 6 follows: 7 904.317 Director may buy and sell real estate —— options. 8 1. The director, subject to the approval of the board, may 9 secure options to purchase real estate and acquire and sell 10 real estate for the proper uses of the institutions. Real 11 estate shall be acquired and sold upon terms and conditions 12 the director recommends subject to the approval of the board. 13 Upon sale of the real estate, the proceeds shall be deposited 14 with the treasurer of state and credited to the general fund 15 of the state in a corrections capital reinvestment fund, which 16 is established in the state treasury under the purview of 17 the department . There is appropriated from the general fund 18 of the state to the department a sum equal to the proceeds , 19 so deposited and credited to the general fund of the state 20 which may be used to purchase other real estate or for capital 21 improvements upon property under the director’s supervision. 22 Notwithstanding section 8.33, moneys in the fund that remain 23 unencumbered or unobligated at the close of a fiscal year shall 24 not revert but shall remain available for expenditure for the 25 purposes designated. Notwithstanding section 12C.7, subsection 26 2, interest or earnings on moneys in the fund shall be credited 27 to the fund. 28 2. The costs incident to the securing of options and 29 acquisition and sale of real estate including, but not limited 30 to, appraisals, invitations for offers, abstracts, and other 31 necessary costs, may be paid from moneys appropriated for 32 support and maintenance to the institution at which the real 33 estate is located. The fund funding source for these costs 34 shall be reimbursed from the proceeds of the sale. 35 -22- SF 562.2115 (1) 90 as/ns 22/ 27
Sec. 27. TRANSFER. Moneys remaining in the general 1 fund of the state on June 30, 2023, from the sale of real 2 estate pursuant to section 904.317, that are available to the 3 department of corrections are transferred to the corrections 4 capital reinvestment fund established in section 904.317, as 5 amended in this division of this Act. 6 Sec. 28. EFFECTIVE DATE. This division of this Act takes 7 effect June 30, 2023. 8 DIVISION V 9 IOWA LAW ENFORCEMENT ACADEMY STUDY 10 Sec. 29. IOWA LAW ENFORCEMENT ACADEMY INTERIM STUDY 11 COMMITTEE. 12 1. The legislative council is requested to establish an Iowa 13 law enforcement academy interim study committee to do all of 14 the following: 15 a. Review and evaluate minimum entrance requirements, the 16 course of study, attendance requirements, and the sufficiency 17 of current equipment and facilities. 18 b. Review and evaluate minimum basic training requirements. 19 c. Review and evaluate minimum standards of physical, 20 mental, educational, and moral fitness. 21 d. Consider additional locations for law enforcement 22 training schools and current and future facility needs. 23 2. The committee shall include all of the following members: 24 a. Ten members of the general assembly, including five 25 members of the senate, three of whom shall be appointed by 26 the majority leader of the senate and two of whom shall be 27 appointed by the minority leader of the senate, and five 28 members of the house of representatives, three of whom shall be 29 appointed by the speaker of the house of representatives and 30 two of whom shall be appointed by the minority leader of the 31 house of representatives. 32 b. The director of the Iowa law enforcement academy or the 33 director’s designee. 34 c. A member of the Iowa law enforcement academy council. 35 -23- SF 562.2115 (1) 90 as/ns 23/ 27
d. A sheriff of a county with a population of fifty thousand 1 or more who is a member of the Iowa state sheriffs and deputies 2 association. 3 e. A police chief of a city with a population of fifty 7 thousand or more who is a member of the Iowa police chiefs 8 association. 9 g. A police chief of a city with a population of less 10 than fifty thousand who is a member of the Iowa police chiefs 11 association. 12 h. A police officer who is a member of a police department 13 of a city with a population of fifty thousand or more who is a 14 member of the Iowa peace officers association. 15 i. A police officer who is a member of a police department 16 of a city with a population of less than fifty thousand who is a 17 member of the Iowa peace officers association. 18 j. The commissioner of the department of public safety or 19 the commissioner’s designee. 20 k. A member of the Iowa county attorneys association. 21 l. The attorney general or the attorney general’s designee. 22 m. The governor or the governor’s designee. 23 3. Members of the committee other than members of the 24 general assembly shall be nonvoting members. 25 4. The committee shall issue a report, including findings 26 and recommendations, to the governor and the general assembly 27 no later than December 15, 2023. 28 DIVISION VI 29 HUMAN TRAFFICKING STUDY 30 Sec. 30. HUMAN TRAFFICKING INTERIM STUDY COMMITTEE. 31 1. The legislative council is requested to establish a human 32 trafficking interim study committee to do all of the following: 33 a. Identify current initiatives to eliminate the human 34 trafficking of minors in the state. 35 -24- SF 562.2115 (1) 90 as/ns 24/ 27
b. Identify current services available in the state for 1 minor victims of human trafficking. 2 c. Identify and investigate the laws of other states that 3 focus on minor victims of human trafficking, concentrating on 4 those states that border Iowa, to determine if another state’s 5 model would be effective in Iowa. Recommendations shall 6 include funding needs for any services or programs. 7 d. Research and recommend a model of rehabilitative 8 services for minor victims of human trafficking that includes 9 input from law enforcement, social services organizations, the 10 judicial system, and mental health professionals. 11 e. Identify barriers that prevent minor victims of human 12 trafficking from seeking legal assistance or medical attention. 13 f. Create a procedure to be followed by all law enforcement 14 officers statewide if a law enforcement officer encounters a 15 minor who may be a victim of human trafficking. 16 g. Investigate the efficacy of safe harbor laws. 17 h. Investigate and identify potential routes to eliminate 18 human trafficking of minors in the state. 19 i. Make recommendations on appropriate human 20 trafficking-related training for law enforcement officers, 21 county attorneys, and juvenile service officers. 22 j. Identify funding needs based upon recommendations made 23 by the committee. 24 2. The committee shall include all of the following members: 25 a. Three members of the senate, two of whom shall be 26 appointed by the majority leader of the senate, and one of whom 27 shall be appointed by the minority leader of the senate. 28 b. Three members of the house of representatives, two 29 of whom shall be appointed by the speaker of the house of 30 representatives, and one of whom shall be appointed by the 31 minority leader of the house of representatives. 32 c. The chief of police or head law enforcement official of 5 a city in this state with a population of two hundred thousand 6 or more as determined by the most recent population estimates 7 issued by the United States bureau of census. 8 i. The chief of police or head law enforcement official of 9 a city in this state with a population of less than two hundred 10 thousand as determined by the most recent federal decennial 11 census. 12 j. A county sheriff. 13 k. Up to two county attorneys who serve on child protection 14 assistance teams under section 915.35, subsection 4, paragraph 15 “a”. 16 l. Up to two members of the public who are former human 17 trafficking victims. 18 m. Up to two criminal defense attorneys with experience in 19 human trafficking cases. 20 n. A representative from the Iowa network against human 21 trafficking. 22 3. Members of the committee other than members of the 23 general assembly shall be nonvoting members. 24 4. The committee shall issue a report, including findings 25 and recommendations, to the governor and the general assembly 26 no later than December 15, 2023. 27 DIVISION VII 28 DIRECTIVE —— DEPARTMENT OF PUBLIC SAFETY 29 Sec. 31. DEPARTMENT OF PUBLIC SAFETY —— PEACE OFFICERS’ 30 RETIREMENT, ACCIDENT, AND DISABILITY SYSTEM. For the fiscal 31 year beginning July 1, 2023, and ending June 30, 2024, the 32 department of public safety shall pay to the peace officers’ 33 retirement, accident, and disability system created in chapter 34 97A, from moneys appropriated in this Act to the department 35 -26- SF 562.2115 (1) 90 as/ns 26/ 27
of public safety for the division of state patrol, the amount 1 sufficient to fund the actuarial cost of the remaining transfer 2 identified in 2023 Iowa Acts, Senate File 513, after the 3 trustee-to-trustee lump sum transfer required by that Act has 4 been performed. 5 Sec. 32. CONTINGENT EFFECTIVE DATE. This division of this 6 Act takes effect July 1, 2023, if 2023 Iowa Acts, Senate File 7 513, is enacted. > 8 2.
